    Suna East MP Junet Mohamed has been ordered to pay 6 million shillings in damages to Nyali MP Mohammed Ali, for making inappropriate comments about him on social media.

    The court said that the comments harmed Ali’s reputation and religious standing.

    “The tweet portrayed the plaintiff as a hypocrite who professes Islamic faith yet goes against its core teachings. This can largely be deciphered from how the other Twitter users reacted to the impugned tweet,” part of the court ruling reads.

    “In the upshot, I find that the plaintiff proved all the elements of the tort of defamation against the defendant,” it added.

    In 2022, the Nyali MP accused his Suna East colleague of defamation by alluding that he was having a sexual affair with a Twitter user Aoko.

    Kenya’s High Commissioner to the United Kingdom Manoah Esipisu, has been voted the 2024 Diplomat of the Year from Africa at the 2024 Diplomat of the Year Awards held this week on Monday in London.

    The annual awards – which are now in their fourteenth year – are hosted by the DIPLOMAT magazine to recognize the outstanding work and achievements of London’s diplomatic community who are trying to better their nations’ well-being.

    Appointed to the United Kingdom High Commissioner role in July 2018, Manoah has been pivotal in enhancing relations between Kenya and the United Kingdom across trade and investment.

    “Last year was great for Kenya-UK relations. The King was hosted by our President. The King hosted the Kenyan Community in the UK. Bilateral trade continued to flourish. New climate smart projects kicked off.  New jobs in agriculture in the UK came on stream. Our health partnership strengthened. Education partnerships and innovation flourished. Security and Defence Cooperation also strengthened,” Manoah said after receiving the award.

    “For me, performing at the highest level is only possible for the support I get every day, from my staff at the Kenya High Commission London who are represented here.”

    Commenting on the awards, DIPLOMAT’s Editor, Venetia de Blocq van Kuffeler, said: “As the global centre for diplomacy, London has become more important than ever. This is an award ceremony for diplomats, with winners chosen by diplomats. This evening is about hard work and technique. It’s about people and professionalism.”

    DIPLOMAT magazine identifies 10 categories that recognise different levels of diplomacy, and winners are nominated by their peers.

    115 MPs Files Motion To Impeach Agriculture CS Linturi

    Bumula Member of Parliament Jack Wamboka has filed a notice of motion to impeach Agriculture Cabinet Secretary Mithika Linturi.

    The motion which is supported by 110 legislators cites that the CS should be removed from office due to gross violation of the constitution and criminal negligence under the Penal Code.

    Linturi becomes the second member of President William Ruto’s cabinet to face such a motion, this is after Embakasi East MP Babu Owino presented a motion seeking the removal of Health Cabinet Secretary Susan Nakhumicha.

    Nakhumicha has been faulted over her handling of the prolonged doctors’ strike that have paralyzed services in public hospitals, respectively.

    Wamboka seeks to edge out the embattled CS over his role in approving the procurement and distribution of fake fertilizer under the National Cereals and Produce Board (NCPB) channels.

    In the petition for the removal, Linturi is accused of exposing farmers to fraudsters who have hoodwinked them saying the quest for the removal of the Cabinet Secretary is not political or a witch-hunt.

    “I firmly believe that the gravity of this allegations demand swift and decisive action as elected representatives it’s our duty to hold public officers accountable and to safeguard the interests of the people that we serve,” Wamboka noted.

    The Bumula legislator insisted that the Agriculture Cabinet Secretary has treated farmers to a circus which will evidently affect food security in the country.

    “Agriculture is such a key sector, we want to tell the president, please don’t allow one rogue minister to derail your agenda of attaining food security in the country,” the Bumula MP stated.

    Wamboka confidently stated that his petition holds serious ground for the removal of the Cabinet Secretary urging Speaker Wetangula to pave way for MPs to send Linturi home.

     “The evidence presented before the assembly paints a distressing picture of negligence, mismanagement and potential of criminal activities within the ministry,” he said.

    Laikipia North MP Sarah Korere who promised to second the motion on the floor of the house called upon CS Linturi to resign before the wrath of lawmakers is waged on him during the consideration of the impeachment motion.

    “We want to tell the CS to step aside before we impeach him, even if investigations were to happen, it won’t be thorough if he is still in the office, if investigations will find him innocent, he can always come back,” she said.

    President William Ruto allies who have signed the motion to remove CS Linturi from office include Maryanne Kitany (Aldai),Pauline Lenguris (Samburu MP), Adams Korir (Keiyo North), Gathoni Wamuchomba (Githunguri), James Wamacukuru (Kabete) and Geoffrey Ruku (Mbeere North).

    Notable Azimio La Umoja One Kenya lawmakers include Joyce Kamene (Machakos), Raphael Wanjala (Budalangi ),Otiende Amollo (Rarieda ), Samuel Parashina (Kajiado South) and Adagala Beatrice (Vihiga).

