    Cyrus Jirongo, one of the biggest beneficiaries of autocratic regime of the late President Daniel Moi, had come out to reveal one of the darkest secrets that’s bound to elicit new debate and anger.

    Jirongo in an interview with Lawyer PLO Lumumba has sensationally claimed that the Moi regime knowingly dumped toxic nuclear waste in Norther Kenya and has linked it to the high prevalence of cancer cases in the region.

    He claims he was given classified documents by Jim Choge who at the time was Nicholas Biwott’s lawyer. Biwott known as Total Man, was the most powerful man in Moi’s cabinet at the time. Jirongo says the documents had details of the allegations and where the waste was being dumped in the Northern Kenya.

    He confronted Moi with the documents of energy officials cheating Kenyans that they’re on oil searching mission while in real sense, dumping poison in the said region. He says Moi’s reaction was shocking, he instead got furious as to how Jirongo laid his hands on the classified documents.

    “I’ve never been in trouble like that, because I was asked where did you get the documents from?” Jirongo said Moi went ahead and issued serious threats to him, “if you don’t tell me where you got this documents from, it’s the end of you.”

    He then made attempts to calm the angry Moi and reminded him of the secrecy code, “yourself said we must always keep secrets and I can’t reveal my sources, you now have the information and the state machinery as the head of state to verify and ascertain the the facts of this matter,” Jirongo recounted his conversation with Moi.

    He says their meeting went on for over 30 minutes and it was so heated that at one point the president’s security stormed into the room thinking that things had escalated into physical altercation, “he was ranting loudly, his security had thought I was fighting him,”

    After their meeting, Jirongo said Moi sent him a stern warning against revealing to anyone any detail of what they had talked about, “whatever we’ve discussed here, if I ever hear it outside there, utajua (you’ll know me),” Jirongo recalled Moi saying.

    He goes further to point out in the interview seen by Kenya Insights, that he was not only fixed subtly by Biwott by being given the sensitive documents through his lawyer to have him fired from Moi’s inner circle but also that Moi whom he had confronted with the documents, could’ve been complicit in the alleged plot.

    “I thought to myself what I was doing and questioned myself whether I was talking to the person who was dumping the waste because that’s what appeared to be the reason behind his angry reaction.”

    Jirongo recalls that his meeting with Moi promptly ignited a cabinet reshuffle with panicked Moi trying to control the damage and contain further information leak, “as I crossed the gates of State House, it was around 4pm, the Permanent Secretary who had just been posted to the Ministry of Energy was immediately reshuffled following our quarrel with Moi because it was believed he was the one who had given me this documents yet it was Choge, Biwott’s lawyer who had given them to me,” he says.

    Jirongo says he later learned of the bigger plot to finish him, “Biwott gave Jim the documents so he could get back to Moi that we’re naked, that this boy(Jirongo) knows too much about us therefore we must destroy him.”

    Jirongo, a former presidential candidate attributes the high cancer rates in Northern Kenya to this dumping, “if you do a survey on the cancer rate in Kenya, you’ll find out it’s heaviest in the North Eastern and it’s surrounding, if you go to western and Nyanza, the cases are not as many because the dumping was taking place in that direction.

    Why cancer prevalence is high in Northern Kenya

    Cancer has become a leading cause of death in the country with an estimate of over 100 lives being lost to the monstrous illness everyday.

    In 2014, then Standard Media Group Crime reporter Dennis Onsarigo highlighted the plight of the people of Marsabit and Mandera Counties, who are silently suffering from the dreadful disease.

    In the documentary dubbed Desert of Death, Onsarigo narrated how the poor ontinue to lose their loved ones to stomach and throat cancer.

    In the story, the reporter had highlighted how young children, mothers, fathers and their grandparents travel through the painful cancer journey without proper medication.

    Then, the youngest cancer patient was three years old. The boy died a few weeks after Onsarigo visited the area.

    In fact, Onsarigo found out that the residents had no money to buy food, leave alone transport to get them to the nearest hospital.

    Loss of weight, chest pains, throat pain, belly swelling among patients paints the picture of the sorry state of residents, a majority of whom died less than a year later.

    The investigation linked the cases to human activities in and around the county.

    In Kargi village, Onsago identified wells that were dug by a foreign oil company about 30 years ago in the quest of oil in the region.

    The wells are the source of water for the residents and their animals.

    According to a health officer who Onsarigo interviewed, majority of the patients that the local hospital admitted had drunk from the well, and there were sufficient reasons to believe the water, contaminated with excessive levels of mercury and other chemicals, is the cause of cancer in the area.

    At the time, the medics disclosed that at least 64 cases had been reported in Kargi village, the numbers rising by half from previous years.

    Doctors received three cases related to cancer every week.

