    Judge On The Spot For Allegedly Giving A Wrong Ruling That Allowed Eviction Of Residents, Deaths, Hospital Admissions Reported

    A Judge at the Environment and Labour Relation Court is on the spot for contradicting himself and giving a ruling that paved way for the eviction of residents in an estate in Nairobi, Kenya.

    This comes after questioned emerged on whether AFRICA REIT LTD, a real estate firm with Governor Johnson Sakaja’s City hall were behind the said ruling.

    So far some residents who have stayed at the estate for decades have been admitted in hospitals and some deaths have also been reported.

    “I want Chief Justice Martha Koome to intervene and stop this judges from violating people rights, my mum is an elderly and we have stayed here for decades, the ruling was so traumatizing,” said a resident.

    According to the documents seen by Kenya Insights, the Judge contradicted himself and gave a wrong ruling that has now paved way for land grabbing and illegal constructions in Woodley estate in Nairobi.

    In his ruling, Justice MD Mwangi, struck off a petition filled by the Woodley residents who had sued to stop Nairobi County Government from demolishing and evicting  them in an inhumane manner.

    Justice Mwangi ruled that the petitioners in the case before him were the respondents in a decided case and were therefore “re-litigating case” terming it res judicata. But the Petitioner were not respondents in that case and have not appealed that decision which was the bases of him dismissing the petition and allowing demolition of Woodley Estate to proceed on. The ruling basically based on a past petition which was not part of the residents proceedings.

    The residents have vowed to take legal action against him and they will be filling a complain at the Judicial Service Commission, residents are also dissatisfied by ruling in which the judge ruled public participation has been conducted  as the tendering process by city hall was advertised. The residents say that is not the criteria set out by Supreme Court for  public participation

    The ruling shows that the judge relied solely on the affidavits of respondents and developer and was thoroughly critical of theirs and even used “unjudicial language” to describe their petition.

    They claim that the Judge relied on an affidavit and submissions of the Respondent and developer which introduced a different ruling with a different parties which they both told the court the petitioner was the Respondent in that case and he believed them and gave a disturbing ruling. The ruling seems to have caused confusion and anxiety even as Governor Sajaka men continue to celebrate.

    Further more as per the documents in our possession, the Judgement failed to address the petition filed in court but relied on the Respondent’s theory.

    “This court finds that the petitioners intention in filling this petition is to re- litigate an issue that has already been decided by a court of competent Jurisdiction ; by giving cosmetic facelift renaming it a constitution petition,” the Judge said while referring to ELC No 2054 of 2007 which the a court in 2015 had ruled it would not have binding effect on the other suits stayed pursuant to the order it granted in it.

    Ironically, that case was between Kenya Anti-Corruption Commission and Mr.Paul Moses Ngetha whom we have confirmed that was not part of the petition filed by the woodley Residents. The  case before Justice MD Mwangi was between Woodley Residents  Welfare Association, Petitioner Wanja Kimani, Peter Ngatia, John Mugwe, and  Samson Mugacha Mwangi against Nairobi County Government, The attorney General and the Ministry of Housing and Urban Planning.

    Residents had Raised serious issues that the Judge failed to address but instead proceeded to strike out their suit without listening to them & even ordered them to pay costs, yet the error was on the court.

    For instance, the Woodley Residents who are the Petitioners told the high court that the County government is attempting to grab the properties and give it for free to a developer,  which houses they had been offered to buy by the defunct City council of Nairobi and were asking to now be allowed to buy by NCCG having lived in the houses for over 70 years. The Judge failed to address their right of equity and upheld land grabbing instead in his ruling in which he also used a harsh tone.

    They also told the court that  the projects set to be launched in a month’s time will lead to bringing down homes housing 3000 residents together with their investments inside the estate.

    They say this is an attempt by powerful people to evict the residents and allocate the houses and land  to themselves and their cronies claiming that there is no environmental impact assessment that has been done and presented to them.

    They wanted  the court to stop the county government through its agents from doing any act interfering with the peaceful, actual and exclusive possession and enjoyment of the land known as Woodley/Joseph Kangethe estate land parcel number LR No 209/13539.

