    Robert Alai Sued Over Prime Runda Land Grab in Shocking U-turn

    Cancer Investments Ltd has taken Robert Alai to court, accusing him of forcefully and illegally taking over their land in Runda on March 31. The firm, through lawyer Harrison Kinyanjui, filed a petition at the Environment and Land Court, calling for Alai’s immediate removal from the property.

    According to court documents, individuals linked to Alai broke into the property using crude weapons, demolished a concrete pillar at the gate, and physically attacked the company’s director, Mukhtar Ahmed Parkar.

    Mr. Parkar told the court that his calls for police assistance went unanswered because Alai allegedly used his political connections to block any action.

    The judge, Mohamed Kullow, certified the case as urgent and ordered that Alai, the Attorney General, and the Officer Commanding Gigiri Police Station be served ahead of the hearing set for May 19.

    Cancer Investments insists that they legally bought the land from Trans National Bank in 1992 and have maintained all legal dues, including payments to Runda Water Ltd and power utility firms.

    The land was recently leased to a neighboring school, and preparations for renovations were underway when Alai’s team allegedly stormed in.

    The company says it has never entered any transaction with Alai regarding the property. Its original title remains intact and is currently still under a charge from a bank, a fact that the company plans to prove in court.

    Sakaja has navigated previous impeachment attempts by aligning with prominent figures such as former PM Raila Odinga, President William Ruto, and Prime Cabinet Secretary Musalia Mudavadi. However, some Nairobi County Assembly members are increasingly frustrated with the lack of quality services and stalled development projects.

    During a press conference, Deputy Minority Leader Waithera Chege and Kileleshwa’s Robert Alai accused Sakaja of incompetence. They highlighted issues like chaotic public transport, land grabbing by private developers, poor drainage, and inadequate garbage collection.

    “The city is in chaos. We have met with the governor multiple times, but nothing has changed,” Alai stated, underscoring the lack of progress on development projects, especially in healthcare.

    Details from Auditor-General’s Report

    According to the Auditor-General’s report from June 30, 2023, Nairobi County has stalled projects worth Sh1.36 billion. The report specifically mentions that many of these stalled projects are hospitals, revealing failures in critical healthcare infrastructure.

    One contractor received Sh869 million to build three health facilities, but none were completed. Inspections in late September showed the sites in poor condition. Despite this, the same contractor was awarded another project worth Sh344.1 million, which also stalled after Sh165 million was paid.

    Additionally, suppliers who provided services to the county have not been paid, raising concerns about revenue collection.

    Concerns Over Revenue Collection and Accountability

    MCAs expressed their frustrations about unclear revenue collection practices within the county government. “Revenue is collected at Riverside, but no one knows who is actually collecting it,” Alai said. They accused the governor of focusing on public relations and blocking oversight from the MCAs.

    Chege mentioned that county officials involved in transferring public land to private developers will be held accountable. She highlighted suspicious changes in contract agreements that potentially favor the developers over the county.

    Assembly Speaker Kennedy Ng’ondi rebutted claims that he blocks oversight efforts. He argued that the MCAs who complain lack an understanding of their roles.

    As frustration mounts, the ward representatives urge President Ruto and Raila Odinga to intervene and address the issues affecting Nairobi’s residents. Governor Sakaja did not respond to requests for comment.

    Kileleshwa MCA Robert Alai has resigned from all Nairobi County Assembly committees, accusing them of being used to “clean the obvious dirt” from the county executive rather than perform meaningful oversight.

    In a statement, Alai criticized Nairobi Speaker Ken Ng’ondi for allegedly defying court orders that nullified his removal from the Public Accounts Committee (PAC). He claimed his troubles began after raising concerns about graft during a Senate Public Accounts Committee session.

    “I have resigned from all the Nairobi City Assembly committees because they are being used to clean the obvious dirt from the county executive and not to conduct proper oversight. The Governor and Assembly leadership must change to serve the city residents or perish,” said Alai.

    Alai, a member of the Energy and ICT Committee as well as the Agriculture, Livestock and Fisheries Committee, vowed to return only if due court processes are followed.

    “When I asked tough questions in PAC, they removed me. When I questioned the ICT matters, the Majority Leader took over the committee’s work, illegally formed an ad hoc committee, and never released a report. Members are now questioning whether there was a compromise,” he explained.