    Alarmed, a government report recommended for the closure of wells drilled close to the oil exploration sites over suspicion that something toxic may have been dumped in the area.

    The report recommended that residents find alternative water points for their animals and own consumption. To date, dozens continue to fall ill.

    Besides the government, various experts including foreigners examined the water and concluded that it was unfit for human and animal consumption.

    Besides human deaths, reports indicate that as of 2014, over 2000 cattle had died after drinking water from the wells.

    Where the problem started

    Sometime in May 1984, Amaco Corporations, the parent company of Amaco Petroleum Kenya was given the green light for prospective oil in Kenya. The agreement signed with Amaco was close to Ksh691 million.

    The exploration would according to the government and the international giant oil company roll out on a staggering 14,000 square kilometres and Marsabit was at the centre of the plan.

    Amaco dug at least five oil wells among them Sirius-1, Bellatrix-1, Chalbi-3, Hothori-1.

    The wells would later deprive residents happiness.

    Increasing cases of cancer in the region raised an alarm in 2006. A government delegation was sent to probe the matter.

    A report by the National Environment Management Authority of Kenya (NEMA) revealed that indeed water in the region that locals depend on for their daily activities was not fit for consumption.

    Involvement of Europe

    In 2010, the environmental organisation, Greenpeace, revealed that nearly 10 million tonnes of radioactive toxic waste from Europe was shipped to Africa between 1988 and 1994, and identified the Somalia coast as one of the key destinations. In 2005, an Italian environmental group and a former member of a criminal organisation also revealed how dozens of ship laden with toxic waste were sunk off the Italian coast and in the Mediterranean. They also reportedly shipped this dangerous waste to Somalia, Kenya and DR Congo to be buried on land or dumped off their coast.

    According to UNEP officials, large containers of hazardous waste, including heavy metals such as lead and mercury, washed ashore in parts of Puntland, Somalia during the Tsunami in 2004. In 2009, Al Jazeera TV aired a compelling documentary in which former officials of an Italian maritime company revealed how they bribed officials in Somalia in the 1990s to bury radioactive waste in heart of that country, amid heart-rending story of death and destruction in that area.

    In 1992 the countries of the European Union and 168 other countries signed the Basel Convention on the Control of Trans-boundary Movements of Hazardous Waste and their Disposal. Despite that, international trafficking in toxic waste by businesses and criminal lobbies has soared.

    According to Greenpeace, it is a lucrative enterprise of $124 billion annually. Europe alone produces over 40 million tonnes of toxic waste; 70 per cent of these is unaccounted for.

    The cases of cancer deaths continue to be reported in the region but little has been done to correct the situation as residents still use the water to quench their thirst. Besides mercury, the water is said to have high levels of nitrate chemical compound.

    A filter was installed in the area to lower the level of contamination in water but a few years later it’s not in use. Experts warn there is more than contaminated water, begging the question of which substance was left behind during the excavation.

    The residents just like many poor Kenyans in the country who can not afford early screening of cancer or access specialized treatment continue to wait for help that may never come, all they stare at is increasing number of graves that remind them of their forgotten state.

     

    Class suit

    Cancer is the second leading cause of death among non-communicable diseases, and the number of cases is rising rapidly.

    The annual incidence in Kenya is about 28,000 cases, with an annual mortality of 22,000 cases, meaning 78.5 per cent of the victims do not survive.

    Cancer is also said to be the third-leading cause of death in Kenya, after infectious and cardiovascular diseases. In 2005, cancer deaths were about 18,000 people, and by 2014, they were about 22 000.

    The disease affects Kenyans of all ages and socio-economic backgrounds but has a disproportionate impact on the most vulnerable groups.

    Cervical cancer makes up the largest portion of cancer cases (nearly 12 per cent), followed by breast cancer, Kaposi’s sarcoma, oesophageal and prostate cancer.

    In 2023, according to the World Health Organization’s International Agency for Research on Cancer, new cases of all types of cancers increased to nearly 20 million worldwide, and there were 10 million deaths (up from about 17 million and 9.5 million respectively in 2020).

    Projections suggest that one in five people worldwide will develop cancer during their lifetime and that the global cancer burden is projected to rise by about 50 per cent over the next 20 years.

    The growing burden is driven by aging populations, as well as several risk factors, such as sedentary lifestyles, obesity and smoking.

    Most cases in the country are diagnosed at an advanced stage, when treatment options are limited and families make huge sacrifices, often with poor results.

    Petition

    In the wake of Jirongo’s confession, there has been an increasing calls for a class action lawsuit against the government.

    “The prevalence of throat cancer in Northern Kenya is higher than the rest of Kenya and the toxic substances are believed to be the precursor. The perpetrators of this heinous crime should be identified and, if possible, punished. The victims should get reparation.” Simba Guleid, former Isiolo Governor has said.

