    Raila: Military Officers Currently Under Training To Be Used In August Election Rigging

    NASA presidential candidate Raila Odinga has dropped a bombshell in what is shocking yet not really unexpected making allegations that the military has been entangled into the land’s politics by being trained in the barracks as rigging agents in the coming election.

    Raila attributed the rigging dating back to since ehen the High Court ruled in April that presidential election results declared at the constituency are final, “the jubilee leadership has been involved in a series of activities that we find to be extremely disturbing with regard to the upcoming elections. ” Said Raila.

    The NASA leader challengedthe jubilee leadership to come clean on these matters.

    First, a series of meetings of officers from the National Intelligence Service have taken place with the sole purpose of coming up with a plan to help Jubilee retain power at all costs, particularly in the event that the courts maintains that results declared at the constituency level are final.

    “Jubilee appears to be putting all its hopes on the old centralised tallying at the Bomas of Kenya that enabled them to doctor and change results. It is now turning to using Intelligence and security officers to influence the august elections.” Odinga said

    The first meeting of the NIS and other groups from the national security sector took place at Lake Naivasha Lodge and the Great Rift Valley Lodge soon after the High Court ruling. Subsequent to that meeting, top officers of the various security formations in have held frequent consultations under the chairmanship of former Chief of General Staff Julius Waweru Karangi to actualise the plan developed by the NIS.

    Those who have attended these meetings include the Commander of the Army, Commander of the Kenya Air Force, the Commandant of the National Defence College, the Director General NIS, and the director of CID.

    Out of these meetings the following developments have followed:

    A training of members of the Kenya Defence Force on crowd control currently going on at in Embakasi military barracks.

    Training by the military for Administration Police officers, County Commanders and Regional Co-ordinators for unspecified roles.
    Recruitment of 120 military officers from each barrack and unit for unspecified special operations.

    These trainings are all currently underway at Embakasi barracks. They have every semblance with what was done at the same venue in the lead up to the 2007 general elections in which APs were later dispersed as election officials and poll agents for the Party of National Unity.

    Raila said they’re in possession of information that further to the above activities, several military officers are currently being hosted in Kakamega at the former provincial premises. We have information that these military officers are being prepared so as to be recruited by the IEBC as polling officials in the on-going recruitment process.

    NASA is inclined to believe that the above activities are meant to subvert the will of the people in the upcoming elections. We are challenging the national government and the leadership of the security organs in the country to explain to Kenyans why a select group of military officers would be involved in training civilians like county commanders and regional coordinators.

    Raila made an appeal to the military to remain faithful to the traditions of this country and their call of duty and refuse to be dragged into politics and instead focus on keeping our country safe. That has been our proud tradition as a country.

    Walter Menya was having a regular medical checkup at Metropolitan Hospital, BuruBuru when a man identified to him as Korros posing as a source of a juicy story called him for a meeting to pass over details of his dossier. It is inhuman that the journalists had to go without his routine medication since he was denied citing orders from above.

    Rather than attempting to kill a man’s credibility that he has built for ages, the unspoken reality is someone sending a warning to journalists against writing contrary to government’s hymns. Jubilee has had zero regards to press freedom, and this is yet again another hammer to the same. The script continues to unfold with laughable loopholes and factors arising but journalists and Kenyans must look beyond Menya, he’s being sacrificed to pass a message. Media is a crucial tool in a democracy, and infringing press rights amounts to undermining democracy and also interfering with the electoral process of public enlightenment. Civil servants must not engage in partisan politics as they’ve been, it is unconstitutional.

    The President will today launch one of the biggest if not the biggest infrastructural project completed under jubilee, the completion of the first phase of SGR that is Mombasa- Kisumu that was built at a cost of 400B. The project has been marred by controversy from inception with procurement scandals, project overquoting amongst the many of issues raised. This is that project that has turned many into billionaires overnight.

    What was promised

    Anyway, as it has been, integrity questions are always shutdown with blind patriotism and you risk being labeled a nuisance, enemy of progress when you just complain even at the moments where you need to shut up and eat what you’re served. It is considered unpatriotic to raise your voice in negatively on SGR right now even though you’ll be paying back the loan. As a law abiding citizen, I’ll forget about everything and simply enjoy the Chinese themed launch of our SGR by the President.

    What has been delivered

    I decided to forget that the Sh400B worth compared to refurbishing the current meter gauge railway that would have cost Sh20 billion, that an upgraded meter gauge line would have given a similar performance as the SGR. I will forget about how we were promised bullet design electric trains only to be served with colonial era diesel locomotives that will be going at 80KM/hr to replace current cargo trains going at 60km/hr because that’s such a huge milestone.

    I choose to forget the fact that to access the SGR I’ll have to take a Taxi or a matatu to Syokimau where the Nairobi terminus is, it would cost me an average of 1500 for taxi to Syokimau and 900 for an economy ticket to Mombasa where I’ll have to take again another taxi from Mariakani where the Mombasa terminus is to the CBD which is another 1000. A sum up of entire trip would come to Sh.3,400 on an economy class. For the same amount, I can afford one of the local flights to Mombasa and a VIP ticket on the luxurious busses to Mombasa. But forget you read this, just another of that pettiness.

    I’ll definitely forget that the returns of SGR to service the loans will take the time to materialize and that the burden is on the heavily burdened taxpayer to repay. With the first phase confirmed an entry of Sh400B to the debt bucket and 2 more phases (Nairobi- Natasha and Naivasha-Kisumu) putting it past 1Trillion mark, Kenya’s debt standing at Sh.4.5T an all times high and spending 50% of GDP paying loans off.