    The petitioners said  that they have lived in the estate for more than 70 years, adding that the estate has historical and cultural heritage and diversity that needs to be jealously protected.

    “The said members have known Woodley to be their home where they have built shops, hospitals, schools, churches among other social amenities for their use and benefit of other members of the public.

    They claimed  City Council (now Nairobi County Government of Nairobi) resolved to sell houses in Woodley to sitting residents,” the petition reads in part.

    “Corruption marred the process where outsiders (non-residents) were allowed to buy the houses in total disregard of the existing tenants and consequently the sale was stopped when Woodley residents went to court after continuously being harassed by people who came in with letters as proof of purchase.”

    The petitioners claim that the sale of the said houses was recognized as the same had happened in Makadara and Dangoretti where residents bought the City Council houses in the past and Woodley residents were expecting the same would happen in their case.

    The plans to demolish the estate were mooted in 2021 by the defunct Nairobi Metropolitan Services (NMS).
    They also told the court that the process was marred with corruption and other funny illegal activities.

    However without considering the above case that was before him, the Judge proceeded to rely on a previous case and the Nairobi County Government defense.

    “Having carefully considered the findings by the court in ELCCC 2054  of 2007, and the petition filed in this matter as well as the application dated 2nd April, 2024, I am convinced that the gravamen of the petition by the Petitioners is prayer number (D) in the petition dated 2nd April, 2024,” read the Ruling referring to the previous Judgement that the court said should be bound to other suits.

    Although that prayer (D) requested the residents be allowed to buy their houses, the judge ruled that was a concealed attempt to claim ownership of the houses by the residents,  which the judge said he had seen through it and was on guard against it.

    He proceeded to ignore all other 6 prayers and used just that one to strike out the suit and permit the County Government to proceed on with the illegal works of house demolishing based on the above ground.

    “An order does hereby issue allowing continued
    enforcement of the resolution by the Nairobi City Council (now County Government of Nairobi) to allow tenants to buy the Council houses at Woodley Estate.” he said.

    They state that was grossly  injustice as their petition was not decided on correct evidence and merit but on presumptions and errors. They will appeal the decision as well as report it to the JSC seeking the Chief Justices intervention to stop the evictions & demolitions that will affect thousands of Nairobi residents.

    Kileleshwa Member of County Assembly (MCA) Robert Alai has criticized Deputy President Rigathi Gachagua for his recent comments on the eviction of Wakulima Market traders.

    Gachagua urged Nairobi Governor Johnson Sakaja to meet with the traders before proceeding with the eviction. He reminded Sakaja that the Kenya Kwanza administration had promised during the 2022 elections not to displace these traders.

    Alai responded to Gachagua’s remarks on X (formerly Twitter) on September 12, 2024. He called on Gachagua to stop interfering in the governance of Nairobi County.

    He noted that while Gachagua often refers to himself as a “villager,” Nairobi is not a village but the largest city in East and Central Africa.

    Alai emphasized that Nairobi must modernize to meet global standards. He stated, “Nairobi is East and Central Africa’s largest city. It must evolve, not just to survive but to meet global standards of modernity and dignity.”

    Alai Calls for Non-Interference in Nairobi’s Development

    Alai stressed that Nairobi’s leadership should be allowed to drive the city’s modernization efforts without interference. According to him, external involvement weakens the city’s governance structure and hampers its growth.

    Instead of focusing on preserving poverty and disorder for political gain, Alai called for the development of a prosperous and forward-looking urban center.

    He added that the Deputy President’s role should focus on fostering national unity, not undermining Nairobi’s leadership.

    Ongoing Tensions Between Gachagua and Sakaja

    The feud between Gachagua and Sakaja has been ongoing since the start of the Kenya Kwanza administration.

    Reports suggest that Gachagua prefers a governor from his Kikuyu tribe to lead Nairobi. However, Sakaja has garnered support from the top leadership of the ODM Party and Nairobi County ODM MCAs to protect himself from political interference.

    Sakaja’s Response to Gachagua

    Governor Johnson Sakaja also responded to Deputy President Gachagua’s comments about the Wakulima Market evictions. Sakaja criticized Gachagua for addressing the issue publicly rather than handling it privately.