    In 2020, the Marsabit community petitioned the High Court, through Kituo Cha Sheria, to compel the government to intervene quickly to avert further spread of the scourge to save the lives of both people and livestock.

    It is the first time in Kenya that a community is suing the state to have it compelled to provide a clean and healthy environment—a constitutional right.

    The matter was filed before the deputy registrar of the Constitutional and Human Rights Division at the High Court in Nairobi by senior counsel John Khaminwa and Kituo Cha Sheria lawyer John Mwariri and Valarie Ang’awa.

    In this case, the petitioners are compelling the government to ensure they have access to clean and safe water.

    The underground water used by the pastoralist communities in the desert has been found to contain toxins.

    Residents claim the poisonous substances were dumped in the desert by multinational corporations.

    They said Amoco Petroleum, which explored oil in the 1980s and abandoned the project, after drilling oil wells in Kargi and Dukana locations, did not properly decommission the wells.

    Residents claim the chemicals used by explorers in their activities were neither destroyed nor buried. They include toxic chemicals, general equipment and scrap metal.

    The poisonous material was left on the ground and is suspected to be the cause of the numerous cancer deaths among residents. Livestock is also affected.

    Other areas affected include Dukana, Bubisa, Maikona, Kalacha and Noth Horr—all in the northern part of the desert. The disease has also spread to other parts of the county.

    The petitioners are also blaming a cache of carcinogenic, hazardous waste they say was dumped in the desert around Kargi location in the 1980s by global companies.

    To support their assertion, they cite a report in 2010 by Greenpeace, an environmental non-governmental organisation based in the Netherlands.

    In the report, the NGO revealed that nearly 10 million tonnes of toxic waste from Europe were shipped to Africa between 1988 and 1994.

    One of the key destinations for this cancer-causing waste, the report said, was the Somalia coast.

    The petitioners, however, say the Greenpeace report is supported by Legambiente, an Italy-based environmental association that started out as an anti-nuclear campaigner.

    It confirmed that “vessels were sent to Somalia and other developing countries such as Kenya and Zaire (DR Congo) with toxic cargoes.”

    The nuclear waste is believed to have been buried in the Chalbi desert and other barren areas of northeastern Kenya.

    Speculation about the dumping of nuclear waste has been rife in Kenya, and the issue was first raised in Parliament in the 1990s following complaints about incidents of strange deaths in Marsabit and in northeastern counties.

    The government has always denied the claims, but in 2009 the Ministry of Environment investigated the cause of the deaths of people and livestock in Kargi location, assisted by other ministries and government agencies.

    In a report, Persistent Water Poisoning in Marsabit District, the government notes that Western multinationals are known to have dumped hazardous waste in third world countries. It goes further to say that allegations that such waste might have been discarded in Kenya should not be dismissed.

    Residents of Kargi witnessed the dumping of toxic waste. It took place at the same time as the oil exploration by Amoco Petroleum.

    One of the most memorable is the deaths of 7,000 livestock—cattle, sheep and goats—in January 2000. The animals had consumed water from a borehole in Kargi.

    Near the borehole, a deep hole, residents say, had been drilled by unknown foreigners and several white substances buried and covered.

    Earlier in the 1990s, a similar incident had taken place in Balesa, near Dukana in northern Chalbi, when a flock of sheep and goats died after consuming water from a borehole drilled next to an abandoned oil well.

    The well was drilled by Amoco Kenya Petroleum Company.

    After the livestock deaths, several cancer cases were detected among residents of Chalbi desert—a majority of them from Kargi, Bubisa, Maikona, Kalacha and North Horr.

    Death became so common in these areas that people stopped seeking medical treatment after being diagnosed with cancer.

    North Eastern leaders to Jirongo

    Leaders from the larger North Eastern Region have in the past been vocal about the alarming cancer rates that they say risk wiping out the population of the region.

    “Cancer has been spreading and is now affecting many people. The government must take responsibility as it brought oil explorers here,” Senator Godana Hargura said, adding the government should compensate residents for its lapse.

    Meanwhile, the Kenya Parliamentary Group(PPG) through their chairman Major Bashir, Mandera North MP has reacted to the news and their intention to summon Jirongo and demand for government’s reaction to the matter, “While the information been given out in the clip by Mr Jirongo is food for thought and further action, it however borders on criminality and needs to be investigated. He is a person of interest; we shall also demand detailed statements from the Government in due course.” Bashir says.

    “We call on the Government to order an immediate investigate by international experts. This is essential in in order to locate the sites, determine the nature the hazardous waste, and protect the environment and the residents from further damage. The Government should hold the companies involved
    responsible, including officials in Government, and compensate families of all those affected.” Billow Kerrow former Senator, Mandera County said.