    The Nairobi-Mombasa line cost about US$5.6m/km, for example, whereas the international norm is about US$2m/km and Ethiopia’s cost is about US$4.8m/km. In addition, Ethiopia is laid a more expensive electrified, double-track line, whereas Kenya’s railway is single-track and rely on diesel locomotives. Moreover, the terrain in Ethiopia is more challenging, and Kenya is also paying far more than Ethiopia for a similar array of rolling stock. I have to forget all that and just enjoy the diesel locomotives, I’m patriotic.

    Integrity: 20 Powerful Politicians In NASA And Jubilee Blacklisted From August Elections

    With 8/8 fast approaching and politicians going on campaign overdrive, the civil society who gives the watchdog value for the community is not sleeping either. A campaign dubbed #RedCardKE is already creating enough havoc, this is a citizen’s driven 90-day campaign created to #RedCard all corrupt and unethical political aspirants, raise voter awareness and empower frontline institutions to hold the promise of Chapter 6 before all candidates.

    According to the campaign, 20 individuals both holding positions in NASA and jubilee have been marked as unfit for public office given integrity issues that they hold and asking the IEBC to bar them from participating in the August poll.

    Here’s the list and the set of accusations labeled against them by the accusing activists:

    1. Mwangi wa Iria – Governor Aspirant Muranga County

    Accused of purchase of 24 acres of land at Kshs. 340 million, a price that is way above the market value of the land.

    2. Kazungu Kambi – Governor Aspirant Kilifi County

    Accused of irregularly approving an exaggerated budget of Kshs. 5.05 billion for the construction of National Social Security Fund (NSSF) Tassia Phase 2 Project, a Kshs. 2 billion variations from the original Kshs. 3.3 billion; Kshs. 2 billion NSSF pensions fund.

    3. Oscar Sudi – MP Aspirant Kapseret Constituency

    The aspirant is accused of forgery of official documents and election into public office on account of falsified documents and intentionally providing false information.

    4. Moses Kuria – MP Aspirant Gatundu South Constituency

    He is subject to several counts of incitement to violence including against leaders, communities and journalists; disobedience of the law and hate speech.

    5. Mike Sonko – Governor Aspirant Nairobi County
    He’s accused of indecent conduct in public including alleged harassment of Mtwapa weighbridge government officers. Mike Sonko is also accused of involvement in a physical fight with Governor Kidero, disruption of proceedings of the Senate public accounts committee and is also subject to the allegation of influencing the award of a Kenya Pipeline Company for a Kshs. 1.35 billion kickback.

    6. Hassan Ali Joho – Governor Aspirant Mombasa County

    He is subject to questionable academic qualifications. Governor Hassan Ali Joho was also listed in United States (US) Embassy list of drug barons.

    7. Gladys Boss Shollei – Women Representative Aspirant Uasin Gishu County

    The aspirant is accused of procurement irregularities including the purchase of the official residence of the Chief Justice at the cost of Kshs. 310 million and authorization of Kshs. 46.4 million to build pre-fabricated courts at Mavoko Law Courts.

    8. Ochilo Ayacko – Governor Aspirant Migori County

    Accused of instigating violence during party nominations in April 2017.

    9. Evans Odhiambo Kidero – Governor Aspirant Nairobi County

    Kidero is accused of procurement irregularities of up to Kshs. 4.6 billion in a plan to launch a metro transportation system. The aspirant is also subject to allegations of bribery and payment of Kshs. 200 million to Justice Tunoi. Governor Kidero is also accused of indecent conduct in public and physical violence against a fellow public official. An IPSOS public perception survey released on September

    10. Elizabeth Ongoro – MP Aspirant Ruaraka Constituency

    She’s accused of instigating violence during the Orange Democratic Movement (ODM) Party nominations which led to her being barred by ODM from contesting on the party ticket.

    11. Baba Yao Ferdinand Waititu – Governor Aspirant Kiambu County

    Waititu was already declared unfit to hold public office in 2015 (Benson Riitho Mureithi vs. JW. Wakhungu and 2 others (2014) eKLR); Confesses questionable academic qualifications; Allegations of hate speech and endangering of intercommunal harmony and cohesion.

    12. Alfred Mutua – Governor Aspirant Machakos County

    Procurement irregularities of 16 Subarus worth Kshs. 147.3 million, Ambulances worth Kshs. 145.3 million and in the construction of Kithimani-Makutano road worth Kshs. 568 million.

    13. Asman Kamama  – MP Aspirant Tiaty Constituency

    Involvement in the ongoing clashes and involvement in the assassination of opponents.

    14. Alfred  Keter – MP Aspirant Nandi Hills Constituency

    Allegations of breach of Chapter 6 and provisions of Leadership & Integrity Act; Abuse of office, obstruction, and harassment of legitimate authority at the Gilgil weighbridge on 21 January 2015.

    15. Cyprian Awiti – Governor Aspirant Homa Bay County

    The aspirant is subject to an ongoing investigation by the Ethics and Anti-Corruption Commission (EACC) into possible misappropriation of Kshs. 200 million meant for the Agro City project.

    16. Ken Lusaka – Governor Aspirant Bungoma County

    Under his leadership as the Governor of Bungoma County, his County Government purchased 10 ‘Special’ Wheelbarrows at the cost of Kshs. 1 million each. Beyond this, there is a case of conflict of interest as the candidate is accused of having links – through proxies – to M’Big Company that has won a bulk of Bungoma County contracts.