    “My elder brother H.E. Rigathi Gachagua, you have my number,” Sakaja said, expressing his frustration with the public nature of the remarks.

    Gachagua had earlier urged Sakaja to have a meeting with the traders before evicting them. He reminded Sakaja of the 2022 promise they made together to the traders, assuring them that their livelihoods would not be disrupted.

    Gachagua further cautioned that breaking this promise would damage their trust. “Please, consider having a meeting with the market’s leadership to agree on any changes without harming their livelihoods,” Gachagua added.

    Wakulima Market Eviction Notice and Protests

    On September 10, 2024, Wakulima Market traders received an eviction notice from Nairobi County, ordering them to relocate to the newly constructed Kangundo Road market.

    The county administration explained that the relocation aims to reduce congestion in Nairobi’s central business district, improve traffic flow, and ease pedestrian movement.

    Following the notice, traders staged protests on September 12, 2024. The new market offers more space and better parking facilities, according to the county’s statement.

    Nairobi Governor Johnson Sakaja was unexpectedly removed from the presidential jet set to take President William Ruto and Azimio leader Raila Odinga to the Forum on China-Africa Cooperation (FOCAC) summit in Beijing.

    This incident, occurring just hours before their departure, raises questions about why Sakaja was excluded.

    Why Sakaja Was Abruptly Kicked Off President Ruto’s Jet to China

    Sakaja’s political career has faced numerous controversies. His removal from the jet may be linked to a past incident where he violated COVID-19 curfew rules.

    In 2021, police arrested him at Ladies Lounge, a Kilimani bar, for drinking after curfew. Officers found him with a group of 10 people at 1:10 am. Sakaja reportedly challenged the police to arrest him, highlighting his defiance.

    The curfew violation is not the only issue tarnishing Sakaja’s reputation. Many Nairobi residents view him as incompetent and corrupt.

    In July 2023, the Tunza Mtoto Coalition criticized him over a corruption scandal at City Hall. They claimed millions of shillings had been paid for services that were never provided. This has deepened the financial struggles of Nairobians already facing high living costs.

    Sakaja is Brazenly Corrupt

    Muthoni Ouko, executive director of the coalition, urged Sakaja to follow Chapter Six of the Constitution, which outlines leadership and integrity.

    She demanded a public statement on the scandal and called for Sakaja’s full cooperation with investigators.

    Questions about Sakaja’s academic qualifications have also emerged.

    Adding fuel to the fire, questions surrounding Sakaja’s academic qualifications have resurfaced, with many doubting the legitimacy of his degree from the obscure Team University.

    Critics argue that Sakaja’s educational background is as dubious as his governance, further undermining his credibility.

    Following Sakaja’s abrupt removal from the presidential jet, speculation swirls about a potential political alliance between Ruto and Raila aiming to replace him with a more compliant candidate.

    One contender emerging is Embakasi East MP Babu Owino. As a young and dynamic politician, he could pose a significant challenge to Sakaja in the 2027 elections.

    With Ruto and Raila now wielding power, they likely have strategies in place to ensure Nairobi is led by someone they can control.

    As Sakaja’s political future hangs in the balance, some suggest that a cabinet secretary (CS) position could be offered as a consolation prize—a graceful exit from the Nairobi gubernatorial seat that has proven too hot to handle.

    The simmering tensions within the United Democratic Alliance (UDA), have now escalated to a full-blown scale.

    Nairobi governor Johnson Sakaja, who has been under the scope of Deputy President Rigathi Gachagua, has fired salvo at the besieged DP, who has been under attack from opposing factions in the ruling party.

    Sakaja has told Rigathi to respect President Ruto and other elected leaders, including himself, and warned him to stop fighting Ruto.

    Speaking to over 7,000 UDA grassroots delegates, Sakaja who’s vying for the Chairmanship in Nairobi, emphasized his determination to remain undeterred by those opposing his candidacy.

    He underscored the importance of strengthening the UDA in Nairobi to secure more seats in the upcoming elections compared to the last cycle.

    Sakaja took a swipe at the UDA Deputy Party Leader, Deputy President Rigathi Gachagua, accusing him of bullying leaders within the ruling coalition.