    “Indeed this has been my suspicion for the the longest. This happened in late eighties & early nineties. I only succeeded in chasing them from Lagdera. The US Marines also wanted to drill boreholes in parts of Lagdera which in my opinion was suspicious. I told them we didn’t require their generosity & hastily left. I engaged UNEP in Gigiri at the time & weren’t helpful at all. I pleaded with UNEP to send experts with requisite gadgets to check for radioactivity in the sites in Wajir & Marsabit to no avail. It’s only fair now to constitute a Parliamentary Select Committee to get to the bottom of this saga.” Farah Maalim, MP Dadaab said.

    “It was 1988 if memory serves me well, when the company allegedly dumping toxic waste set up shop in Garissa and Wajir. They curiously named it Kenya Oil Service “prospecting” for oil. They recruited numerous local labourers who told tales of digging trenches where sealed containers were buried, the Cancer epidemic followed a little later. We need to get to the bottom of this matter. The people of the North need closure to this incident and tangible action on it’s devastating consequences in the region.” Mohammed Adow, Wajir South MP said.

    Ali Maalim, Mandera Deputy Governor reads a lot into Jirongo’s confession alluding he could merely be seeking attention, “Gravely concerning – Why is Jirongo coming out now – decades later? Or could it be a publicity stunt to seek some relevance?” He posed.

    “My documentary “Desert of Death” laid bare this huge scandal. Moi’s regime dumped nuclear waste in Nothern Kenya which has affected the region for decades; the water bodies are laced with carcinogenics. Downstream is Meru County which is also grappling with many cases of cancer let alone the meat we consume around the country.
    Cancer is a national crisis waiting to happen.
    Biwott died of cancer. His nuclear waste caught up with him.” Investigative journalist Dennis Onsarigo says.

    A prominent South Sudanese politician is among people being probed by the Ethics and Anti-Corruption Commission (EACC) over the alleged illegal payment of Sh250 million that has sucked in prominent Kenyans.

    Mr Albino Mathom Ayuel Abuog, 43, a member of the South Sudan National Legislative Assembly representing the Sudan People’s Liberation Movement was named as a recipient of part of money allegedly paid out to former Lugari MP Cyrus Jirongo by the Nairobi County government in 2020 in compensation for land that was in the custody of the government over Sh19.8 billion loan default.

    Mr Abuog could not be reached for comment even as other suspects were summoned to Integrity Centre, the EACC headquarters in Nairobi, for questioning on Friday.

    Several other suspects, including accounting officers at Nairobi County government, are scheduled to be interrogated by EACC detectives.

    Mr Abuog is reported to have received Sh38 million, the second largest amount of money from a payout reportedly made to Mr Jirongo as compensation for the land situated in Nairobi’s Mukuru Kwa Reuben slum.

    Investigators have not yet established why Mr Abuog, a former University of Nairobi student, who served as a diplomat in various African countries and is a member of the Pan African Parliament (PAP), received the money.

    The dual South Sudanese and American national was the chairman of the Pan African Youth Council and Youth Affairs ambassador to the Pan African Parliament.

    A former child soldier, Mr Abuog was an ambassador and presidential special envoy for South Sudan and a former advisor to Republic of Congo’s president Dennis Sassou Nguesso.

    Jirongo

    Mr Jirongo’s previous engagement in South Sudan has been controversial. In 2021, a firm associated with Jirongo, Yu sung Construction company, was involved in a court tussle with the South Sudanese government over Sh5.4 billion payment claim for the construction of Dr John Garang Military Academy and Natinga Warehouses.

    According to the EACC report, Sh60 million was wired to Cotu secretary-general Francis Atwoli, Sh25 million to Jubilee party vice-chairman David Murathe while former National Assembly speaker Kenneth Marende received Sh3 million.

    Mr Jirongo got Sh20.6 million while former Vihiga Senator George Khaniri received Sh5 million. “Immediately the funds were paid out by the county government, the money was shared and distributed through law firms to several entities,” says part of the preliminary investigation report that lists the alleged beneficiaries.

    Detectives have summoned Mr Jirongo, Mr Murathe and Mr Atwoli to clarify how the compensation was made to the former Lugari MP for public land on which several public institutions, including AEF Reuben Primary School, a health centre, a police station and a vocational centre sit.

    Investigations have so far established that AEF Reuben Primary School, run by African Education Fund and financed Mukuru Promotion Centre has been on the parcel of land since 1986.

    In 1998, Mukuru Promotion Centre surrendered the school to Nairobi City Council through the Ministry of Education.

    An investigation report revealed that in 1989, the then Maj-Gen Augustine Cheruiyot applied for and was allocated the parcel, which he then transferred to Kuza Farms and Allied Limited.

