    Petition: Marsabit Governor Mohammed Ali On The Spot Over Graft Allegations In Billions

    A Marsabit resident wants the court to block National Treasury from disbursing monies to the county government until the Mohammed Ali’s led administration accounts for funds allocated since 2017.

    In a petition, Mohamed Said Chute has sought orders to bar the Controller of Budget and the Cabinet Secretary National Treasury from approving and releasing funds for budgetary estimates allocated to the County Government of Marsabit for the 2021/2022 financial year.

    Said further wants the court to compel the auditor General to publish and make available before court the financial Audit Reports for the County Government of Marsabit from 2017 to date.

    He also wants the court to compel the controller of Budget to publish and report to court the Budget ceiling for each county department for the County Government of Marsabit for the said period.

    Said is also seeking orders to compel the Governor and executive committee finance to give an account of Sh119,000,000 allocated to the county for COVID-19 pandemic.

    Through lawyer Elias Mutuma, Said seeks the court to compel Governor Mohamed Mohamud Ali and County Executive Committee Finance to present before court, statements of account on all the statutory deductions and remittances for P.A.Y.E, and Employer’s Contribution to N.S.S.F, N.H.I.F, Gratuity, LAPFUND and Pension made for all the County Staff for the period 2017 to June, 2021.

    “Court be pleased to compel Auditor General to conduct a special audit on the Respondents’ financial accounts for the period between 2017 to 2021financial years and file the report in court for the following Budgetary Allocations in Marsabit County pending hearing and determination “, Said added.

    He argues that the people of Marsabit have a right to dignified life and access to resources, which right is being violated unless the Respondents are compelled to give account of county funds allocated each year from 2017 to date.

    Ali is one of the marked corrup governors who’ve been on the EACC radar. Marsabit county top officials were questioned on claims of irregular employment. Garissa county government is being investigated over employment of staff using forged documents, over-staffing and lack of adherence to employment procedures.

    in July this year, the National Treasury Cabinet Secretary Ukur Yatani wrote to the Ethics and Anti-Corruption Commission (EACC) to investigate his political rival, Marsabit Governor Mohamud Ali.

    In the letter dated July 8, and copied to the National Intelligence Service (NIS) Director General Philip Kameru, Mr Yatani directs EACC boss Twalib Mbarak to expedite investigations against his Marsabit Gubernatorial race opponent.

    The directive by the Cabinet secretary to EACC raises questions on the use of State office and investigative agencies against political opponents.

    Mr Yatani, who lost the Marsabit gubernatorial race to Mr Ali in 2017 polls, has already expressed interest in contesting for the seat again in 2022.

     “In view of the above developments, I urge your office to quickly investigate all bank accounts held by the governor and his family members,” states Mr Yatani in the letter.

    Travel expenses

    The letter, which is marked as confidential, directs the EACC to narrow the investigations on Mr Yatani and examine the travel expenses incurred by the governor and his family members.

    The letter states that the governor should be investigated for some Sh1.5 million media advertisement bill and use of road levy funds among others.

    Mr Yatani says as a Cabinet Secretary, he is duty bound to highlight the unanswered graft questions raised against the governor.

    The letter bears the logo of the office of the National Treasury and Planning, and signed off by Mr Yatani, which means he is giving the directive in his official capacity.

    The EACC is an independent institution and creates aspersions, especially coming at a time when the investigative authority like Directorate of Criminal Investigations are being accused of witch-hunt.

    The dirty past has come to haunt Lunga Lunga Mp Khatib Mwashetani who has shelved his 2022 gubernatorial ambitions in favor of Kenya Ports Authority engineer Lung’anzi Chai as he resorts to the drawing board.

    Mwashetani is backing Lung’anzi who has swindled from NG/ CDF like him and they both members of UDA, a fast rising political party associated with the Deputy President Dr. William Ruto. But he has not only chickened out of the Kwale gubernatorial, Mwashetani is technically taking a break from politics, may be to clean up and reinvent himself after he became unpopular for misusing CDF funds.

    He wants Kwale to end in the hands of Lung’anzi, a man who pocketed bribes while serving as the CDF manager for Kinango constituency where he selected by Hon. Gonzi Rai. Lung’anzi used his top position to hawk CDF bursaries at Sh10,000 and Sh20,000 to poor parents in Kinangop.

    That is the man who Mwashetani is not showing signs of defending his Lunga Lunga seat  wants to become the Kwale boss. A corrupt man who will dish out lucrative tenders to individuals like him [Mwashetani] who wants to hide from the limelight.

    He is not focused on defending his Lunga Lunga seat but he is instead planning to campaign for the DP Ruto who is eyeing presidency in the 2022 elections. His tainted image has seen him shiver from a race that is attracting big wigs and seasoned politicians like former cabinet minister Ali Mwakwere.