    Others include Stephen Mogaka (West Mugirango,) ,Clive Gisairo (Kitutu Masaba) and Mohamed Adow (Wajir South, ODM), David Pkosing (Pokost South, KUP).

    The Constitution provides for the removal of a Cabinet Secretary under Article 152.

    The mover of the motion is required to file evidence alongside a list of legislators in support of the bid.

    Speaker of the National Assembly considers the threshold of evidence presented before clearing the matter for tabling.

    Speaker Wetangula’s clearance would pave the way for a 7-day notice with the mover moving the motion within fourteen days.

    The House will then set up a Select Committee upon ascertaining support by a third of its membership.

    The Select Committee will be required to probe the allegations and submit its findings to the House within ten days.

    Where the Select Committee finds ground for removal, the Cabinet Secretary will appear in the National Assembly for a trial.

    The matter will then be settled by a majority vote with the Speaker transmitting the House resolution to the President for action.

    Authorities in Tanzania have shut down five hydroelectric stations in a bid to reduce excess electricity in the national grid, the country’s prime minister has said.

    Kassim Majaliwa said the main plant, Mwalimu Nyerere Hydroelectric Station, has alone generated enough electricity to power major cities, including Dar es Salaam, the country’s commercial hub.

    “We have turned off all these stations because the demand is low and the electricity production is too much, we have no allocation now, “ an official from state-run power company, Tanesco, said.

    The 2,115 MW Julius Nyerere hydropower dam is said to be almost full with water, following heavy rains that started early this year.

    A current spell of extreme weather has caused at least 58 deaths in Tanzania and devastated other East African nations like Kenya.

    It is the first time Tanzania, which suffers chronic power shortages, has closed hydroelectric stations due to excess production.

    No, TikTok will not suddenly disappear from your phone. Nor will you go to jail if you continue using it after it is banned.

    After years of attempts to ban the Chinese-owned app, including by former President Donald Trump, a measure to outlaw the popular video-sharing app has won congressional approval and is on its way to President Biden for his signature. The measure gives Beijing-based parent company ByteDance nine months to sell the company, with a possible additional three months if a sale is in progress. If it doesn’t, TikTok will be banned.

    So what does this mean for you, a TikTok user, or perhaps the parent of a TikTok user? Here are some key questions and answers.

    WHEN DOES THE BAN GO INTO EFFECT?

    The original proposal gave ByteDance just six months to divest from its U.S. subsidiary, negotiations lengthened it to nine. Then, if the sale is already in progress, the company will get another three months to complete it.

    So it would be at least a year before a ban goes into effect — but with likely court challenges, this could stretch even longer, perhaps years. TikTok has seen some success with court challenges in the past, but it has never sought to prevent federal legislation from going into effect.

    WHAT IF I ALREADY DOWNLOADED IT?

    TikTok, which is used by more than 170 million Americans, most likely won’t disappear from your phone even if an eventual ban does take effect. But it would disappear from Apple and Google’s app stores, which means users won’t be able to download it. This would also mean that TikTok wouldn’t be able to send updates, security patches and bug fixes, and over time the app would likely become unusable — not to mention a security risk.

    BUT SURELY THERE ARE WORKAROUNDS?

    Teenagers are known for circumventing parental controls and bans when it comes to social media, so dodging the U.S. government’s ban is certainly not outside the realm of possibilities. For instance, users could try to mask their location using a VPN, or virtual private network, use alternative app stores or even install a foreign SIM card into their phone.

    But some tech savvy is required, and it’s not clear what will and won’t work. More likely, users will migrate to another platform — such as Instagram, which has a TikTok-like feature called Reels, or YouTube, which has incorporated vertical short videos in its feed to try to compete with TikTok. Often, such videos are taken directly from TikTok itself. And popular creators are likely to be found on other platforms as well, so you’ll probably be able to see the same stuff.

    “The TikTok bill relies heavily on the control that Apple and Google maintain over their smartphone platforms because the bill’s primary mechanism is to direct Apple and Google to stop allowing the TikTok app on their respective app stores,” said Dean Ball, a research fellow with the Mercatus Center at George Mason University. “Such a mechanism might be much less effective in the world envisioned by many advocates of antitrust and aggressive regulation against the large tech firms.”

    Migori County Assembly Speaker Charles Likowa has been impeached by the Members of the County Assembly (MCAs) over alleged mishandling of House affairs.

    Tuesday’s impeachment motion was passed by 59 out of 60 MCAs present during the afternoon session.

    The majority of the MCAs accused the Speaker of poor management of the County Assembly matters and a lack of accountability over the Assembly’s finance affairs.

    Led by Majority Leader Ken Ouma, the MCAs said that they have not been paid their committee allowances for a long time. Ouma said that Likowa has not been giving any proper reason or explanation, which shows a lack of respect for the members of the county assembly.