    17. Zacharia Okoth Obado – Governor Aspirant Migori County

    Embezzlement and loss of up to Kshs 600 million through procurement irregularities, violation of Section 11 of the Election Offences Act, 2016 including the use of and perpetration of violence during the ODM party nominations in April 2017 leading to destruction of property, loss of lives and intimidation of opponents by issuing threats.

    18. Anne Waiguru – Governor Aspirant Kirinyaga County

    Under investigations for the National Youth Service (NYS) theft in which Up to Kshs. 1.9 billion was lost in the NYS scandal under her watch as Cabinet Secretary (CS) for Devolution. Audit of NYS scandal is still incomplete. Abused, lost or unaccounted for budget includes funds meant for slum upgrading of 3.5 km road in Kibera slum which would have significantly improved physical accessibility and public health and sanitation in one of the biggest slum in Africa with approximately 250,000 dwellers.

    Waiguru gave directives that ensured procurement and payment were centralized at the NYS headquarters, hence overriding and undermining meaningful oversight by other State departments. An IPSOS public perception survey released on September 8th, 2015 ranked the candidate as third most corrupt leader. The candidate was declared unfit to hold public office by the Public Accounts Committee of Parliament in May 2017.

    “To honour my mum I got a bunch of celebrities from Kenya and South Africa to share messages of hope around breast cancer.”

    NAIROBI, October 17, 2016 – Top radio presenter and social activist Adelle Onyango has roped in celebrities from Kenya and South Africa for a social media campaign on breast cancer.

    Adelle says it took her a “little over a week. Just to reach out to different personalities and now the collection continues as we roll out the different messages,” adding, “I want survivors to know that we celebrate them, breast cancer patients and family members to know we recognize their battle and are with them in strength and prayer, and for men and women to know the importance of self breast exams and regular medical check ups!”

    Some of the celebrities who have lent their voices to the campaign include TV news anchor Janet Mbugua, rapper Shaq The Yungin, Israeli – Kenyan act Gilad, DJ Mikey, actress Brenda Wairimu, singer Angela Mwandanda, rap queen Femi One and South African star Nandi Tshabalala.

    Commenting about the messages sent out by the various celebrities, Adelle said the one that caught her off guard and made her emotionally was by Janet Mbugua.

    “Janet knew my late mum and when I played her audio she speaks about my mum, about how strong my mum was and it really just brought tears to my eyes. My mum passed way from breast cancer her anniversary of her death was on March 31,” the Kiss FM breakfast show host said. “We got listeners texting us about their loved ones battling breast cancer and how alone they’d felt until we spoke about it! Also to see male listeners find out for the first time that they too can get breast cancer. Knowledge is power!” To honour her mother’s experiences and life, Adelle and her sisters are very conscious about breast cancer. “Well for us, being that our risk is higher we are conscious about early detection all year long,” Adelle said, “When my mum was alive we would go for the breast cancer walks she would organize. It’s been hard for us to do that stuff without her around because it makes it more apparent that she’s not here. Personally I think this is the most vocal I’ve gotten since she passed away I hope that means I’m getting stronger!”

    So, is there enough been done for breast cancer? “More can be done. Cancer is such an expensive disease to treat! And without the treatment it just spreads. We need to subsidize these costs. And also in rural areas, arm people with knowledge. Many seek treatment when the cancer is on its late stages because they misdiagnosed the symptoms at the beginning and wasted time. Also as an individual what type of lifestyle are you living? Some risk factors are controllable, like healthier diets (less fats), not smoking, less drinking,more exercise!” Adelle said.

    The Ombudsman has written to the Cabinet Secretary, Ministry of Education Dr Fred Matiang’i on the above-captioned subject.

    In the letter, the Commission raises concerns over the directive by the Cabinet Secretary requiring the University of Nairobi Kenya Science Campus to vacate its premises on Ngong’ Road by 1st December 2016 to pave the way for the Kenya Technical Teachers College which has been instructed to relocate from its current location in Gigiri.

    The Commission has recommended that the process of initiating relocation of the two institutions be put on hold to first address concerns of stakeholders.

    The national carrier that has turned from a pride of Africa to being a shame continue to get hammered despite their PR exercise to sanitize the filthy profile. Genuine worries that Kenya Airways is at the brink of total collapse given massive losses they continue to make.

    An audit report conducted by Deloitte reveals from the ticketing, fuel and accounting to the baggage and cargo departments; the audit trail tells a story of plunder and theft. Most of the KQ ticket prices filed in its system were below the minimum seat cost as per its finance records. KQ issued more than 7 million seats between 2012 and last year at below price, resulting in a loss of $611.6M.

    The auditors in the report, accuse the KQ management of allowing its staff to void, refund and reissue tickets, causing a revenue loss of $12 million.

    With Kenya Airways in financial distress, it turned to Dubai Bank, at the time a crumbling financial institution that would later go under, for help. On August 18, 2014, the board approved Dubai Bank as one of the banks that KQ could obtain facilities from to a maximum of $5 million.

    The auditors also found two repatriation transactions (one for ZAR3 million and one for AED2 million) in respect of which no payment had been received from Dubai Bank into a KQ Central Bank account. The total value of these transactions was $700,000, with two employees in the finance department found culpable. A loss of $5.2 million was recorded by the airline from these dubious transactions with Dubai Bank.

    The scheme was so intricate that Baghel Deeraj of Dubai Bank operated a fake email address with Bank of Africa when he wasn’t a staff member of the West Africa-based lender.