    Mwakere recently pulled an old school stunt when he refused to hand over microphone to Agriculture PS Hamadi Boga during the burial of former Kwale Women MP Zainab Chidzuga.  Boga, Mwahetani’s partner in crime is also in the race to succeed Salim Mvurya whose term will expire in August 2022. Kwale Deputy governor Fatuma Achani and one Daniel Gereza Dena are also running.

    Mwahetani and PS Boga were found to have orchestrated the irregular payment of Sh1.8 billion to controversial firms that imported maize during the drought of 2017. Investigations by Ethics and Anti-Corruption Commission (EACC) also revealed that they colluded with Procurement chiefs, accountants at the Agriculture docket and directors of Blackstone Investment in the scam.

    Noah Wekesa who chaired the Strategic Food Reserve Fund (SFR) at the time only raised an alarm after Sh1.8 billion had been withdrawn and paid to the Commodity House without approval from the board.  The rafters of the scam claimed that the payment was meant to clear pending bills for grain imports.

    But upon further investigations, EACC also found that Blackstone Investments which associated was paid Sh792.5 million is associated with Mwashetani who benefited from the proceeds though the company was not even invited to tender.

    “Blackstone Investment had not been invited to tender, yet it was contracted to supply maize contrary to the Public Procurement and Assets Disposal Act (PPDA),” said Twalib Mbarak, the EACC chief executive.

    Kenya Film Classification Board boss Ezekiel Mutua has been left with an egg on the face just hours after insisting he was still in charge at KFCB.

    Mutua even went ahead to preside over an official function Friday morning in Kiambu county, only to be sent on compulsory terminal leave awaiting the expiry of his contract in October.

    Mutua commonly referred to as the moral cop for censoring films and songs with obscene content has been replaced by Christopher Wambua, Director of Public Communication CAK in an acting capacity for two months.

    According to a memo from KFCB  acting Chief Manager, Corporate Services Mr Paskal Opiyo, Wambua’s appointment takes effect immediately.

    Earlier, Mutua refuted claims that he had been fired over alleged abuse of office and urged Kenyans to ignore what he dismissed as malicious rumours.

    “My attention has been drawn to reports on social media to the effect that I have been fired as CEO of KFCB. PLEASE IGNORE such malicious rumours. I am not aware of such developments and there can be no grain of truth in them as there’s no vacancy in the office of the CEO KFCB” he said.

    His response had been prompted by a tweet from Senator Mutula Kilonzo Junior who accused ICT CS Joe Mucheru of unlawfully sacking the KFCB boss.

    “Ezekiel Mutua unlawfully removed by CS Mucheru as CEO after being lawfully appointed by the board. Laws are mere suggestions for this administration,” Kilonzo Jnr tweeted.

    There have been accusations that the KFCB boss is planning to extend his term in office without falling due process.

    The unconfirmed reports further indicated that the State Corporations Advisory Committee (SCAC) had waded into the matter when it got wind of the scheme to renew his contract for a third term hence, asked the CS to take disciplinary action against the KFCB Board.

    Mutua who has served at the helm of the Kenya Films Classification Board for six years has always been at the centre of controversy over his strict directives.

    It emerges that Mutua who’s been baptized deputy Jesus’ given his delusional moral standards that often put him in the wrong with Kenyan artists most of whom he frustrated with his position to stall creativity,had schemed to extend his term in office and beside, is also now under corruption investigations.

    According to document seen before Kenya Insights, EACC has launched probe into Ezekiel Mutua and a Board Member Ms Gathoni Kungu over alleged Irregular payments of Salaries and Allowance.

    The anti-graft commission has asked the film board to facilitate them with relevant documents to conduct the investigations in which the CEO is alleged to have paid himself millions outside the set salary and allowances pointing out to a massive corruption.

    Mutua, is not new to accusationsaccusations of theft, the once the secretary general of Kenya Union of Journalists and journalists are not best friends and their reasons are many. Chief among them is KUJ Awards fiasco of 2006, where prize money and television sets, meant for winners, did a disappearing act.

    While journalists talk about the incident, Mutua — who is perched on KFCB’s plush 15th floor office at Uchumi House — wants to forget it. Completely. He does not even want to talk about it.

    Mutua has been in the news more times than a news ticker for his new role as a moral police who is on a banning spree. Mutua’s juggernaut has left multiple victims in its wake. Ask beer giants, East African Breweries; or the manufacturer of condom brand, Durex. Or, for that matter, ask Coca Cola, whose soft drink advert was deemed to have crossed his regulatory red line.