    Ouma said the failure of the Speaker to run the County Assembly as per the expectations of the MCAs has disrupted House business.

    North Kamagambo MCA Collins Osewe also acknowledged that since December, the MCAs have not held any House Assembly committees which has hugely affected the discharge of duties as expected.

    “The Speaker has not been looking into the welfare of our members and it was important that the MCAs relook and reassess to make an informed choice on the way forward,” lamented Osewe.

    Migori Deputy Speaker and Bukira East MCA Mathews Chacha who assumed the role of interim Speaker disclosed that he was going to work together with all the MCAs to address the issues that have been ailing the County Assembly.

    Likowa’s impeachment comes at a time when he has been battling cases in court challenging his election as the Speaker of the Migori County Assembly.

    In February 2023 activist Isaac Aluochier, who vied to become Migori County Assembly Speaker but lost, contested the victor, Charles Owino Likowa’s victory in court.

    High Court Judge Roseline Wendoh ruled that Likowa’s election was null and void as legal compliance with the poll’s conduct was proven.

    The court ordered that a fresh election be conducted in 21 days, but Likowa’s lawyer sought stay orders to allow the filing of an appeal.

    Ethics and Anti-Corruption Commission (EACC) detectives on Wednesday raided the Nairobi and Marsabit homes of former Treasury Cabinet Secretary Ukur Yatani  and Governor Ali Mohammud Mohammed over alleged corruption.

    The two were interrogated separately over alleged embezzlement of funds from Marsabit County Government.

    While Yattani was picked from his Nairobi home, Governor Mahammud was arrested in Marsabit, the two said to have been involved in the alleged embezzlement of Ksh 8.2 billion from Marsabit County.

    The commission managed to impound computers, documents and two safes from the Former Treasury CS residences which they maintained are crucial to the investigations.

    Yatani was grilled by the detectives at Integrity Center and was accompanied by his lawyers Senior Counsel James Orengo and Otiende Amollo.

    Mohamud, on the other hand was grilled in Isiolo.

    Members of the public who rushed to the helicopter crash scene where Chief of Defence Forces Gen Francis Ogolla and eight of his juniors died stole some items belonging to the victims.

    A military probe team known as Board of Inquiry, spearheaded by Commander of Laikipia Airbase, Brig Mohamed Salah Farah has been established to investigate the April 18 military chopper crash.

    The detectives have already visited the sorrounding villages where the crash happened at Kaben-Cheptulel border between Elgeyo Marakwet and West Pokot in the banditry prone North Rift region to recover the stolen items.

    According to the detectives, some of the valuables include watches, mobile phones and shoes believed to have been taken by first responders to the scene.

    By yesterday, some of the mobile phones were still being switched on and off, suggesting that those keeping them were wary of being tracked down for handling stolen property.

    General Ogolla’s family said the only thing that was handed over to them by the military from the site was his wedding ring.

    Some of the bodies were intact when
    they were picked from the scene while others were burnt following the crash that happened soon after the chopper had tak- en off. “Some of these people are walking around with the valuables including mo- bile phones and shoes of the victims,” said an official, adding, the items are needed as part of the ongoing probe.

    The team has contacted local leaders to help in talking to the said responders who are yet to surrender the valuables.

    Police are also helping with the probe. One of the items the probe team will be seeking to recover is the fallen General’s Bible, which is said to have disappeared during the crash.

    Speaking at the fallen General’s memo- rial service at the Ulinzi Sports Complex in Lang’ata, Nairobi, Joel, his son, sent out an impassioned plea to the military to re- cover his father’s treasured Bible, saying he would want to preserve it as a memento.
    Precious possession

    “As he lies here with his uniform, I see they put his medals, his sword and boots. He loved it as a tool for the job but nothing more. Don’t be under any illusion that he thinks he is important once he breathed his last,” Joel noted.

    He went on to tell the gathering which included the President and Commander In Chief of the Kenya Defence Forces William Ruto how his father treasured his Bible, at times engaging his family in a Bible com- petition. “Somewhere in the helicopter wreck is his Bible, which was his most pre- cious possession, Joel went on, as he eulo- gized his father.

    Anyone who worked with his father, Joel added, would attest that he always carried a Bible with him wherever he went.

    He implored the team that visited the ac- cident scene, and probably the investiga- tions team too, to try their best and retrieve the Holy Book.

    “I am hoping that they are able to re- trieve it from the accident (scene). I’d want to keep it as a memento and for the rest of the family as well,” he said.

    Thorough probe

    Leaders have called for an investigation into the crash to rule out foul play.

    President William Ruto promised to en- sure investigation into the crash and the report made public.

    Speaking during the service at Senator Barack Obama’s Primary School in Siaya, Ruto expressed confidence in the professionalism of the military in probing the he- licopter crash. “The Kenya Defence Forces is as concerned as I am on the life of Ogolla. There will be no shroud of doubt on what happened to General Ogolla,” he said.