    Although Kuza Farms never developed nor occupied the land, it was used to secure Sh1.6 billion loan by Jirongo’s Sololo Outlets Limited from Post Bank Credit Limited.

    Sololo Ltd defaulted the loan leaving Post Bank Credit with the title until it went into liquidation and the then Deposit Protection Fund Board, currently Kenya Deposit Insurance Corporation (KDIC), took custody of the title.

    The loan balance has so far accumulated to Sh19.8 billion.

    In 2014, KUZA Farms & Allied Limited through their lawyers Wagara, Koyyoko & Company filed a suit ELC 507 of 2014 against the Boards of Directors of AEF Reuben Primary school, the Nairobi City County, the office of the Attorney General and the National Land Commission (NLC) seeking to have the school, police station, health centre and vocational centre demolished and compensation for trespass.

    The parties agreed on an out of court and a decree was entered on August 1, 2016. Nairobi county paid the money to Kuza despite the title being with KDIC.

    Former Lugari MP Cyrus Jirongo is known for being outspoken and never hesitates to speak his mind. Having made his fortune during Moi’s era, Jirongo who mentored DP William Ruto has grown to become one of his greatest critics, while DP has often chided his friend turned foe, Jirongo has never missed an opportunity to throw shades.

    During the burial of slain businessman Jacob Juma whose murder was largely speculated on DP having an hand in, Jirongo shocked the nation when he revealed that he once witnessed Ruto strangle a young man to death.

    In a latest interview with Daily Nation, Jirongo warned Kenyans against embracing the DP ahead of 2022 alluding that he’s dangerous for the prosperity.

    “I know Ruto inside out. He’s power hungry, he may plot to remove term limits. You can laugh at neighboring countries that people are being battered but it can happen here.”

    “In Kalenjin tradition, when you’re on the wrong you send elders to apologize for you. Ruto tried sending elders to Moi and the former President refused. What did he do that Moi defied Kalenjin elders? That’s a question you must ask yourself.”

    “Some of the things we know about Ruto can’t be printed. Raila, Uhuru, Mudavadi, Martha Karua and me can’t work with him. Ask yourself why. Ruto worked for me for 7 years. Find out why I kicked him out.” Jirongo said.

    In continuation of the interview, the father of many and husband to several and a boyfriend to several concubines, Jirongo doesn’t shy away from his lifestyle and revealed details. Below is an excerpt from the interview with Sunday Nation as he opened up on his personal life.

    A number of your friends say that your major undoing is that you splash money around and are generous to a fault, that you can have Sh10 million today and fail to afford a meal tomorrow. Is that so?

    What did I come with to this world? Why would I deny you to enjoy the extra that I have, that I want to hold it. When I came from my mother’s womb, I had nothing. It is through giving that you receive.

    Do not watch a friend go through pains and problems because you are hoarding for your children. That is how we end up with drunkards because that person is cursing. If you have, do with your whole heart, that is the whole purpose of living, service. That is what is interesting in life.

    When somebody tells you thank you, you feel very nice. That is the purpose of life, because you have served, because somebody appreciates what you have done. I believe that is what we must all do as human beings.

    Families of prominent leaders have been left in chaos either for lack of a will or leaving a contested one. Do you have a will for your family?

    My children are very good friends, they do not need a will. You see the way children grow, to understand somebody, you need to watch them in various instances. When they are alone, and they do not know you are watching. When they have money, when they are with their girlfriend, you tend to get a real feel of what your son, daughter is. I do believe they are good people because I have watched them grow, marry, earn money. I have seen how they behave with money and when they don’t have.

    That may change when you are not there, especially because they have different mothers.

    No, they will turn against that person who tries to poison their minds. I know them, they will turn against them very viciously.

    How many children do you have?

    (Laughs) Wanga, you know that we do not count children where we come from, you know it. We say we have many children, so I have many. They are several.

    How many wives do you have?

    That is also another topic on its own. They (children) come from several mothers but that does not make them not to be friends. They have grown up together, I have taken them to school together, there is nothing like this child belongs to this or that mother. It does not matter who their mother is, they all come from my house.

    There is a time they used to go to Makini School in a bus. I had a minibus for all my children, you must have had that story. All my children used that minibus. They do not know those stories about daddy’s girlfriends.

    Would you advise youth to have more than one wife?

    Most men have more than one partner. The only difference is some of us do not know how to hide. People have mistresses here and there and know how to hide. Personally, I do not hide because whatever the product, it is my product, so why should I hide? I talk to my wives and tell them, there is this boy, there is this girl, and he or she is a member of this family.

    The law allows polygamy. The law would not have allowed it if it was something bad. The law is just trying to remove you guys from where you are hiding because you all have mistresses. The law is just telling you, guys, do not bring us problems when you pass away, just do it, it is okay. Let the other members of the family know that she is not the only one. How I can advise a man? All of them are polygamous by nature.