    He also emphasized that the blatant disregard for the law undermines the assembly’s integrity and the trust placed in it by Nairobi citizens.

    In April, Alai and Ngei MCA Redson Otieno Onyango challenged Speaker Ng’ondi’s decision to reconstitute House committees in court, arguing that their ejection was unlawful and unconstitutional. The two claimed their removal was a ploy by political adversaries to settle personal differences.

    Gachagua urged Nairobi Governor Johnson Sakaja to meet with the traders before proceeding with the eviction. He reminded Sakaja that the Kenya Kwanza administration had promised during the 2022 elections not to displace these traders.

    Alai responded to Gachagua’s remarks on X (formerly Twitter) on September 12, 2024. He called on Gachagua to stop interfering in the governance of Nairobi County.

    He noted that while Gachagua often refers to himself as a “villager,” Nairobi is not a village but the largest city in East and Central Africa.

    Alai emphasized that Nairobi must modernize to meet global standards. He stated, “Nairobi is East and Central Africa’s largest city. It must evolve, not just to survive but to meet global standards of modernity and dignity.”

    Alai Calls for Non-Interference in Nairobi’s Development

    Alai stressed that Nairobi’s leadership should be allowed to drive the city’s modernization efforts without interference. According to him, external involvement weakens the city’s governance structure and hampers its growth.

    Instead of focusing on preserving poverty and disorder for political gain, Alai called for the development of a prosperous and forward-looking urban center.

    He added that the Deputy President’s role should focus on fostering national unity, not undermining Nairobi’s leadership.

    Ongoing Tensions Between Gachagua and Sakaja

    The feud between Gachagua and Sakaja has been ongoing since the start of the Kenya Kwanza administration.

    Reports suggest that Gachagua prefers a governor from his Kikuyu tribe to lead Nairobi. However, Sakaja has garnered support from the top leadership of the ODM Party and Nairobi County ODM MCAs to protect himself from political interference.

    Sakaja’s Response to Gachagua

    Governor Johnson Sakaja also responded to Deputy President Gachagua’s comments about the Wakulima Market evictions. Sakaja criticized Gachagua for addressing the issue publicly rather than handling it privately.

    “My elder brother H.E. Rigathi Gachagua, you have my number,” Sakaja said, expressing his frustration with the public nature of the remarks.

    Gachagua had earlier urged Sakaja to have a meeting with the traders before evicting them. He reminded Sakaja of the 2022 promise they made together to the traders, assuring them that their livelihoods would not be disrupted.

    Gachagua further cautioned that breaking this promise would damage their trust. “Please, consider having a meeting with the market’s leadership to agree on any changes without harming their livelihoods,” Gachagua added.

    Wakulima Market Eviction Notice and Protests

    On September 10, 2024, Wakulima Market traders received an eviction notice from Nairobi County, ordering them to relocate to the newly constructed Kangundo Road market.

    The county administration explained that the relocation aims to reduce congestion in Nairobi’s central business district, improve traffic flow, and ease pedestrian movement.

    Following the notice, traders staged protests on September 12, 2024. The new market offers more space and better parking facilities, according to the county’s statement.

    Cooperatives PS Patrick Kiburi Fingered In Linturi’s Fake Fertilizer Bribery Scandal

    Patrick Kiburi Kilemi, the Principal Secretary, Ministry of Co-operatives and Micro, Small & Medium Enterprises (MSMEs), has been adversely mentioned in the alleged bribery scandal in parliament over the exoneration of Agriculture CS Mithika Linturi in the fake fertilizer saga.

    The National Assembly’s special committee committee probing Linturi’s impeachment has been accused of being compromised and taking bribes to clear the CS.

    Sources claim that each of the members were offered with up to Sh5 million for a favorable report.

    Its reported PS Kiburi who is a close confidant of CS  Linturi, allegedly played as the intermediary between the compromised MPs and the accused CS in negotiating for bribes.

    Kileleshwa MCA Robert Alai made the claim insisting, ‘PS Patrick Kiburi played like himself” loosely translated to mean he facilitated the transfer of cash to the MPs.

    Linturi survived impeachment after the 11-member committee determined that the grounds of the impeachment motion were not substantiated.

    Seven of the 11 MPs voted to save the CS.

