JSC’s Tom Ojienda 378M Tax Fraud Claims By KRA Unmasks Irregularities With The Tax Collector

    By Mark Karisa

City Lawyer Tom Ojienda is putting up a fight to block Kenya Revenue Authority from recovering Sh443 million in alleged tax arrears.

On October 5, Ojiambo obtained temporary orders barring KRA from taking any action against him until a suit he filed is concluded. Ojienda has accused the taxman of unfairness.

KRA, in a letter dated June 7, demanded payment of Sh443,631,900 from Ojienda as total tax due to it for 2009-16. But the lawyer says the claim is illegal, and he should not be made to pay. In court documents, Ojienda says KRA has summed with all the money he has received since 2009, including unpaid bills, his clients’ money, proceeds from personal accounts to which he was paid salaries and other allowances, and treated it as his net taxable income.

He accuses the taxman of unlawfully subjecting his four bank accounts, three held at Barclays and one at Standard Chartered Bank to taxation, which, he says, is in violation of his fundamental rights. Stating that he receives and keep clients’ money as a statutory obligation and that money cannot be subjected to taxation as the taxman wanted.

He said it is unfair and unreasonable for KRA to seek claims on sums banked at his personal account. Ojienda says it is unfair that he is required to provide communication and documents between him and his clients, which were covered by advocate-client privilege.

He says it was wrong for KRA to issue an amended assessment dated September 5, purporting to assess a total of Sh378 million as tax dues and payable for 2011-16, without giving him a chance to be heard.

The battle has been marred with tribal bias class between Ojienda and James Mburu, a deputy commissioner of KRA who swore an affidavit against him. Ojienda claims the pursuit is dishonest and full of malice. Mburu in his affidavit says a payroll that Ojienda never deducted and remitted his employees’ income tax as required by law.

Dr. Robert Ayisi, the Nairobi County Secretary, who claims to have been frog-marched by KRA officers. Ayisi was arrested allegedly for declining to reveal crucial information to KRA on the payments made by the county to Ojienda and his law firm. He has since sued for harassment and humiliation, following his arrest and brief detention at the Times Tower.

The matter if tax fraud has hit several media publications even though the case is yet to be determined by the courts, KRA seems to have won the public court with sympathy seeking innuendos. While tax evasion is a severe economic crime, the judicial procedures must be respected and trusted in carrying out their mandate and give the breakthrough in this standoff between the law professor and the taxman before the public lynching. The imminent violation of individual space in the name of sniffing by the taxman shouldn’t be excused either but instead should adhere to the set ethical standards.

The case between Ojienda and KRA is still before the court shouldn’t be discussed in details to the media as it could incite unreal opinion and perception. Respecting the judicial components in serving fair judgement should not be tampered with. KRA need to through legal in addressing this stand off and do so by respecting the law.

Reprieve To Eastleigh Hawkers As Court Moves To Bar The Land Grabbers, Alfa Traders From The Piece

It comes as good news that the Nairobi County has been stopped from selling the Sh500 million Eastleigh Public Market to the Alfa Traders who have been putting up a mall despite several court orders that they disregarded.

The Environment and Lands Courts division judge, Mr. Justice Samson Okong’o, who stopped the sale heard that the livelihood of over 400 traders is at risk.

The judge temporarily stopped the transferring of the market land to two businessmen Mr. Farah Mohammed Barrow and Mr. Ali Sheikh Mohamud trading as Alfa Traders or third parties.

Justice Okong’o barred the Nairobi County Government and Alfa Traders from transferring, selling, charging, leasing, dealing, removing from, excavating, damaging or developing the property on which the market is built.

On realizing loopholes and uncertainty on their land lease which the Ombudsman investigations determined to have been irregularly acquired and the NLC revoked, the Alfa Traders hatched a secret plot to sell units to third parties as a security measure. The alleged lease was canceled in 2009.