    Don’t your wives have a problems with you bringing other children to their homes?

    Whether they take it well or not depends on the man. You have to put your foot down. You do not open that up for debate. When it comes to my children we do not discuss. Mtoto atakuja nyumbani (the child must come home). Otherwise, why are you a father? Why are you the leader of that home?

    You know in your case, you are a man of means so you can afford. It is…

    You are forgetting there was a time I slept in jail because I could not pay Bran Yongo 10 million shillings. People paid for me, including President Uhuru. Sometimes I have, sometimes I do not have because I do not have formal employment. I am businessman where today you make a profit and tomorrow you do not. Sometimes you have too much, other times you do not have, totally. They have also come to understand the dynamics of business.

    What are some of the dos and don’ts in polygamy?

    South Sudan suffers blow in Sh5.4bn dispute with Jirongo

    The government of South Sudan government has suffered a blow after the Court of Appeal in Kenya ordered that its bank accounts at NCBA and Stanbic be frozen in the wake of a legal battle with a company associated with the ex-Cabinet minister Cyrus Jirongo, which is demanding Sh5.4 billion for a construction work in Juba.

    The three bench judge on Thursday restored freezing orders on the accounts after YU Sung Construction Company successfully appealed on an initial ruling by the High Court that allowed South Sudan government to partially operate the two accounts but reserve the disputed Sh5.4 billion.

    Yu Sung was represented by lawyer Ken Kiplagat who argued that the High Court ruling was in conflict with orders in the dispute which would render the outcome of the suit null.

    “The honourable Judges of the High Court have issued conflicting orders which conduct by Judges of concurrent jurisdiction points to a collapse of due process and administrative order in the Judiciary to the grave detriment of the Applicant herein who stands to suffer a miscarriage of justice,” Kiplagat said.

    Jirongo’s lawyer also faulted the Attorney-General of South Sudan for failing to provide any security for the satisfaction of the consent issued against Juba at the East African Court of Justice, in favour of his client’s firm.

    The freezing orders on the accounts were granted in December but have been extended from time to time by different judges until February 2021 when Justice Said Chitembwe reversed them after South Sudan complained that the freeze was hurting some government functions.

    Justice Chitembwe lifted the orders after he was persuaded that the government of South Sudan could not meet some of its obligations including paying of staff salaries.

    But after hearing the case, justices Daniel Musinga, Patrick Kiage and Gatembu Kairu of the appellate court ordered status quo to be maintained which means that South Sudan cannot withdraw money from the accounts until all the pending cases are heard and determined.

    South Sudan gets partial access of accounts as row with Jirongo intensifies

    A Kenyan court has allowed South Sudan authorities to partially access their bank accounts at NCBA and Stanbic bank amidst a legal battle with a firm belonging to ex- Cabinet minister Cyrus Jirongo who is demanding more than Sh5 billion form Salva Kiir’s administration.

    The move comes after South Sudan challenged a decision to freeze the accounts which they protested as a declaration of war by Kenya since it would hinder delivery of services unable to it’s population.

    The court has now allowed them to operate the accounts on condition that they leave a balance not less than Sh5.4 billion as Yusung Construction continues to appeal the order that lifted the a complete freeze on the accounts.

    Jirongo’s firm won the deal to construct John Garang Military Academy and Natinga Warehouses in 2008 but later fell out with the government of Salva Kiir following a contract breach pushing the ex-minister to rush to court.

    The freezing order was granted last December but has been extended by different judges until Justice Said Chitembwe lifted the order in favour of South Sudan authorities on February 26 since the government could not meet some its obligations.

    Judge Chitembwe allowed South Sudan to operate the bank accounts held at NCBA and Stanbic Bank freely pushing Jirongo’s firm to challenge the move where Justice Joseph Sergon granted Juba partial access to the accounts.

    The court was told that South Sudan paid Yusung Construction Sh2.6 billion to begin the works but nothing was done after the foundation was laid down till two years ago when Jirongo’s firm moved to the East African Court demanding Sh5.4 billion as sums due with interest.

    Yusung Construction had complained that they were forced to move construction to different sites four times due to violence in the war-torn country with some areas also proving prone to flooding.

    The case was the forgotten till November last year when the firm reached an out of court deal after one Biong Pieng Kuol Arop, an official of South Sudan’s Finance and Planning ministry committed to have Jirongo paid the claimed Sh5.4 billion.

    The deal gave Yusung Construction permission to attach South Sudan’s assets to recover the sums in case of a default but it is that deal that has now seen South Sudan’s accounts in  Kenyan banks frozen with Juba now claiming that Mr Arop did not have the authority to negotiate deals on its behalf.