    A call for Probe

    A section of lawmakers now want thorough investigations into claims that money changed hands with a view to exonerate Linturi from blame in the fake fertiliser scandal probe.

    In particular the MPs demanded that the Powers and Privileges Committee as well as other investigative agencies such as the Ethics and Anti-Corruption Commission (EACC) be seized of the matter as it had put Parliament to shame.

    The calls for the investigations  came on a day fresh details emerged over how a senior official working in parliament allegedly met Linturi on May 1 immediately after Wetangula had approved the impeachment motion, to deliberate on how to save him from ouster.

    Sources privy to the intrigues, revealed that the said official assured the CS that resources would be mobilised to ensure that he is saved from ouster.

    It was understood that apart from the said meeting, a lot of other underhand dealings as well as meetings were held in high offices in government where it was agreed that Linturi should be saved as he was not to blame for the alleged scandal.

    After the committee presented its findings to the House on Monday, Rarieda Member of Parliament Otiende Amollo claimed to be aware of corruption among the members.

    “I have spoken to some of the members of the select committee and a disclosure has been made to me that questions and allegations of impropriety and misconduct by some members of the committee,” he told Parliament.

    “It is necessary that such an issue is referred to the powers and privileges committee first because if there is any truth in it would result in the report being annulled. It would not be right to discuss that report.”

    Speaking separately, Nominated MP John Mbadi was categorical that EACC should be called in to investigate  the matter which has put parliament to shame. He said it is regrettable that Sh5 million was being mentioned as the buying price for members  to save Linturi.

    He said: “I think those are not issues that you can just wish away. In fact, the amount has been mentioned and there is consistency in the amount. This matter needs to be dealt with by the Powers and Privileges Committee and it may even go to the extent of asking EACC to investigate because it is very unfortunate and if it happened then the Members affected have a lot of explanations to do.”

    He added: “The day before yesterday (Monday), the figure of Sh5 million has been mentioned, on Monday the same amount was still being mentioned. To me that is a serious matter more so that this is an issue that is of serious interest to the country in terms of compromising the food security.”

    ‘I was offered the bribe’

    Busia Woman Rep Catherine Omayo who was part of the special committee has claimed that someone attempted to bribe her to vote in favor in the impeachment case against Linturi.

    In an interview with Citizen TV, Omayo stated that most of the committee members tasked with determining Linturi’s fate were approached with bribes to sway their decision in favor of the CS.

    “Someone came to me with Ksh.2 million, and another came saying the money had increased to Ksh.3 million because the report against Linturi was hot. At some point these people asked me to state what I wanted to favour the CS,” Omanyo said.

    “The other person asked me to say what I wanted at that time so that we go where the person is or he will come here.”

    She revealed that the committee members were given bribes, but some declined to be compromised.

    The committee held twelve sittings to investigate the proposed dismissal of the Agriculture and Livestock Development CS.

    According to Naomi Waqo the chairperson of the committee, four members dissented and made it publicly known to the committee.

    However, seven out of the 11 committee members investigating the fake fertilizer scam voted to save Linturi.

    While presenting the report, Naomi Waqo informed the House that the Committee found that allegations against the Cabinet Secretary were unsubstantiated.

    This meant that there will be no further proceedings on the matter.

    The Motion for the proposed removal of the CS was moved by Bumula MP Jack Wamboka, on the grounds of alleged gross misconduct.

    Also cited was the gross violation of the Constitution and reasons to believe the CS committed a crime under national law.

    In response to the outcome of the impeachment, Wamboka accused MPs of betraying Kenyans by letting Linturi off the hook over the fake fertilizer scandal.

    “The unanimous decision of 149 members representing over 30M Kenyans cannot be overturned by the influenced 7 members of the select committee. Their decision is a betrayal in the city to the hardworking Kenyans in our villages,” he said.

    Despite the setback dealt by the select committee’s decision, Wamboka has stated that he will not tire until justice is served to Kenyan farmers and Linturi is dismissed.

    “We will not relent in pursuit of this fake fertilizer scandal that has rendered farmers hopeless and endangered the country’s food security,” Wamboka said.

    “There is no doubt that all evidence and witnesses proved beyond reasonable doubt that Linturi as the head of the docket was liable for the mess, scam and failures.”