    As KQ woes continue to pile, internally the workers are subjected to the hostile environment. According to documents in Kenya Insights hold, staff members are disgruntled. A good number have downed their tools leading to several flights being canceled.

    Workers are protesting in what they term as exploitation by Career Directions Limited (CDL), Insights Management, Strami and Trade Winds Aviation staff.

    KQ outsourced recruitment to CDL also made arrangements with the mentioned companies in what seems like a bid to continue exploiting the workers and milking the dying Kenya Airways. The outsourcing is proving injurious to the employees as terms of employment don’t meet with KQ’s.

    For the last five years, KQ has been procuring loading and grooming services from Trade Winds Aviation services at about Sh150,000 per individual employee per month, yet individual employees end up being paid mere Sh10K monthly. The rest, your case as good as mine, the outsourced companies apparently colluding with management to fleece the workers.

    Dadaab’s Broken Promise: New Report Criticizes Closure of World’s Largest Refugee Camp By Kenyan Government

    “The deadline to close the world’s largest refugee camp must be lifted,” said Jan Egeland, Secretary General of the Norwegian Refugee Council (NRC). A new report released today by NRC criticizes the returns process from Dadaab camp in Kenya to Somalia, as no longer being voluntary, safe or dignified.

    The report, titled Dadaab’s Broken Promise, says that the decision by the Government of Kenya in May to close the Dadaab refugee camps has led to a situation where the voluntary returns process does not meet international standards, and breaks the agreement that Somalis would be assisted to return home safely and voluntarily.

    “We are willing and able to enable voluntary return, but the pressure to push more than 280,000 registered refugees from Dadaab camp has led to chaotic and disorganized returns. From what we have seen on the ground, it is no longer voluntary, dignified nor safe,” said Jan Egeland.

    “Refugees in Dadaab need international protection. The Kenyan government and the UN refugee agency should reinstate the organized and voluntary process of return under the Tripartite Agreement. The unrealistic deadline must be removed before the situation further deteriorates,” Egeland continued.

    The Tripartite Agreement for the voluntary return of Somali refugees from Kenya was signed by the Kenyan and Somali governments and UNHCR in 2013. It was based on international law and created a framework in which returns were to be organized.

    “The initial returns programme under the 2013 Tripartite Agreement was largely a success, as it saw Somalis would be assisted to reach their return locations safely and with dignity. We should return to the terms of this agreement, rather than simply aiming to push back as many refugees as possible,” said Egeland.

    NRC’s new report highlights the major failures of the current returns process. In addition to failing to meet international standards for voluntary return, the report finds that refugees returning to Somalia are not sufficiently protected. It also reveals that the pressure to speed up the repatriation process threatens to create a revolving door scenario.

    “The number of vulnerable Somalis planned for return far outstrips the resources available to support them in Somalia,” warned Neil Turner, NRC’s Country Director in Kenya. “Sustainable return should form a key component of the returns programme. It must prevent families ending up in displacement camps in Somalia or returning as undocumented refugees to Kenya.”

    Over 80 per cent of the population in Somalia lives in poverty, and over one million people are internally displaced. Basic social services and infrastructure are mostly non-existent or at best limited. In addition, the security situation in many areas remains fluid. An overwhelming 74 per cent of Somali refugees in Dadaab said in August that they are not willing to return yet, largely fearing insecurity in Somalia.

    NAIROBI, September 10, 2016: Over the weekend, radio queen and social activist Adelle Onyango joined three other top female personalities in a mentorship event dubbed #NajijuaNajiamini held at Machakos Girls High School.

    Hosted under Champs Foundation, the campaign is a brainchild of radio presenter Mwende Macharia, who hopes to use the campaign to “create awareness among young people aged 15-24 years on self empowerment, self confidence and self appreciation”.
    For this edition Mwende invited Adelle together with radio presenter Mwalimu Rachel, gospel star Bahati and Liz Marami, the first female marine pilot.

    “It’s powerful when, we, ladies in the media get together to inspire and mentor our little sisters. The illusion of jealousy is just that, an illusion. What we are doing is bigger than us,” Adelle explained.
    Adelle gave a talk to the hall full of teenagers about the importance of being self aware.

    “I spoke about my journey, roughing it out even after losing my parents, especially my mum. I gave a speech about speaking your success into existence. Moulding your identity but leaving room for you to grow and unlearn things. I emphasized about the company you keep, basically, you are the average of the four people you hang out with,” Adelle said.

    After her talk, one of the student’s – Georgina – was overwhelmed with emotion and narrated how “she always listens to me since I joined Kiss FM. She even knew I joined in 2013!!!!! She always dreams about joining not any radio station but Kiss FM! So the emotions just rolled down her face,” an equally emotional Adelle said, “It was so humbling. And a reminder that, what I’m doing and my story, is influencing and inspiring so many people!”

    This is part of Adelle’s desire to create social change and empower the girl child; she is also the brand ambassador of Intel® She Will Connect.

    Recently, she joined over 150 women from Narok in a week long digital literacy programme that is aimed at giving women and girls the opportunity to acquire or improve their digital skills while expanding their understanding and use of technology.

    A unique platform was used to dispense the training – a custom built trailer with a 40ft container that has been redesigned to become a digital classroom equipped with PCs, internet connectivity, digital screens and trainers that can accommodate 30 women at a time for training.

    Tribunal Blocks Esther Passaris From Registering Her Harambee Democratic Party On Flimsy Grounds

    A tribunal chaired by Kyalo Mbobu and James Atema Paul Ngotho as members before the Kilimani court has dismissed Passaris’ plea to have the decision by Registrar of Political Parties blocking her from registering Harambee Democratic Party overturned.