    Find closure

    The President declared that there will never be cases of extra-judicial killings or political assassinations in his regime.

    “There shall never be extra-judicial kill- ings or political assassinations in Kenya under my watch,” he said.

    Leaders demanded that the outcome of the investigation be made public to enable Nyanza region that has lost several gallant sons in the past, to find closure.

    Siaya Senator and ODM leader Raila Odinga’s elder brother Oburu Oginga said no stone should be left unturned in the probe into Ogolla’s death.

    Kanye West Gets Involved In Drake, J Cole And Kendrick Lamar’s Beef

    Rapper Kanye West has weighed in on the simmering beef between Drake, J Cole and Kendrick Lamar.

    The beef has been escalating since last year when Cole referred to the trio as “the big three”, a description that Lamar forcefully rejected.

    West, a long-time adversary of Drake, has now added his two cents on a remix of Lamar, Future and Metro Boomin’s song “Like That”.

    “I can’t even think of a Drake line,” he said, attacking the star’s lyrics.

    West also criticised Drake’s record deal with Universal Music, suggesting he’d sold the rights to his music for “little bag” (money).

    “Lifetime deal? I feel bad for [you],” he said.

    West’s remix was premiered on Justin Laboy’s radio show The Download – and opened with the line “Yo Dot, I got you,” a reference to Lamar’s nickname, K-Dot.

    He only played a snippet of the song and, although a fuller version later leaked online, it was unclear whether that was genuine or fan-made.

    West and Drake’s animosity can be traced back to a dispute over a beat in 2018 – and culminated in an infamous song by Pusha T (and produced by West), where he revealed the existence of Drake’s son Adonis.

    The latest war of words started on last year’s Drake and J Cole collaboration “First Person Shooter”, where the “big three” claim originated.

    The seemingly innocuous comment went unremarked for months. Then, in the middle of March, Lamar delivered a fiery verse on “Like That”, declaring that there was no “big three – it’s just big me”.

    He went on to call Drake and Cole’s best verses insubstantial (“a light pack”) and claimed he was the Prince to Drake’s Michael Jackson.

    Two weeks later, J Cole offered his own reply to Kendrick’s verse, in a track called “7 Minute Drill”. 

    He called the Pulitzer Prize winner’s last album, Mr Morale and The Big Steppers, “tragic” and said the star had “fallen off” his A-game.

    He later apologised, appearing to back out of the feud, but Drake doubled down, with a song called “Push Ups (Drop And Give Me 50)”.

    Amidst a lot of comments about Lamar’s height, he also suggested the star was a record label puppet who’d been forced to add verses to commercial pop songs by Maroon 5 and Taylor Swift.

    “Pipsqueak, pipe down, you ain’t in no Big Three,” he added.

    Lamar appears to be uninterested in responding, but Drake seems determined to provoke a response.

    On Friday, the Canadian star released a new track called “Taylor Made Freestyle” – in which he suggested Lamar was unwilling to engage in the feud because he was in cahoots with Swift, and didn’t want to overshadow (or be overshadowed) by her album release.

    “If you ’bout to drop, she gotta approve/This girl really ’bout to make you act like you not in a feud,” he goaded: “Yeah, shoutout to Taylor Swift/Biggest gangster in the music game right now.”

    The song also appeared to feature AI vocals from Lamar’s rap hero Tupac Shakur and Snoop Dogg. Their verses also tried to prompt a response from the star.

    “Kendrick we need ya, the West Coast saviour/Engraving your name in some hip-hop history,” advised the AI Shakur.

    “World is watching this chess game, but are you out of moves?” admonished the AI Snoop Dogg.

    Of course, all of this is good for business. Both “Like That” and “Push Ups” are among the Top 40 most-played songs on Spotify.

    Fake NGO Director Seth Orinda Charged In Sh291M Fraud

    A notorious fraudster pretending to be a director of a leading humanitarian Non Governmental Organization has been charged with obtaining goods worth over Sh 291 million.

    Seth Orinda appeared before Milimani Senior Principal Magistrate Robinson Ondiek and denied the charges.

    Orinda is accused that on diverse dates between 7th of August and 28th November last year at MOL logistics in Embakasi in Nairobi jointly with others not before court with intent to defraud obtained food stuffs worth Sh291, 160,000.

    He obtained the goods from Frontline Tarkipa Media Limited by falsely pretending that he was director of Development Aid Africa who were to pay for the goods.

    The goods include, 23,000 90kgs bags of white maize and 8,500 jericans of 20 litres Pika cooking oil.

    Prosecution further charged Orinda with unlawfully making a contract agreement with the logo of Development Aid Africa purporting it to be a true contract agreement originating from a registered NGO called Development Aid Africa.

