    Kakamega: Bereaved Family Hit With Sh1.5M Bill For Damages After Echesa-Barasa Chaos

    The family of a retired Mumias chief, Augustino Odongo, whose burial in Matungu constituency was disrupted last Saturday by chaos allegedly sponsored by politicians, is now staring at a Sh1.8 million bill slapped on them for damage caused.

    Shan Events, the company that had been engaged to organise the event now wants the family to compensate it for the equipment and other items damaged during the chaos.

    The company says the family, as the host was responsible for providing a secure environment conducive to their service provision and thus is responsible for the losses incurred.

    Safety measures

    “As you are aware, chaos erupted during the event, leading to the loss and damage of equipment that was vital to our service delivery. The losses incurred have been assessed, and the total value of the damaged and lost equipment stands at Ksh.1.8 million,” a letter by the Shan Events Operations Manager Abraham Odhiambo Otieno to the family reads in part.

    The firm pointed out that failure to ensure adequate safety measures resulted in the losses, therefore demanding compensation in the sum of Sh1,561,850. The demand gives a fourteen-day timeline, from the date of the notice.

    Others damaged property that the firm wants compensated are 161 broken plastic chairs valued at Sh136,850, 20 VIP Red Banquet Chairs worth Sh160,000 and one VIP wooden chair, which costs Sh40,000.

    The late Odongo’s family spokesman Patrick Lutta said they still don’t know where they would get the money to compensate Shan Events.

    “We have found ourselves in a very unfortunate situation where we are being asked to pay for things damaged by goons brought in by some politicians. As a family, we don’t know where we are going to get the money,” Lutta said.

    Meanwhile, Kakamega Governor Fernandes Barasa and Matungu MP Peter Oscar Nabulindo are yet to honour police summons to record statements over the chaos, which broke out last Saturday.

    The two had not reported to the DCI Western regional headquarters in Kakamega town by yesterday afternoon.

    The Western Regional Police Commander Kiprono Lang’at had directed the duo alongside a former Cabinet Secretary Rashid Echesa to appear before the DCI headquarters to shed light on the fracas.

    Several police officers and over 100 mourners were injured during the funeral when supporters of the trio clashed.

    Echesa presented himself to the police for grilling on Wednesday and distanced himself from the chaos.

    “I am a law-abiding citizen and I have no interest in Matungu because I hail from Mumias West Constituency. I had gone to attend the funeral due to my closeness to the deceased and his family,” the former Sports CS said, adding that he was equally surprised when a section of the mourners started heckling and booing before fighting broke out.

    “I did not incite anyone to cause the chaos and even personally intervened to calm the situation,” he added.

    Embarrassment

    In the letter signed by Patrick Lutta, Evans Odongo, Shadrack Odongo and Chrisanthus Odongo, the late chief’s family had termed the fracas as an embarrassment to the Bashitsetse clan of the Wanga sub-tribe.

    “The conduct witnessed on that day, attributed to individuals associated with you, was not only a gross disrespect to our family and the Wanga community at large, and particularly to the Abashitsetse clan (to which you both belong) but also a violation of the solemnity of a funeral ceremony,” they added.

    They said the goons had strategically been positioned at the funeral with the sole intention of heckling selected individuals including Governor Barasa.

    The family appeared to exonerate the county chief from blame and addressed the letter to Nabulindo and Echesa while reminding them of refund of their contributions of money and a bull towards the funeral.

    But Lang’at insisted yesterday that they still needed to question Barasa and Nabulindo over the melee.

    Witchcraft: Things Start Working Against Governor Barasa In Alleged Extortion

    Kakamega governor Fernandes Barasa could’ve walked himself into bigger problems while thinking he was untangling himself from the witchcraft claims that has muddied his image. In what has since morphed into a blackmail and extortion scandal as claimed by the governor leading to the arrest of former sports CS Rashid Echesa, tougher questions have since arose over the magnitude of sins Barasa had indulged in to warrant a huge amount he claimed that he was extorted and above all where he could’ve gotten all the cash he claims.

    Echesa was arrested on Thursday and held at Muthaiga Police Station for police custody for alleged extortion extortion targeting Kakamega Governor Fernandes Barasa, cybercrime bullying, and stage-managing an abduction.

    Echesa was on Saturday, March 30, admitted to a Karen Hospital following a deterioration in his health.

    According to his lawyers Danstan Omari and Cliff Ombeta, Echesa had undergone surgery at the same hospital a week before his arrest and was due for a review on the day he was arrested.