    Juba administration is also accusing Jirongo of using fraudulent means to obtain the out-of-court settlement which it later used it to dupe Milimani High Court into freezing their two accounts.

    Authorities in South Sudan have suddenly agreed to pay a company associated with the former Lugari Mp Cyrus Jirongo Sh4.9 billion after a case was heard and determined in Arusha, Tanzania.

    The company associated with the controversial politician was hired to construct South Sudan People’s Liberation Army but the debt had delayed for over ten years.

    The works to build Dr John Garang Memorial Military Academy, 4 warehouses and fuel depots kicked off in 2007 and were completed in 2011 with a pending debt of US$18.6 million but the interests have since accumulated to US$49.3 million (Sh4.9billion).

    Jirongo who has been making news of going broke was represented by MS Semuyaba, Iga Advocates from Kampala along with Lumumba and Lumumba Advocates from Kenya.

    A Chinese firm Yu Sung Construction Limited was also part of the team that had dragged the government of South Sudan to the Arusha based court in November 2019 to pay the decade long debt.

    “We have a pleasure to kindly request your honorable court to file a consent order of the payment of US $49,398,473.91 in four installments,” read part of the demand.

    But SPLA terminated the contract with Yu Sung in September 2011, just two months after South Sudan became a nation when the debt still stood at USD 18,609,595 after attracting an interest of USD2,791,439 per annum.

    Lead lawyers were persuading presiding Justice Munica Mugeyi who issued conservatory orders to freeze and settle the debt where money would be put in a winning account until the case is determined.

    Munica’s orders affected more than 20 crude oil cargos from the South Sudan, construction of Natinga Warehouses and Dr Garang Memorial Military Academy.

    This was after South Sudan changed the construction sites claiming that locals had staged demos to protest the works.

    “The SPLA authorities chose Kurmork, which unfortunately proved to be prone to flooding after foundations had been laid and some buildings already at an advanced stage, according to the submission.

    “The project owners chose a third site in Mangalla country near Juba-Bor Highway which also came to be prone to flooding of the Nile and the project was moved to Suleng, 75 kilometres away in the northeast of the capital Juba”.

    A meeting chaired by Brig General Abuol Deng and Brig Gen James Hakim Elia held in 2011 wanted the contract to be reviewed but the idea was later rubbished and Yu Sung while South Sudan still owed them more than US$ 18 million.

    By September 2020 debt had accumulated to over US$49.3 million by and the South Sudan government acknowledged the fact that the ministry of Defence and Veterans Affairs entered into contracts with Yu Sung on different dates for construction of facilities, which were later defaulted.

    “Recognising the fact that the failure and default of the respondent to uphold the contractual obligations it signed with the applicant may complicate the matter much more should the court’s proceedings be the only option left to the parties to follow,” Athian Ding Athian wrote.

    Mr. Athian who is the minister for Finance and Planning of South Sudan made the commitment on the payment to Jirongo in a letter dated 26 November 2020.

    Complicated Relationship, Cyrus Jirongo Goes Back To Bed With William Ruto

    Joined at the hip, the YK92 housemates don’t seem to move far away from each other. Following public spat, by Cyrus Jirongo and Ruto, their relationship was seen to have hit final nail beyond mending. However, in politics, there are no permanent enemies just different interests. Jirongo blamed Ruto for being behind the assassination of Jacob Juma. During the funeral, Jirongo unleashed secrets of how the DP strangled a young man to death and also revealed that the slain businessman had at one point slapped Ruto after a disagreement.

    Jirongo went on extreme media attack on Ruto who laughed him off for being jealous of his success. Jirongo’s media frenzy was deflated following the fatal shooting of his son in law in what he claims was a warning shot to his life after his public onslaught.

    Jirongo boasts of vast business empire and prides for having made it to the list of billionaires by the age of 30. Jirongo attained sustainable power and influence during the Nyayo era following his support for Moi’sMoi’s re-election and leading the youths in the course.

    However, Jirongo has been facing liquidity challenges since he was thrown into opposition. The former Lugari MP has been jumping from the courtroom to the next battling auctioneers a clear sign that his financial crisis is a reality. Things got even worse when his long-term friend and wheeler-dealer in the city Brian Yong’o wanted Jirongo to be declared bankrupt over a Sh25M debt that he failed to pay. COTU chairman also accused Jirongo of defaulting a small debt of Sh100M.

    Faced with financial and political relevance crisis, Jirongo has been forced to swallow his choking pride to make peace with Ruto who now not only enjoys power privileges but is an unchallenged figure in the big deals in The system. Kenya Insights has learned that the two are back and working together in the background.