    He is alleged to have committed this offense on the 8th August, 2023 along General Mathenge Road in Westlands, Nairobi, jointly with others not before court and with intent to defraud.

    Orinda is further charged with unlawfully making two purchase orders NO. 000114 and 000115 with the logo of Development Aid Africa purporting it to be true purchase orders originating from a registered NGO called Development Aid Africa.

    He is further charged with uttering the fraudulent contract agreement and purchase orders with the logo and stamp for Development Aid Africa dated 7th August 2023 which had been made by Seth Orinda without lawful authority.

    The court also heard that on diverse dates between 7th August, and 28th November, 2023 along General Mathenge Road in Westlands, with intent to defraud Frontline Tarkipa Media Limited the said goods,Orinda falsely presented himself as the director Development Aid Africa.

    Sh33 million fraud

    Separately, under the same pretext, Orinda alongside Leon Otieno and Richard Mwaniki were charged last year in January with fraudulently obtaining goods worth Sh33 million.

    They were accused of conspiring to obtain goods worth Sh8,360,000 from Rajula Adimo.

    They allegedly committed the offence between November 15, 2022 and December 23, 2022 in Westlands, Gigiri subcounty, as directors of Development Aid Africa.

    They were charged with another count of intent to defraud.

    They allegedly asked to be supplied with 4,500 jerricans of 20 litres cooking oil from businessman Hussein Adow Mohamed by falsely pretending they were in position to pay Sh24.7 million.

    It is alleged they committed the offence on diverse dates between November 5 and December 23, 2022 in Westlands, Nairobi.

    They are also accused of obtaining 1,520 jerricans of 20 litres cooking oil from Rajula Adimo by falsely pretending they were executive directors of Development Aid Africa and were in a position to pay him Sh8,360,000.

    The charge sheet further stated that Orinda, Otieno and Mwaniki (claimed to be the transporter) dishonestly received or retained 290 of jerricans of 20 litres of cooking oil from Adow of Yustro Construction and Logistics Company knowing or having knowledge they were stolen goods.

    Orinda was further charged with money laundering and acquisition of proceeds of crime.

    The court heard that he entered into an arrangement with Abdiwahab Aden Arte to receive Sh4,332,000 being the proceeds of 1,040 jerricans of 20 litres cooking oil that were obtained by false pretence.

    They denied the charges before Milimani senior principal magistrate Esther Kimilu.

    The court ordered Orida to deposit Sh2 million bond or alternative cash bail of Sh800,000 to secure his release.

    The winner of Beijing’s half marathon He Jie and three African runners have had their results cancelled after an investigation found that the three slowed down near the line allowing the Chinese athlete to finish first, organisers said on Friday.

    He had won the race held last Sunday in China’s capital in a time of 1:03:44, a second ahead of Ethiopian Dejene Hailu Bikila, and Kenyans Robert Keter and Willy Mnangat, who tied for second place.

    The organising committee said in a statement that the three African runners “actively slowed down in the last 2 kilometres and as a result He Jie won the men’s championship.”

    All trophies, medals and bonuses will be withdrawn and the athletes will be reported to the Chinese Athletics Association, it said.

    Race operator, the Zhongao Lupao Beijing Sports Management company, will also be disqualified from hosting and operating the Beijing half marathon, the committee added.

    Mnangat told the BBC that the trio ran as pacemakers and were not competing.

    However, the committee said pacers would not have been allowed to participate as specially invited athletes without organisers’ approval.

    The Zhongao Lupao Beijing Sports Management company said its partner Xiamen Xtep Investment, a unit of Hong Kong listed Xtep 1368.HK, failed to note the relevant pacer information, which led to the organising committee not being informed.

    “Our company has unshirkable responsibility and would like to experience our sincere apologies to all runners.” He has been sponsored by Xtep since 2021 according to its website.

    Xtep said staff had made a mistake during the registration process and did not identify the pacers.

    “We bear a great responsibility and fully accept the punishment decision made by the organising committee,” Xtep said in a statement.

    He was slightly behind the three African runners as they approached the end of the race but they slowed down and waved the Chinese athlete ahead as they gestured towards the finish line. The four had run together throughout the race of just over 13 miles.

    The finish drew widespread scepticism with some social media users commentating that the result was “embarrassing” for He, a member of China’s marathon team and national record holder.

    Long distance running races are increasingly popular in China but have a chequered history of cheating and poor organisation. In Shenzhen’s 2018 half marathon 258 participants were caught cheating, most of whom had taken shortcuts while some wore fake bibs and others were impostors.

    Opera Mini Browser has stopped its free data plans that Kenyans have been enjoying since 2020.

    The firm blames the  local authorities’ decision, including the Betting Control and Licensing Board, to stop offensive advertising on Speed Dials (bookmarks on the start page) within browsers.