    However, the police refused his request for a review and detained him, leading to complications with his wound.

    “Echesa told the police that he was supposed to come back for the review, but the police refused and locked him in. As a result, the wound has become septic,” Omari explained.

    It took the intervention of seniors in the government to allow for his release to the hospital.

    Big Questions

    In a situation of the hunter being the hunted, lawyer Cliff Ombeta is now questioning the authenticity of Barasa’s claims that he was extorted Sh240 million.

    Ombeta questions the depth of dirty affair the governor had indulged in warrant such an amount of money, “what had Barasa done that was so crucial, so bad, so negative that he had to get Sh240M to coverup? What was he hiding?” Mr Ombeta posed while speaking to the media.

    He goes further to poke holes into the claim saying it’s unrealistic that the governor was extorted the quoted amount and on giving it the benefit of doubt, questions the source of the money.

    “Sh240 million is 240 bundles of Sh1 million each, how do you carry that, does it have a paper trail, where did you get it from, can you be able to prove it? If you can’t then you have no case,” Ombeta added.

    The lawyer went ahead and said Kakamega residents should go back for by-elections since their governor used black magic to win.

    “Question where this Sh240M came from, find out your state of development, are you developing or this money is missing?” Ombeta posed hinting at the possibilities of the money quoted being part of public funds.

    According to the legal team, the police still have nothing solid, “up to now they still have nothing.” Ombeta said.

    Adding his voice, UDA Secretary General Cleophas Malala told the police to cast their net wide enough to bring to book everyone to book, “I call upon the Police, especially the DCI, to ensure all those involved in the matter, including Kakamega County Governor – Hon. Fernandez Baraza records statements to ensure both parties get justice that they deserve.” He said.

    They now want Barasa to come forward and record a statement with the police as the complainant as his statement will be crucial in building the defense and will also give answers to the bigger questions like the source of money he allegedly paid the extortionists.

    Echesa was picked up from his house in Nairobi on Thursday and locked up in cells at Muthaiga over the saga.

    Officials said he will take plea on Tuesday April 2.

    There were efforts being made to release him on cash bail.

    His lawyer Danstan Omari said his client had been detained over claims extortion and stage managed abduction.

    He was picked from the cells and taken to Directorate of Criminal Investigations, Kiambu Road for grilling as Omari followed him there.

    Police said he has been evading their dragnet in efforts to grill him for possible prosecution.

    This came a week after a man police said was Echesa’s handler was Wednesday March 20 charged in a Kibera Court for extorting over Sh240 million from Barasa.

    William Simiyu Matere alias Elijah appeared before Kibera Senior Principal Magistrate Ann Mwangi where he was charged with two counts of demanding property with menace and conspiracy to commit a felony.

    According to the prosecution, it is alleged that on diverse dates between December, 2023 and 18th day of March, 2024 at unknown place within the Republic of Kenya, jointly with others not before court, with menaces demanded a total sum of Sh240 million from Fernandez Odinga Barasa.

    The other count states that on the same date he jointly with others not before court conspired together to commit a felony namely demanding property with menaces and extorted from Barasa over Sh240 million.

    He denied the charges and was freed on a bond of Sh2 million with a surety of the same amount.

    The prosecution intends to call four witnesses.

    The matter was mentioned on March 27 for pre trial but did not proceed.

    The drama broke with videos emerging online showing Echesa in handcuffs and in a thicket with ropes around his hands and legs.

    Barasa say this was all stage managed.

    New video

    A new undated video that has been posted by Kakamega Senator Boni Khalwale further complicates the case and implicates the governor as it clearly shows his face questioning Echesa who’s handcuffed and bundled in the back of a car at unknown location.

    Initially, the version of this video posted didn’t clearly show the rest to reveal the governor’s face and only reported widely as someone who resembled him, however, this long version shows his face going to further implicate him.

    Former Sports Cabinet Secretary Rashid Echesa has been arrested in an investigation into claims of an extortion racket targeting Kakamega Governor Fernandez Barasa.

    Echesa has been locked up at the Muthaiga police station after being picked up from his house on Thursday afternoon and is set to be charged on Tuesday.

    According to his lawyer Danstan Omari, Echesa was being detained over claims of extortion and stage managed abduction.

    “We have been allowed to see him. We understand they are investigating claims of extortion and abduction which we don’t know more about,” he said.

    Echesa was on Thursday at about 4 pm picked from the cells and taken to Directorate of Criminal Investigations, Kiambu Road for grilling as Omari followed him there.