    In a letter dated 10th June 2016, the registrar declined to register the name saying it name could not be reserved for use by a political party since the name “was not in compliance with the Political Parties Act, 2011 and the Constitution of Kenya, 2010 Article 91.” There was no explanation as to how or why the proposed name was not in compliance with the Political Parties Act and the Constitution. 2.

    A second letter was issued by the registrar of political parties on 24th August 2016 by which Passaris was informed that “Section 8(c) of the Act provides that the Registrar may refuse an application for the registration of a political party if the name or symbol that wishes to use the Act so nearly resembles the name or symbol or an abbreviation of the name of another political party registered under the Act or any other legal entity registered under any other written law. This is, therefore, to inform you that the name Harambee forms part of the National Coat of Arms of the Republic of Kenya recognized under Article 9c of the Constitution.”

    In appealing the decision, Passaris premised it on numerous grounds, key among them being that the rejection of the proposed name by the registrar was unlawful, unconstitutional and whimsical since the allegation that the name is not in compliance with the Political Parties Act 2011 and Article 91 of the Constitution is a clear misreading of these provisions of the law.

    In her defence, Passaris argue that whereas the word “HARAMBEE” is protected by law from use; it is so protected, but not when used in other words and for purposes that are not in conjunction with other words and objectives connected with the National Coat of Arms, and the proposed use of HARAMBEE DEMOCRATIC PARTY (HDP), is not an improper use of the said word, and is not prohibited under the provisions of Section 3 Cap.99 Laws of Kenya W . of the National Flag, Emblems and Names Act, while acknowledging such protection, her position is that such protection from use or abuse extends to the singular use of the each of the said names, and to avoid commercial exploitation and the creation of the notion of state patronage and approval in otherwise private undertakings, and to guard against the use of trademarks bearing such names; but when used in conjunction with other words, the same names are available and can lawfully be used for other purposes.

    Passaris argues further that, the said names have clear and distinct Kiswahili language meanings of their own, and cannot be said to exclusively belong to the State, and have therefore had widespread application and use in society when and where they do not violate any written law.

    One wonders why the case of Harambee Party is treated differently by the registrar in obvious bias steps alleged bias, for example, the fact that there is a party with the name Madaraka which, like Harambee, is a name protected under the National Flag, Emblem and Names Act.

    There have been entities registered using these protected names, such as HARAMBEE SACCO SOCIETY LIMITED, HARAMBEE STARS, HARAMBEE aircraft and marine vessels, HARAMBEE Foundation, a charitable educational organization, HARAMBEE SCHOOLS, ESTATE, HARAMBEE CONSTRUCTION LIMITED, JAMHURI HIGH SCH OOL, a leading secondary school in Nairobi, JAMHURI PARK, JAMHURI Savings Account by Co-Operative Bank of Kenya, JAMHURI ESTATE, in Nairobi, the NYAYO Motor Corporation, now renamed Numerical Machining Complex, and the NYAYO TEA ZONES DEVELOPMENT AUTHORITY Corporation. What therefore would stop the Harambee name from being registered.

    The tribunal findings surprisingly coincided with Passaris’ thinking on The reasons given by registrar for refusal include that the name Harambee has also been used by other entities registered under other laws. The examples provided by the registrar are Harambee Stars (the national soccer team) and Harambee SACCO Society Limited. However, this argument is self-defeating for if other government offices have registered entities with the name Harambee, why should the Registrar of Political Parties claim that the name can never be used since it forms part of the Coat of Arms and is protected under the National Flag, Emblem and Names Act?

    In a sharp, abrupt turn, the tribunal ruled that in their reading of the National Flag, Emblem and Names Act is that the word ‘Harambee’ (alongside the other protected words Nyayo, Madaraka, Jamhuri and the name of the President) cannot be used as the names of companies, firms or other bodies of persons, including political parties. Saying they’re well aware of the evidence which seems to show that the Registrar of Companies has allowed the name Harambee to be used by a company.

    The ruling has been criticized by the section of legal fraternity with one prominent judge heard saying the findings were idiotic and out of the constitution. It’s for example laughable thinking Kenya can’t differentiate between Jubilee party and Jubilee Insurance as one of the examples cited by the registrar. These things are as separate and can be told apart.

    It’s, therefore, unfair for the registrar to deny Passaris a chance to registrar her party early enough to give her time to popularize it countrywide and formally launch her gubernatorial bid. She has moved to the high court to appeal the decision with hopes she will be granted permission to have the name registered.

    A report commissioned by The US’ Department of Labor on Kenya has revealed some disturbing statistics, the annual Findings on the Worst Forms of Child Labor focuses on the efforts of certain U.S. trade beneficiary countries and territories to eliminate the worst forms of child labor through legislation, enforcement mechanisms, policies and social programs.

    The Report serves as a resource to foreign governments, NGOs, academics and policymakers working on labor and human rights issues.

    The report has established that Kenya has made a minimal advancement in efforts to eliminate the worst forms of child labor. The Government continues to expand social cash transfers to additional households as part of its National Safety Net Program for Results and implemented and participated in several programs to combat the worst forms of child labor. However, the report finds that children in Kenya are engaged in the worst forms of child labor, including in sand harvesting and commercial sexual exploitation.

    Kenya has yet to ratify the UN CRC Optional Protocol on the Sale of Children, Child Prostitution, and Child Pornography and its minimum age for work law and compulsory education age are not harmonized due to the lack of a particular compulsory education age. The Government has also not committed sufficient resources to enforcement efforts.