    “Unfortunately, for now, we have had to stop our much-loved Free Data Campaigns in Kenya for our 13.5 million local Opera users. We had to put a hold on investments and free internet access in Kenya, but we are hoping for a solution so that we can once again provide free data to you, our valued customers in Kenya,” the firm said in a statement.

    Previously, campaigns run by Opera offered up to 1.5GB of free data monthly, a move the firm said significantly enhanced digital inclusion across various demographics.

    “The Betting Control and Licensing Board (BCLB) decision means over 13 million Kenyans will not get 50MB of free data every day. The users who benefited from them now face barriers to accessing the web,” said the firm.

    ”Before the regulatory changes, Opera shared plans for an extensive investment for the upcoming year, meeting or even exceeding the previous year’s amount spent on Free Data campaigns in Kenya. However, the BCLB’s decision has placed these plans on indefinite hold, creating uncertainty about the future of these campaigns.”

    Free data campaigns have been a key aspect of Opera’s Africa First strategy to attract as many users to use their services while partnering with other SPs.

    Opera regularly partners with local telcos to coordinate free data campaigns. Opera has already facilitated for nearly 40 million people across five countries to benefit from up to 3 GB of free browsing each month.

    According to StatCounter, Opera has over 13 million users in Kenya, accounting for almost 50 per cent of the mobile market share in February 2024, splitting the market with Google’s Chrome. In 2023 alone, the company provided over four million GB of data for free valued at Sh1.6 billion as part of its campaign to enhance digital inclusion in the country.

    Kenya’s new data protection regulations came into effect in 2022, governing what businesses inside and outside the country can do with information about citizens. The law has far-reaching implications for how companies and how they process data.

    For instance, it is now unlawful to collect, process or disclose a data subject’s (an individual person) information without their permission or sell any personal data without their express consent. It also stipulates that if you process people’s data, you must be registered with the office of the Data Commissioner.

    BCLB order

    In February 2024, the Betting Control and Licensing Board (BCLB) initiated the enforcement of a High Court order prohibiting all gaming operators from utilizing the speed dial feature on internet browsers, primarily provided by the Opera Mini Browser and Google.

    This action marked a victory for the Consumer Federation of Kenya (COFEK) and consumers following a petition filed by the consumer lobby.

    The speed dial feature in Opera is a function that allows a user to have favorite websites on a start page, making it fast and easy to access them. It also allows one to create folders and group similar websites together.

    COFEK raised concerns in their petition, alleging that betting firms were exploiting the feature to target Kenyan internet users indiscriminately, irrespective of age.

    Affected gaming companies include Betika, OdiBets Kenya, Sportpesa, Peteta, and 1XBET Kenya, among others.

    Cofek had initially written to the BCLB demanding for action that such licensed firms be removed from the speed dial platform as it was hurting minors and forcing many unsuspecting children to be addicted to gambling and betting.

    COFEK expressed in a letter to BCLB, “Based on our research and consultations with line experts, we hereby confirm that browser providers, such as Opera, have introduced a “speed dial” feature, specifically curated for the Kenyan market. This offending feature, sponsored by betting firms (your licensees), ensures these betting services are prominently displayed, regardless of the user’s age, religion and other diversities.”

    The speed dial feature provides a convenient way to access frequently visited websites. However, and as a result of this, it compromises internet safety practices by exposing minors who cannot avoid clicking on suspicious links or downloading unknown files from these sites.

    COFEK emphasized that the continuous display of betting advertisements posed a significant risk to millions of underage citizens who could access smart devices intermittently, with or without permission from parents or guardians.

    For example, COFEK pointed out that a browser like Opera Mini had introduced a speed dial feature tailored for Kenya, displaying five to seven shortcuts to leading betting firms on any given day.

    BCLB acknowledges that gaming operators adopted the speed dial feature, resulting in the prominent display of betting services without considering the age, vulnerability, and other diversities of internet users.

    The Betting Control and Licensing Board is the regulatory agency responsible for overseeing the operations of all betting firms in Kenya.

    Siaya Senator Oburu Odinga while speaking on the death of General Francis Ogolla following chopper crash said the Luo community has in the past lost high-ranking leaders under unclear circumstances hence need to probe for the truth.

    “Even though it was an accident; in this region we’ve had many such accidents and we’ve also had assassinations of leaders from this region. So when such things happen we are a bit suspicious not because of anything, but we want to know the truth,” Oburu said.

    Oburu differed with Joel Omondi, the general’s son who had ruled out foul play in his father’s death, “I want to ask our Uncle, the General’s son, young man, don’t be impatient with us allow investigators to do their work! It’s not because of anything it is because once bitten twice shy. We asking for no stones to be left unturned and let us know the truth on who killed General Ogolla.” Oburu said.

    In his speech, Oburu who was representing the larger Oginga family, recalled the assassinations of prominent Luo leaders in the past including Tom Mboya, Robert Ouko among others.