    He said: “Huwezi kuwa you are bullying people for two years, then unatajwa wiki moja unaanza kulia. Do you know bullies are the biggest cowards?”

    “Mpaka unaenda sijui kwa msitu, sijui wapi…if you want respect, respect other leaders. If you don’t respect those leaders, then respect the people who put them there.”

    Sakaja went on to dare the DP to run for the Nairobi County governorship seat in the 2027 elections if he does not respect his capacity as an elected official.

    “I’ve been through a lot and I’m not easily intimidated, nobody has the right to say I was given the seat. I was elected,” charged Sakaja.

    “In 2027, you are free to run for any elective post, run and be Nairobi Governor.”

    The Nairobi Governor meanwhile stressed that the party must elect leaders based on their agendas for the people rather than tribal affiliations.

    Sakaja in his address said that he envisions a future where key positions such as Governors, Senators, Women Representatives, and half of Nairobi’s Members of County Assembly (MCAs) are held by UDA members.

    Rejecting his critics as proponents of tribal politics, he reaffirmed his commitment to fulfilling his gubernatorial duties.

    Corruption

    Sakaja’s administration has come under increasing criticism for alleged massive looting that has attracted major critics, including the DP, and it’s unsurprising that he seized the moment to go on a full attack on Rigathi.

    City lawyer Donald Kipkorir (DBK) has come out to reveal that Nairobi County Assembly Committee members and Governor Johnson Sakaja had demanded a huge chunk of bribe to approve his pending debts.

    DBK says he was approached to cut a deal to have his payments first tracked. Nairobi County owes the lawyer over Sh1.69 billion in legal fees pending since 2022.

    He recently won a case and had instructed auctioneers last month to seize assets belonging to the Nairobi County government to cover his debts.

    However, there has been a strategic delay in settling the debt and now it appears it was aimed at boxing him into cutting a deal.

    DBK claims that last month, Nairobi County Assembly Budget Committee together with Governor Sakaja Johnson were in Naivasha preparing the County’s Supplementary Budget and that it was here that they coined a deal to extort him.

    He goes further to say they had demanded for a Sh845 million bribe from the Sh1.69 B that the county owes him.

    “They called me that they want to approve all my payments if I give them 50% of the sums I am owed.” He says.

    He turned out the deal, he says, “I told them, my fees are in accordance with The Advocates (Remuneration) Order & decreed by Court & I won’t pay a bribe. Nairobi City under the Governor pay Bills, Invoices & Court Decrees to those that pay a bribe of 50%.”

    His latest revelation doesn’t come as a surprise, earlier this month, he had hinted on the schemes before finally laying it all bare, “I have been advised that City Hall top officials have vowed they will frustrate my judgments against them through all subterfuge methods. That doesn’t bother me. What bothers me is that Public Officials have weaponized their offices.” DBK had posted on X earlier.

    DBK instructed Garam Investment Auctioneers on March 27, 2024 to seize valuables, office equipment, computers, furniture and cars to satisfy the debt. This followed the High Court Judge Nixon Sifuna decision that quashed section 13A and 21 of the Government Proceedings Act, opening the door for litigants to attach government properties or bank accounts to recover their debts.

    While quashing the laws, Justice Sifuna termed the sections colonial relics that have no place in modern society and were only meant to frustrate rather than facilitate the processing and expeditious disposal of cases.

    However, DBK alleged a plot by City Hall to overturn the decision, “The ruling by Sifuna allowing attachment of County Government property has unnerved City Hall & upended their nefarious schemes. Because, you can now attach, there is no excuse for City Hall to blackmail for payments to be done. Now City Hall wants to fund the ruling of Justice Sifuna to be overturned in the Court of Appeal. Nairobi City County is truly rotten at all levels. It is irredeemable.” He said on April 4, 2024.

    Blackmail and extortion

    DBK says he has been in business with the Nairobi Government since 1998 and it was until 2012 when blackmail and extortion took precedence.

    “Since devolution in 2013, payment of legal fees & bills for provision of other services like construction et al became subject to surrender of your payments to City Hall apparatchiks. I refused to pay & City Hall stopped giving me work or paying my outstanding legal fees. In the current County Government, to be paid legal fees, you must pay City Hall officials to the highest level 50% of your legitimate fees. Contractors pay upto 40%. Again, I declined to pay them.” He said.