    The report notes the commercial sexual exploitation of children,sometimes as a result of internal human trafficking, which is apparently dine by relatives and friends.

    Sexual exploitation of children the report indicates is a major problem in Kenya, especially in Eldoret, Kisumu, Nairobi, Nyeri, and in coastal areas. The majority of children engaged in commercial sexual exploitation are girls, but boys are also involved.

    Coming at a time when paedophilia cases have been increasing with latest being one Alfayo who bragged on the internet for sleeping with a small girl amongst many other reported and unreported cases of sodomy and rape. Several interventions have been given in the report for the government in ensuring safety and protecting the children.

    Residents of Kisii are wreathing with fire following an incident on Thursday that left two women dead. According to reports gathered by Kenya Insights, the police attached to the DP’s quick response unit, engaged in a scuffle in Daraja Mbili market, Kisii County.

    In the evening, chaos had erupted after the entourage heading to Kisumu after the DP had left in his chopper, got inti a minor accident with the boda-bodas leading to a clashing argument. Within minutes and being a market day, a large crowd surrounded with fellow boda-boda riders staging a mild protest to save their colleagues who were at the moment being held and roughed by the officers.

    It is said the officers had aimed to shoot a rider before the two women who were going about their business selling fruits came to the officers pleading for them to forgive the driver. It was at this moment that the officers opened fire at them killing one woman on the spot and the other died while being rushed to the hospital.

    The incident caused a major protested that blocked Kisii-Kisumu highway. The residents condemned the DP and pulled down the Jubilee Party billboards that had been freshly erected. Residents vowed to paralyze Jubilee operations in the area should there be any. More protests are anticipated today in Kisii town as local leaders hinted.

    Public Accounts Committee has this morning questioned the unscrupulous businessman Ben Gethi Wangui over the missing NYS Shs.791 million.Mr. Wangui has been accused of stealing the said amount alongside Josephine Kabura and other six who have been charged with 15 counts of money laundering.

    The eight are accused of colluding with devolution ministry officials to wire the money from NYS coffers to purchase property through phony companies. Watching Mr. Wangui defend himself before PAC is a waste of time and public resources. The charlatan takes nothing seriously, asked to describe himself, the man who claims to come from Nyeri but was born in Garrisa cannot remember when he came to Nairobi when he cleared school and the names of his business partners.

    This is a rude chest thumping act because the transactions in question were a syndicate between him and the high and mighty government officials. He purports to have been the supplier with NYS for five years, way before the former CS Ann Waiguru was appointed to head the devolution docket. This is a cover-up aimed at protecting Waiguru who bowed to public pressure for her involvement in the infamous NYS scandal.

    The documents presented by Mr. Wangui to PAC indicate that he qualified for the tender to supply his over priced oil in the 2013/ 2014 financial year when Ann Waiguri was heading the docket. Anyone who watched the interrogation was able to notice the way he was dodging straightforward and direct questions that needed one-word answers. He could not tell the exact year he began supplying NYS with overpriced commodities.

    The con went further and presented a bank statement of one John Kago Ndung’u. When put to task to explain why he had submitted another man’s bank statement; he hesitated for a while and could not tell the relationship between him and John Kago when asked about it. He apparently kept evading the questions and gave answers that cannot convince even a mad man.

    Using ‘convenient amnesia’ to safeguard himself against hard-hitting questions, Mr. Wangui took advantage of some the of committee members’ abnormal leniency to give filtered information to sail through the probe. The likes of one Hon. Kareke Mbiuki, a panel member, at some point, sounded like he was Mr.Wangui’s advocate. He said hustlers could be forgiven for their ‘forgetfulness’ giving an unconvincing example of DP William Ruto who rose from selling hens to the position of deputy president.

    Consolidating his weak point that hustlers cannot document their transition from rags to riches, one need not be intelligent to notice that he was trying to take sides. Kenyans are tired of games, hundreds of millions were lost and youth dedicated projects stalled, watching Ben Gethi Wangui before PAC is a bitter pill to swallow and a further waste of taxpayers’ money. The man belongs in jail.

    Traditional narrative divides legal and political power in Government among the legislature, the executive, and the judiciary. The resulting question of who inspects the classical three arms of Government and their incidental institutions has necessitated the establishment of commissions whose main objective is to secure the observance by all state organs of democratic values and principles. With such a momentous task, commissions ought to operate beyond reproach in regard to observance of the said values and principles.

    The Ethnic and Diversity Audit of commissions was carried out in 2016 with the aim of finding out the ratio of the various ethnic groups who comprise the current staff of commissions, assessing the compliance of commissions with the National
    Cohesion and Integration Act, No. 12 of 2008 and identifying ethnic representation among Commissioners. Using the quantitative approach, the study employed the census methodology and collected data from all the 15 commissions in Kenya.

    With a total of 5,679 staff in all commissions, 93% comply with the NCI Act, 2008 as they have not employed more than 33.3% of their staff from one ethnic group.

    Only one of the 15 surveyed commissions flouted the Act. The Judicial Service Commission flouted section 7(2) of the NCI Act (2008) by employing 39% of its employees from one ethnic community, the Kikuyu.

    The study reveals that the most represented ethnic community in the employment of commissions is the Kikuyu which forms 22.2% of the employees. Other dominant groups include the Kalenjin (12.8%), Kamba (11.3%), Luhya (11.1%) and Luo (9.4%) communities. Notably, employment within the commissions has also included minority communities such as the Maasai, Njemps, Rendille, Orma and the Ogiek to mention but a few. Nevertheless, it was evident that only 19.6% of all commission positions are occupied by staff of such minority origin.