    “I was part and parcel of the team that was investigating the death of Ouko. It was very sad because the regime at that time managed to convince the family to be very protective and not allow people to go into details. So young man allow investigators to do their work,” he added.

    Calls for investigation

    Azimio La Umoja leaders in attendance including Wiper leader Kalonzo Musyoka added their voice in calling for thorough investigations.

    “What Kenyans want is simply to make it public because they that will alley all these fears.The matter of General Ogolla goes beyond our sister Aileen and her beautiful kids. It is a national thing, for the truth must come out,” Kalonzo said.

    Narc Kenya Party leader Martha Karua also called for a probe, “When an accident occurs, it is a security issue. There are concerns which deserve answers. Since an inquiry has been formed, we look forward to speedy investigations into the death of General Francis Ogolla.” She said.

    Orengo speaks 

    “The first rule of investigations is you don’t rule out anything,” Siaya governor James Orengo said in calling for a comprehensive investigation into the helicopter crash that killed Gen Ogolla.

    “We have mourned many heroes in Nyanza. I plead with everybody to allow Kenyans to mourn their heroes the way they can. We want to be assured nothing will be left out in General Ogolla’s chopper crash investigations so the truth comes out.‬” Orengo said.

    He expressed alarm that an apparently mechanically unfit copper without backup allegedly was assigned to General Francis Ogolla who died when it crashed.

    He also asked why such a minor mission as school inspection was assigned to the Chief of Defence Forces in a bandit-prone area. The crash was on Thursday at 2.30pm.

    The chopper lost power shortly after taking off but the cause has not yet been established.

    Orengo on Saturday said as a leader from Ogolla’s home region, he will not shy away from demanding clarity on the circumstances surrounding Ogolla’s death. The chopper lost power and exploded in a fireball when it was taking off after the inspection.

    He asked why the Ministry of Education was not involved. The military as a rule does not inspect schools or commission them.

    One of the stories of Chief of Defence Forces (CDF) General Francis Ogolla that have refused to go away is that of Bomas.

    The events of the August 2022 general election at Bomas of Kenya in which late General featured prominently took centre stage during his funeral on Sunday.

    Speaking during the event, Defence Cabinet Secretary Aden Duale laid bare the matter as he sought to defend Ogolla while revealing a discussion he had with him a few months after the incident.

    Duale recounted a phone conversation in which Ogolla explained how it had continued to affect him mentally to the extent of losing weight.

    “He called me and the family can agree with me, we had a conducive discussion; that he had even lost weight, that this thing was disturbing him,” said Duale.

    In his speech, Duale said that past text messages were showing that General Ogolla was sent to Boma of Kenya by senior members of the National Security Council.

    “The General shared text messages with me from his superiors and members of the National Security Council at the time. He was given directions by a leader to go to Bomas. When he got there, the IEBC Chair kept them waiting for five hours after which he said results to be announced at 3 pm,’ Duale says.

    ‘When he asked what he was doing, he was told to stay with his colleagues. Before his appointment, we had a one-on-one discussion with him for hours at my home before he discussed with the president,”

    Following the alleged happenings, President William Ruto directed that members of NSC can never delegate the attendance or membership to their juniors, Duale says.

    Rwanda Considers Strict Laws On NGOs Spendings

    Rwanda has proposed a new draft law that is aimed at regulating non-governmental organizations (NGOs) in the country.

    The bill passed the crucial stage of first reading in parliament on Thursday.

    The draft law is already causing jitters among the opposition and civil societies who think it is aimed at stifling their operations.

    Details of the draft law

    The bill by the Minister in the Office of the President, Judith Uwizeye, has requested NGOs in Rwanda not to spend more than 20 per cent of their budget on operational costs.

    An operating cost is an expense from the daily operations, materials, and other necessary components an organisation uses regularly. Operating costs may include necessary expenses like rent, utilities, payroll, and supplies among others.

    Activists, however, argue that the drafters of the law may not fully understand how NGOs operate, as NGOs typically allocate their budgets based on the demands of their funders.

    The draft law states: “Organisation has an obligation not to exceed 20 per cent of its operating budget in activity programmes that are not in the interest of their beneficiaries.”

    The proposal also aims to avoid scams by some NGOs in the country according to drafters.

    One of the most common forms of NGO scams is misappropriation of funds.

    Fraudulent NGOs often collect donations under the guise of supporting a noble cause but misuse the funds for personal expenses.

    According to the draft law, non-governmental organisations have also been obliged to keep, for at least 10 years, the documents regarding the use of property in the country.

    Once the draft law is approved, the organisations’ action plans and financial reports will be approved by districts and line ministries.

    “An organisation has obligations to submit to the board its activity and financial report for the previous year and the plan of action for the coming year, approved where applicable by the district administration, the line ministry, or any other state organ having responsibilities related to the field of activity of the organisation, within the first three months of the following fiscal year,” reads part of the draft law.