    Law firms like Kwanga Mboya and Company Advocates have found themselves being at the center of accusations of playing to the dirty tricks of City Hall. In a complaint against them on Nyakundi blog, the firm is claimed to be getting payments instantly while others are kept in waiting.

    Most corrupt leadership

    The lawyer has described the Nairobi County’s leadership as the most corrupt and called on President William Ruto to dissolve the county assembly and expel Sakaja from UDA party.

    “Nairobi City under Sakaja Johnson will go down as the MOST CORRUPT LEADERSHIP in Kenya’s History with a County Assembly that is completely beholden to him. It is time President William Ruto dissolves both the County Assembly & expels Sakaja from UDA and EACC should arrest Nairobi County leadership of both the Executive & the County Assembly.” Said the lawyer.

    History of Sh1.69 billion debt owed to Kipkorir

    DBK was awarded one of the highest legal fees in the country’s litigation history for defending the county government against the Ministry of Defence over a parcel of land where Embakasi Barracks sits. The Environment and Land court in 2022 ruled that Mr Kipkorir should be paid Sh1.338 billion for representing the defunct city council in a case that was in court for close to 10 years over the 3,000-acre land valued at Sh61.5 billion. The amount has since increased to Sh1.69 on account of interest.

    DBK acted for the defunct city council when its land was forcibly taken by the Kenya Defence Forces, triggering the court case in 2012 but the matter was later withdrawn to allow for the case to be settled through inter-governmental relations.

    Most incompetent

    Elsewhere, a section of Nairobi County leaders have slammed Nairobi Governor Johnson Sakaja accusing his administration of being the “most incompetent and morally degenerate” county government.

    In a strongly-worded statement, the leaders led by Dagoretti South MP John Kiarie accused Sakaja’s administration of contributing to Nairobi County’s deteriorating state.

    They pointed out issues such as widespread sewerage problems, garbage mountains in residential areas, water shortages amidst flooding, and poorly planned high-rise constructions.

    “It is our observation that Nairobi could be facing its worst leadership crisis at City Hall in the capital’s history. The dream that was sold during the campaigns of a city of order, dignity, hope and opportunity has turned into a nightmare. Nairobi is becoming clamped in an ever-tightening chokehold of an arrogant and dangerously corrupt leadership,” said Kiarie.

    Citing a recent Auditor General report, Kiarie further accused Sakaja’s administration of gross financial mismanagement, including payments to ghost workers and selective payment of bills for kickbacks.

    “In a shocking revelation last year, a junior officer wielding authority directly granted by the Governor, clandestinely approved over 600 building plans against the Physical Land Planning Act which stipulates that the County Chief Officer is responsible for approving building plans,” he said.

    “That would explain the ‘kiudutho’ development and the unplanned highrise buildings that are mushrooming and cropping up in every corner of Nairobi. Such cases of abuse of power only give a preview of the rot house that is the Nairobi City County.”

    Kiarie further condemned the acquisition of luxury assets by top Nairobi County officials, describing it as a disregard for public welfare.

    “Never before has Nairobi ever been pilfered so brazenly and with so much display of juvenile bravado, intimidation, exclusion and undermining of those who they are not able to pay with their looted billions,” he said.

    “Pitting leaders against each other and sponsoring squabbles has become the expensive hobby of the Governor and his court of loyalists.”

    A section of Kenyans have turned their backs on Nairobi governor Johnson Sakaja and accused him of being intolerant towards fair criticism after suing Human Rights activist Jerotich Seii for alleged defamation.

    Coming hot on their heels, the Nairobi boss is being criticized for not having a hard shell to deal with criticism from his voters.

    The governor has moved to court seeking Sh100 million in damages from the activist and Standard Media Group for defamatory remarks she allegedly made during an interview with Spice FM.

    The suit doesn’t come as a surprise as Seii has in the recent past put up a sustained campaign against the governor especially on social media stemming from illegal structures suffocating the city.

    The Suit

    In the court document, Sakaja asserts that on January 26, Jerotich Seii appeared as a guest on the program, where she insinuated collusion between him and real estate developers to erect high-rise buildings exceeding legal height limits.