    The Kikuyu community dominates the employee composition of all commissions save for the Commission on Revenue Allocation (CRA) at 18% and the Commission on the Implementation of the Constitution (CIC) at 25% that are predominantly Luo.

    When the representation of ethnic groups in commissions is compared to that of the national population, the study noted both overrepresentation and underrepresentation of some ethnic communities. While the Kikuyu community accounts for 17.7% of the national population, it has a proportion of 22.2% in commission employment, a variance that would easily be used to bring in some of the underrepresented or “forgotten” ethnic groups. Groups such as the Kalenjin and Maasai are relatively proportional; while the Meru and Kuria are underrepresented. A notable concern is the non-representation of the Dasenach, Galla, Konso, Waat, Galjeel, Isaak, Leysan and Gosha ethnic groups, to which this research refers to as the “forgotten” ethnic groups.

    The study used the richness of the population of employees to establish its diversity. In that regard, the Parliamentary Service Commission has 29 ethnic communities in its staff, being the highest among all commissions. However, using the mean to establish diversity evenness, the Commission on Administrative Justice (CAJ) turned out to be the most diverse commission with a mean of 2.4, followed by the Judicial Service Commission at 2.9 and the National Cohesion and Integration Commission at 3.0.

    The study demonstrates that the workforce of commissions which have regional presence is more diverse. As such, commissions that have decentralized offices are likely to have more ethnic groups than those that have only one office in Nairobi.

    Some of these include the Teachers Service Commission (TSC), the Independent Electoral and Boundaries Commission (IEBC) and the Ethics and Anti-Corruption Commission (EACC). The composition of the members of the Board of commissions in Kenya includes 20 ethnic groups spanning from the majority Kikuyu, Luo and Luhya to the minority Turkana, Gabbra, Kuria and Njemps among others. Most of the Commissioners appointed belong to the Kikuyu community which forms 16.5% of the commissioners.

    Unlike Commissioners, the CEOs of commissions are drawn from a leaner scope of ethnic groups. The CEOs of the 15 commissions belong to eight ethnic groups. The majority of them are from the Luhya community with a proportion of 26.7%.

    However, worth noting is the gender representation among CEOs, which is in the spirit of the Constitution. Female CEOs are composed of 33% while 67% are male. The study recommends that the President and the parliament should include at least one person from the minority communities in each appointment to a commission. Further, there is need for parliament to review Article 250(4) of the Constitution – the law forming all commissions – to have appointments

    Further, the Joint Parliamentary Committee on National Cohesion and Equal Opportunities should support NCIC in the development of policies that will enhance the participation of ethnic minority and marginalized groups in the general labor market and specifically in public service employment.

    There is also need to make commissions grassroots oriented to improve service but majorly to strengthen diversity in employment. It would be an opportunity to strategically tap into areas where minority groups have a say, away from the competitive nature of national exposure. Furthermore, each Commission should endeavor to make the advertisements for job vacancies in a way that accommodates some of the rudimentary strategies applicable at the grassroots to add on to the two dailies approach.

    Moreover, it necessitates the National Cohesion and Integration Commission to form a deliberate and progressive formula to create a balance of the “seemingly minorities against the perceptive majority” through generating an Ethnic Quota Recruitment System or Strategy for all commissions. Finally, there is a need for NCIC to develop a draft of the Minimum Standards and Principles for Recruitment, as well as train staff of all commissions to ensure inclusiveness and diversity within such institutions.

On 27th September, the hugely built man pounced on the tiny girl in a horrible, painful rape ordeal that went for close to one hour in his home.

    Kenya Insights has gathered, the monster is not new to raping and previously, he raped and impregnated his sister in law, the matter unfortunately was solved within the family and he escaped justice. The raped lady just gave birth the other day.

    The neighbors told KI when we visited his home in Ruiru that the man is a notorious abuser who often beat his wife, a mother of three to pulp. The wife has been suffering silently and nursing injuries from consistent brutality from the beast of a husband but like the rest of many domestic violence cases , she has often opted to stick with the man who exhibits killer motives.

    A day to Ng’ang’a raping the minor maid, he had as usual beat his wife brutally injuring her and on this day, she fled away leaving him behind the kids and Alice. He came home ealier on the day that she was to rape the young lady.

    Alice told Kenya Insights that he came home unusually earlier perhaps maybe because the wife wasn’t around, unknown to her the reason for coming earlier were different.

    The kids were in the house under care of the maid. As Alice was making her way to the kitchen, he cornered and pounced on her in the corridors. Covered her mouth, held a knife to her face threatening to kill her should she shout, helpless and terrified, Ng’ang’a repeatedly raped the girl and as if that was not much evil, sodomized her. All these were happening with the kids in the house.

    After struggling with the shame of a man, Alice finaly managed to find a space and ran out to the neighbours who took her to the hospital and Muthuga Police Station to report the rape case. Ng’ang’a immediately went into hiding knowing what he has done.

    When we visited the police station, they said the matter was being investigated and he remains at large. But we’re unconvinced the police are doing enough to find his whereabouts and being a repeat offender, being out there walking free is a threat to lives of his potential victims.

    “He has destroyed my life completely, I was a virgin and preserved myself all through just for him to come around and ruin me completely. I only planned to start having sex once I’m married. I never knew things would end up horribly to me like this. I curse my life, my life is ruined. ” Teary Alice narrating her story to us. Honestly, it was a disturbing scenario and emotional listening to her narrate all this.