    Jirongo has been held at the mercies of Jubilee like in the instance of the controversial 1,000 acres in Nairobi’s Ruai area which could not have been registered in another name since it had been used to acquire money from Post Bank Credit then headed by Francis Chahonyo. According to CBK sources, Jirongo’s 1,000-acre plot in Ruai Estate (Land Ref: No. 12973/3) was to be sold to recover Sh20 billion he took from Post Bank Credit but when he got the wind, he rushed to court and got an injunction just two days before auctioneers were due to put the land up for sale. The vast land is said to be valued over Sh7 billion.

    The CBK had planned to auction the land to recover money that collapsed Post Bank Credit lent Sololo Outlets, a company owned by Jirongo. The orders stopped and restrained Kenya Deposit Insurance Corporation from selling the land pending the hearing and determination of the application.
    Sololo had defaulted on the loan, which was extended to it for the construction of residential estates that were to be sold to the National Social Security Fund.

    The NSSF had an agreement with Sololo to buy an incomplete housing project in Nairobi’s South B Hazina Estate. Jirongo had used the Ruai land owned by another of his companies, Offshore Trading, to guarantee the loan. Jirongo claimed the loan had 26 guarantors with the principal guarantor being Cyrot Limited. Others are Davy Koech, Kuza Farms and Allied Limited, Kipa and Sons and Cyper Enterprises.
    Jirongo’s deal with the NSSF did not have a happy ending after he raised the price of the estate to Sh2.65 billion in May 1993 from an initial Sh1.2 billion, citing a jump in material costs. The NSSF terminated the contract, having paid Sh900 million and hired a different contractor to finish the work. The estate consisted of 420 homes, a school, and a shopping center.

    Post Bank Credit was one of the banks involved in the infamous Goldenberg scandal which brought several banks to their knees during the Moi era when Jirongo was an influential political figure at the time after he led YK92 to campaign for Daniel Moi. In 2011, Jirongo was paid Sh490 million by the NSSF as an out-of-court settlement for a Sh4.5 billion claim for breach of contract relating to the estate transaction. Jirongo had disclosed that he had planned to sell the Ruai land in order to settle a Sh32 million debt owed to Emris Investments in another land row. Emris had gone to court after Jirongo failed to honour a commitment to pay the cash.

    At one time, Jirongo had to fight to retain ownership of the1,000 acre Ruai land after a group of squatters laid claim to the property. A group of squatters under Ruai Embakasi Youth United Development Organisation (Reyuda) wanted the High Court to nullify Jirongo’s title deed and declare it the valid owner of the massive tract of land. The squatters claimed that they have occupied the land since 1993 and wanted themselves declared its valid owners.
    With DP offsetting the debt he owes Jirongo, the former Lugari MP’s presence is being felt in both political and business circles.
    The newfound relationship between Ruto and Jirongo is aimed at striking business and political deals. On the political front, Jirongo is to checkmate Musalia Mudavadi in Western politics. This comes at a time when Raila has been named the NASA presidential candidate and language of voter apathy emerging.

    Kenya Insights has learned that Jirongo has been charged with igniting a voter apathy in the Luhya community capitalizing on the ‘shortchanging’ of Luhyas in the NASA deal. It didn’t come as a shocker that Jirongo rose from the dead to surface in the media the same day NASA deal was made public.

    Jirongo who was never a party in NASA and the presidential candidate selection process suddenly had a voice on the topic. From our source, Jirongo is scheduled to hold ‘protest’ rallies across the Western region in a bid to incite locals against NASA and subsequently rejecting Raila presidency.

    The plot has been steady including fabricated media stories to paint a circus scenario and discontent in the Western region. Another source in Luanda revealed to us how NIS officials in conspiracy with the media offered bribes to locals in Luanda market to give dismissive remarks on Raila candidature. Media houses, K24 and Citizen News, aired the clips. Capital News ran a story how a huge protest was held in Kakamega against NASA line-up while on the ground there was no such an activity. The media has been infiltrated with propaganda agents.

    Jirongo is posed to run for the presidency under his party UDM. Even though his bid would not make a worthy effect, he sure will have played a role in yanking votes from NASA in Luhya by capitalizing on voter apathy. For the favors to keep coming and Jirongo to stay afloat without distinction, he has no alternative but be the puppet for Ruto.

    Jirongo is a cunning political animal who at day time talks ill of Ruto but at night, he dines and wines with him. In Ruto’s bag of puppets is one Kenneth Marende who is set to be vying in Nairobi Governorship though it has remained a mere speculation. We learn that Marende who’s role is to divide the Luhya vote in Nairobi to trounce Kidero, is yet to make up his mind since Ruto is yet to fully fulfil his part and release finances. Marende, Jirongo as Ruto have been doing businesses at KPLC where the former speaker is Board Chair. Jirongo is particularly blaming Raila for his financial crippling who he says sealed off his business deals in Tanzania.