    Germaine Mukabalisa, one of the Rwandan MPs said the new draft law should assure the country of eliminating NGO scammers.

    “We want to hear measures in the draft law against so-called charity organisations which pretend to give money and jobs to needy people but end up disappearing within a few days,” she said.

    On whether the the requirement for NGOs to submit plans and reports to line ministries and districts would eliminate their independence and make them like government organs.

    The minister responded that the obligation is aimed at ensuring NGOs implement their objectives and eliminate NGO scammers.

    “What NGOs are doing to benefit the welfare of people should not be done in disorder. That is why what they do must be in line with what we wish on our list as government, as districts. They must be regulated. That is why the NGOs must submit action plans and sources of finance, and reports which must be monitored and approved. This will help eliminate scammers with empty promises,” she explained.

    The draft law has put NGOs in categories that include NGOs aimed to benefit community development, general public interest, members’ interest based on their particularities, profession-based organisations, sports, games and sport-based entertainment organisations, umbrellas, and forum of umbrellas. Umbrella organisations carrying out related activities may form a forum of umbrella organisations.

    According to the draft law, national non-governmental organisations carrying out related activities may form an umbrella organisation. However, for an umbrella to be accepted, it must be composed of at least 10 organizations.

    Activists worries

    Joseph Ryarasa Nkurunziza, the head of Rwanda Civil Society Platform (RCSP), emphasised the significance of soliciting more inputs from non-state actors.

    “We read that districts and ministries have to approve NGOs’ action plans and budget they spent, to monitor if NGOs accomplished what they pledged. We look forward to hearing more explanation as the committee analyses the draft law to have a common understanding,” he said.

    He said that the budget spending criteria also need further civil society consultations.

    “Administration activities need a budget so that activities reach beneficiaries. Saying we must not exceed 20 per cent of the budget on administration activities might not be possible. For instance, research organisations and others need more than that,” he said.

    According to the law, an organisation intending to spend more than 20 per cent of its operating budget on activity programmes that are not in the interest of its beneficiaries must provide prior justification in writing to the board.

    LandNet Rwanda, a network of local Rwandan organisations and international NGOs which deals with land issues, also wrote to parliament on April 17, asking to reflect the views of NGOs.

    “We observe that there is no policy that guides this draft law which opens room for challenges during its implementation. We recommend putting on hold parliamentary discussions on this law so that relevant authorities develop the policy first,” reads part of the letter.

    The organisation also recommended the establishment of an NGO forum or council that brings together all NGOs registered in Rwanda.

    The bill received 45 votes in a parliament and will now go to a parliamentary committee for further scrutiny.

    President William Ruto reveals the events that led to the appointment of General Francis Ogolla as Chief of Defence Forces.

    When it came time for me to make a decision on the next CDF, it was not an easy decision as it should; it’s always a decision of many balances. All the recommendations I got on the next CDF, and all the advice I got did not include Ogolla’s name, unfortunately, but he was a military officer with a distinguished career.

    There was only one problem, the events of August 15, 2022, at the Bomas of Kenya and so I asked Ogolla for a meeting and had a one-on-one, man-to-man, come-to-Jesus meeting with him and when we concluded the meeting he said the following ‘Mr President I have no defence. I will not try to defend myself, it was wrong what happened and you have three choices, either send me to Court Martial, have me retire or forgive me.’

    I went home after that meeting and I reflected on what General Ogolla had told me and in that reflection, I thought of my own ICC conspiracy story and my own episode at the ICC in Hague where certain circumstances had conspired and I was there.

    Secondly, I also reflected on the brief I had been given when I came to office as President and I was told there are 4 sensitive positions, that of IG police, Interior, NIS and CDF.

    I had been told you have to be careful who you appoint to these offices because they mean a lot and are very sensitive.

    I had even been told that please don’t be shy to appoint members of your community, you will be safe. I had made a conscious deliberate decision that we were going to take a different trajectory as a country where merit, professionalism and competence must come before ethnicity and I made up my mind that General deserved to be the Chief of the Defence Forces of Kenya.

    Last month, Niger broke off a military agreement with the US that saw a US drone base set up in the north of the African country.

    Explaining their decision, Niger’s military authorities said that the agreement had been imposed on the country and was not in the interests of the people.

    Washington is set to pull out from Niger’sterritory more than 1,000 servicemen stationed at the major US drone base in the north of the country following Niamey’s breakdown of the military cooperation agreement with the US.

    The development came in the wake of Nigerien Prime Minister Ali Mahaman Lamine Zeine’s talks with Deputy Secretary of State Kurt Campbell in a meeting in Washington on Friday, AFP reported, citing unnamed US officials.

    The two parties have reportedly agreed upon an upcoming US delegation visit to Niamey to facilitate an organized withdrawal process.

    Earlier, Nigerien state media announced that the Pentagon officials would visit the West African country next week.