    President William Ruto appointed former Echesa to be the Chairperson of the Kenya Water Towers Agency Board.

    According to a gazette notice dated May 19, 2023, Echesa will serve for a period of three (3) years, with effect from the 19th May 2023.

    Echesa was appointed as Cabinet Minister in retired President Uhuru Kenyatta’s second term as Head of State until March 1, 2019, when he was fired in a Cabinet reshuffle.

    His removal as Cabinet Secretary came under a wave of corruption allegations that had dogged the Sports docket.

    Magistrate Who Controversially Freed Echesa Of Firearms Fraud Put Under Probe

    Tye magistrate who released disgraced former CS Rashid Echesa well past working hours has been suspended amid claims that a bribe may have been paid through the former Echesa’s wife.

    The magistrate is reported to have taken the action late at night. The judicial officer was suspended for conducting night trials without permission.

    The Magistrate delivered the ruling on a Friday at 7.30 pm past operating hours. Courts operate between 9 am and 5 pm from Monday to Friday.

    Earlier this month, Senior Principal Magistrate Kenneth Cheruiyot had set free Echesa in the Sh39 billion fake arms scandal.

    While setting him free Senior Principal Magistrate Kenneth Cheruiyot acquitted him on grounds that the DPP did not avail key witnesses in the matter who included the two foreigners that were allegedly duped.

    Cheruyoit ruled that there was no evidence to put the accused on their defense.

    The two foreigners in the case were complainants in the case were Kozlowski Stanley Bruno, the CEO of US based ECO Advanced Technologies firm and Egyptian Mamdough Mostafa Lofty who claimed that Echesa and his co accused wanted to dupe them in the fake arms scandal.

    However, the court put businessman Chrispin Odipo on his defense in one of the counts of being in possession of instruments to commit forgery.

    Echesa and the three other accused persons were acquitted of fraud, forgery and impersonation charges.

    Echesa was charged with Conspiracy to commit a felony, Obtaining money by face pretences, making a false document and personation.

    The Prosecution had called a total of 18 witness in the case including defence PS Ibrahim Mohamed.

    Others who testified the case were three Major officers from Kenya defence forces, a pilot, several officers from DCI and employee from the office of the Deputy President.

    Most of the witnesses testified in camera due to the nature of the information regarding the department of defense that was confidential.

    This is not the first controversial ruling the judge has given on the case, last year, the DPP was aggrieved by the decision of Senior Principal Magistrate Kenneth Cheruiyot on June 4 directing police to release two firearms and a Range Rover to Echesa.

    Underaged Girls Busted At Echesa’s Sex Den In Ruaka

    Police raided an apartment in Ruaka on Tuesday busting underage girls brothel in a 3 bedroom house by the proprietors. The brothel is linked to ousted CS, Rashid Echesa.

    Police said among the teenagers rescued was a student who had disappeared from a secondary school two months ago.

    According to police investigations, a Form Two student at a school in Kiambu, was recruited to the trade by a friend who lured her with the promise of making money. The girl escaped from school last month and was led to the apartment where she was promised Sh10,000 every day.

    Police says she was taken to the apartment in Ruaka where she was greeted to prostitution with Sh5,000 and Sh10,000 a day for her services.

    The girl told the cops that her contract was revised and she was to receive 25 per cent of the payment while 75 per cent be pocketed by the operators.

    According to the girl, she would entertain close to 10 men a day. At times she visited the homes of her clients for a night of pleasure filled with lots of food and alcoholic drinks of their choice.

    The Police has been investigating the disappearance of children from secondary schools in Kiambu, this bust comes as a win for the State. In the raid, the cops recovered sex toys imported illegally into the country and for use in the sex parties by minors.

    Karuri DCI officers found 10 girls locked in the house with some in bed with clients. The investigators, who posed as clients, were informed that another group of 20 girls had been relocated from the house to a brothel in Mombasa.

    The apartment goes for 60K per month and amongst other things confiscated by Police were unused condoms and sex toys.

    Police rescued the girls and arrested three suspects including a 44-year-old man believed to be the brothel manager. Patrons who were found at the brothel were also arrested but later released on a Sh 1 Million cash bail.

    The investigations into the child prostitution in the crib allegedly owned by the fired former CS Rashid Echesa—who has also been linked to Mumia 42 brothers killing— are ongoing. Those arrests face a huge jail term from the 10 sexual offences before them.