    Because of privacy issues, we can’t post her face and we’ve used a different name from the real to conceal her identity. Alice after finishing her fourth form in Meru, came to Nairobi to stay with her sister in April this year and found a job as a maid to the family of Ng’ang’a. She has worked for four months and during all this time, she tells us the man has never talked to her though he spends most of his time in the house. He’s always in bad moods.

    Alice fortunately is under full medical attention but the barbaric act still haunts her with sleepless nights. From health records, she’s had to be put on reconstructive surgery since beast raptured her rectum in the sodomy act. Ng’ang’a has more than a crime to answer, the wife and him must be held liable for employing a minor according to the law only persons over 18 years should be. The case of Alice is of many maids out there who are faced with such a like men. You can be sure of many cases of maids being raped that go unreported and many lives continue to destroyed we therefore as privileged medium, use the opportunity to highlight and expose the beasts in the society. Ng’ang’a has since abandoned his home in Ruiru, the wife is nowhere to be found either. He runs a logistic company Aeromarine.

    We also notified Healthcare Assistance Kenya (HAK) to offer the much needed psychosocial support and provide linkages to help and assist Alice access treatment and how to prevent infections such as HIV and other sexually transmitted diseases.
    HAK also called the Police Headquarters to report the matter and find out why Mugutha Police Station had not swiftly acted on the rape case reported.
    HAK is the first and the only organization in Kenya which runs a GBV Rapid Response Call Centre where women Kenyans can call 1195 Toll FREE to report Gender Based Violence , Rape.

    HAK’s hotline 1195 is for survivors of Sexual and Gender Base Violence and purely for real time rescue missions and referral to other ideal GBV service providers.

    Kenya Insights further gathers that Ng’ang’as filthy trends backdates to his Kanunga high school days in Kiambu where he was expelled from school because of attempt to rape a form one boy. Back in the year 1998. He was notorious in homosexuality in school. Then he used to live in Thika. And at some point he was a matatu conduct route 237 Thika.

    We’re tasking the police to move with highest speed to arrest this man and bring justice to the young girl whose life as she says it has been totally destroyed.

    Ethnicity has been the key voting pattern since the onset of multi-party democracy in the early 90’s, parties have never won top seats through well-laid strategies, driven agenda or proper party manifestos. Politicians have always done tribal arithmetic to rout their opponents, the recent being ‘tyranny of numbers myth’ where considerably two large tribes teamed up to beat their opponents and share top political seats, president, and deputy president positions.

    The pattern goes beyond tribal lines, religion and geographical proximities also play significant roles. Opposition party ODM seems to be working out a formula along the lines of religion, with enough support from regions bordering Nyanza and beyond. The party is rooting for a well-calculated move to bag the Muslim vote. They are on a steady path after the party’s deputy leader and Mombasa county governor, H.E Ali Hassan Joho, successfully organized an anniversary rally just over a week ago in Mombasa, to last Sunday’s rally in Nairobi and a major fundraiser in Wajir the following day.

    Joho is currently playing in the national political league with enough authority as the coast region’s kingpin and the 2022 presidential candidate. He’s now moving from his comfort zones, holding rallies outside Mombasa County and stretching beyond the party to be the voice of the Muslim community which boasts of over 1.6 million votes. Islam is the dominant religion at the Coast and North Eastern Kenya, but they have been marginalized since independence. Members were at some point held at the Kasarani stadium in an abusive round up that aimed at screening individuals of Somali origin. They had no stronger voice to speak against the unlawful detentions other than quiet whispers that Islam is not terrorism.

    Things are now changing.
    Suna East Mp Hon. Ali Hassan Joho.
    Duale lost it all for playing too sycophantic politics and enriching himself forgetting to lead his group.

    When he sensed the support shifting to Joho’s base, he worked everything possible with the Interior CS Joseph Nkaiserry to scuttle a prayer meeting organized by Joho at Jamia Mall in March this year. The meeting did not go as planned and they were forced to hold prayers outside the mosque after some received intimidating calls from Harambee House.
    Now as 2017 draws closer with political landscapes changing, Joho is fast cementing his position in national politics and as a high-ranking, muslim leader to command the Kenya Muslim community. A section of the Muslim community has already endorsed him for 2022 presidency. A vibrant national Muslim leader has been missing for decades since the demise of the late Shariff Nassir.

    Duale is now less than his competition; Joho is the Cord’s/ODM’s man to counter Jubilee’s DP William Ruto. He led the top delegation of ODM team to Wajir where he donated the undisclosed amount of money. They raised shs 11.6 million to expand Madrassa Tul-Taqwa and Al-hudaa, the event was also used to popularize ODM party in the region. DP William Ruto is known for his ‘generous’ contributions, the man he is mostly likely face in the ballot in 2022 is also doing the same.

    Twitter is witnessing an increasing number of government requests for data involving user accounts.

    The company released its latest transparency report, which aims to help consumers better understand tweet removal requests and copyright notices as well as government information requests. With each report, the number of government requests continues to rise, and the US government continues to make more requests than any other government.

    This is the drawback of using social networks and other online services. The information you share can come back to haunt you. In most of the requests the IP logins tops the requests.

    Kenya tops the list of African Governments Seeking closure on users. This is done through the National Intelligence Service should that have a criminal case against a user to pursue. Here’s the graphical representation of the requests posted by GoK. Despite the requests, Twitter in the last 6 months granted the GoK access to either of the accounts they asked for.