    Minority Leader Opiyo Wandayi described the committee’s decision as a case of the House’s ruling being overturned by a group of seven people.

    “There is a higher moral responsibility on the cabinet secretary and the appointing authority, following the overwhelming 149-against-36 vote in this House last Thursday. This matter should not even have gone to the select committee stage,” said Wandayi.

    He urged Parliament to refuse to recognize Linturi as the Minister for Agriculture until President Ruto yields and dismisses the CS.

Alai who was reacting to the impeachment threats initiated by the senator on governor Susan Kihika, claimed that Tabitha is oblivious of what’s going on in the county as she’s allegedly drowned in the bottle.

    “The problem with Tabitha Karanja is that she spends more time drinking alcohol than even trying to understand what’s happening in Nakuru County.” He said.

    In a retaliation, Anerlisa Muigai issued a stern warning to Robert Alai while responding to his remarks about her mother.

    The Keroche heiress warned the Kileleshwa MCA to stop telling lies about her mother.

    “ROBERT and I repeat ROBERT!!!!! STOP TELLING LIES ABOUT MY MUM,” Anerlisa Muigai wrote.

    The move by the Keroche Breweries boss has attracted harsh criticism even from members of her own political party, UDA. Former nominated senator Millicent Omanga Is one of those who’ve reacted to the impeachment threats calling it political witch-hunt and a shame to womanhood.

    “Sen Tabitha’s call for the impeachment of governor Kihika is unfortunate and smacks of hypocrisy. It can’t be gainsaid that the people of Nakuru are in need of services. Gov should be supported to deliver on her mandate without unnecessary diversions and political witch-hunt. For God’s sake, women should stop being their own enemies!”

    At the center of the row is the Nakuru Senator calling on Members of Nakuru County Assembly to initiate an impeachment motion against Governor Susan Kihika for allegedly violating the Constitution.

    Citing the events at the War Memorial Hospital, where county enforcement officers raided the facility, and chased away doctors, nurses and staff, Karanja challenged the MCAs to take up their oversight role and initiate the removal of the governor from office.

    She said the raid at the hospital and the cruel treatment of patients was ground to impeach the governor.

    The calls for impeachment came just hours after a patient who was admitted to the hospital’s High Dependence Unit (HDU) died a day after the forceful takeover.

    Ms Karanja insisted that she was doing her oversight duty and the hospital saga had eroded investors’ confidence.

    She announced that she has no interest in the governors position and was keen to do her over sight role safeguard the rights of voters.

    “We are calling on the EACC, DCI and the relevant government agencies to investigate how public funds are being used as we fear there is massive embezzlement,” she said.

    The senator claimed that since the governor took office, she has been undermining other elected leaders and calling them names.

    Kileleshwa MCA Robert Alai has exposed a plan to grab a piece of public land to Kileleshwa Mosque. Alai has alleged that the embattled former National Lands Commission commissioner Mr Wilson Kiruinge Gachanja is behind the scheme to grab the land tittle number L/R209/9770 located in Makueni Road.

    “Wilson Gachanja with the help of corrupt government officials are determined to grab this public land and sell it to the Kileleshwa Mosque.” Said the MCA.

    According to a letter from Gachanja’s lawyer, Bitumen Standard write to Nairobi County government requesting for clearance of the property occupied by traders.

    According to Alai, the land in question (209/9770) was of surrender to Nairobi City County just as all the 209 blocks were.

    “There is no way it changed to corrupt former Lands Commissioner Gachanja, unless only through corruption, who is now planning to sell it to Kileleshwa Mosque.” He claimed.

    “Gachanja wanted Ksh 200 million and Mosque offered him Ksh 50 million. Now they have agreed on Ksh 170 million through this law-firm (Wambugu & Muriuki Advocates).” He claimed further.

    In June 2022, the Ethics and Anti-Corruption Commission (EACC) arrested Mr Gachanja and two others for aiding the illegal acquisition of public land by private developers in Kwale.

    Those who were arrested together with Mr Gachanja are a former senior lands officers in charge of the former Coast Province and former physical planner in the Ministry of Lands Mr Jabu Salim Mohamed.

    EACC said that the public land in question is a public access road Kwale Diani/Beach Block/1072 valued at Sh30 million.

    The embattled former lands boss recently had one of his properties in Kilimani, Nairobi auctioned.