    “On the 26th day of January 2024, the 2nd Defendant/Respondent herein, in a morning show programme dubbed ‘The Situation Room’ that was aired by one of its radio stations by the name Spice FM, hosted the 1st Defendant as the guest speaker where alongside the programme hosts namely Mr. Eric Latiff, Ms. Ndu Okoh and Mr. Charles T Muga, went on a discourse of discussing the guest’s views about the recent unveiled Chinese Property Developers Association,” the statement read in part.

    According to Sakaja, the program hosts failed to moderate the guest’s remarks, which he claims have tarnished his reputation and undermined his status as a reputable citizen, as enshrined in Chapter Six of the Constitution.

    The lawsuit specifically highlights statements attributed to Jerotich, implying that the Governor and developers knowingly violated the law.

    “The community are organised, they do public participation informing the developers that you are not going to construct here and send them away somehow, these guys end up getting permission/permits that they require and finally after launching the association and going to visit the Governor Sakaja in his office, the following day all permits were issued and they are excavating as we speak,”Jerotich had purportedly stated.

    Through his lawyers Okatch & Partners, the governor accuses the activist of defaming him by linking him to a Chinese cartel behind the controversial buildings in the capital.

    “She alluded to the fact that the Governor had “gotten to bed” with the Chinese Property Developers and thus neglected the voters who have elected him into his office, to add salt to the injury she vehemently stated that the Governor Johnson Sakaja had left the groups whatsapp in order to avoid accountability and she vehemently stated that:”….Governor Sakaja, left all the Kilimani Foundation whatsapp groups quietly in the dead if the night on the 27th day of December, shortly after that, the Chinese are in his office thereafter, he is launching the Chinese property Developers Association, Immediately after permissions are issued to this company called Alina on Likoni Lane and the MD of Alina is the vice chair of the Chinese property Developers Association. If this is not cartel what is?” Part of the document reads.

    Moreover, the remarks have been framed as an attack on his qualifications to hold office as stipulated by Chapter Six of the Constitution of Kenya, 2010.

    The governor seeks not only a financial settlement but also an unqualified apology from the defendants, along with a permanent injunction to prevent further defamatory publications.

    Nairobi Senator Edwin Sifuna called out the governor over his decision, “This is a cowardly attempt to silence critics. We need involved citizens like you to keep the elected honest. The beauty is that Nairobi has 5 million of us. Sakaja cannot sue us all.” He write on X.

    Taking to X to express their disgust with the suit, a number have marked it as a SLAPP aimed at silencing Seii and potential ‘defamers’. “This looks suspiciously like a SLAPP suit. Unfortunately these are becoming all too common,” John Allan Namu, renowned investigative journalist pointed out.

    “The primary goal of a SLAPP is not to win the case, but rather to use the legal process itself to inflict financial and emotional strain on the defendant. Defamation suits are a common SLAPP tactic,” Lawyer Stephen Mallowah explained.

    Some senior lawyers also dismissed the suit as a joke, former Law Society of Kenya (LSK) President Nelson Havi belittled it sarcastically terming it ‘Obtaining fees through false presences’.

    Another lawyer Mr Ndong termed it as a suit in futility, accusing the lawyer who drafted if for misleading the governor, “Sometimes I do think some of my Learned Friends mislead Clients in Defamation suits. Definitely won’t succeed.”

    Renowned activists also joined to stand in solidarity with Seii and in calling out Sakaja for his move, “You fight out of pain or passion. What’s important is that when Jerotich wins, the public wins. She is fighting for all Nairobi residents.” Boniface Mwangi said.

    “We cannot allow criminals and dishonest politicians like Sakaja who are drunk with power to use the courts to intimidate citizens for exercising their rights!” Said Wanjeri Nderu, “Human Rights Defenders and Active citizens have a right to demand for services and accountability from elected officials. Defamation lawsuits are a tactic used by those afraid of exposure to silence critics we must speak up. This is madness!” She added.

    Seii has relentlessly criticized the county government and the governor himself for overseeing rising constructions of alleged dangerous buildings in the capital mostly done by the Chinese contractors that she alleges have pocketed the governor.