The court is being asked to “declare it as public land.” Meanwhile, the recently released Ombudsman report said the land a public utility as it has been listed since time. Kenya Insights for those who’ve been following updates have closed head and in this case that broadcasted absolute impunity with complete disregard to law.

Endless court orders and NLC blanket cessation orders have all been ignored, and the dubious developers went ahead with construction under police surveillance. The hawkers can only wish the court won’t relent and loosen the knot. Cases of public land grabbing have been on the rise in Eastleigh with wealthy businessmen taking advantage of the corrupt systems in the County Government and NLC to grab few remaining public spaces. We will be following keenly to see how things turn out to be. Next hearing is December 19, 2016.

Revealed: List Of The Banks Involved In NYS Fraud

It turns out the Sh.1.6B being floated as the amount lost in the NYS heist is just but assumed amount and the real figure stolen could be in more billions. This follows fresh revelations by PAC that more than 70% of Kenyan banks handled the NYS loot with up to 30 banks named contradicting the initial 18 number reported.
Members of the House team said they received information from the Devolution ministry that the banks have handled the cash since 2013.

PAC said it needs to question the companies and banks to establish if any impropriety was committed in their transactions.

The additional banks named Tuesday are:

    • Equity Bank
    • Diamond Trust Bank
    • Cooperative Bank
    • Consolidated Bank
    • First Community Bank
    • Bank of Baroda
    • African Banking Corporation
    • I&M Bank
    • Paramount Bank
    • Chase Bank
    • Bank of Africa
    • Transnational Bank
    • Housing Finance
    • Giro Bank
    • Gulf African Bank
    • Commercial Bank of Africa
    • Ecobank
    • Fidelity Bank
    • CFC Stanbic.

    Initially, the banks named included;

    • Standard Chartered
    • Sidian Bank
    • Guaranty Trust Bank
    • Barclays Bank
    • Kenya Commercial Bank
    • National Bank of Kenya
    • NIC
    • Jamii Bora
    • Old Mutual
    • Faulu
    • Family Bank.

Family Bank has been named as the primary recipient of the mega loot which was then transferred to individual accounts in other commercial banks. They were fined 1M alongside other two banks for failing to report the suspicious bulk transactions. Central Bank in latest update has given the go-ahead to the DCI and ODPP to institute investigations on the then CEO Munyiri over criminal involvement in the looting.

Banks as a regulation, are required to report to the Financial Reporting Centre (FRC) on transactions above 1M as a measure to curb money laundering. Most of the banks that handled the NYS money failed to report ending up aiding the robbery. As a measure of consumer confidence at a time when rogue bankers are putting consumers holding their hearts by the sleeves, action must be taken especially criminal charges on banks that permit illegal transactions as of this magnitude.

Ombudsman: NGO Coordination Board CEO Mahamed Fazul Forged His Academic Credentials And Was Hired Irregularly

The Ombudsman has recommended to the Devolution Cabinet Secretary and Head of Public Service to remove from office the Executive Director of the NGOs Coordination Board Mr. Yusuf Mahamed Fazul. An investigation by the Commission on Administrative Justice has found Fazul unsuitable to hold public office for abuse of power and misconduct. The Ombudsman has further established that Fazul was irregularly appointed as he did not have the requisite qualifications.

CAJ embarked on investigations following complaints that the CEO was underqualified and engaged in gross misconduct of office including misuse of funds, unprocedural procurement processes, irregular appointments and transfer of staff, threatening staff members who raised a finger on his qualifications.

CAJ determined that his 2014 appointment to the post was irregularly made since he didn’t hold a degree. Fazul was discontinued from the Egerton Uni for failure to satisfy the academic standards of the course he was pursuing, Bachelor of Science in biochemistry.

During his interview, Fazul presented forged papers indicating he had a degree from the sane college he was discontinued from. In an attempt to cover up, Fazul withdrew his personal file from the custodian (Human Resources Manager) and removed his records.

The investigations have also determined, Fazul operated with absolute impunity and uncontrollable misuse of funds on unapproved foreign trips, irregular promotions, and transfers of staff. As an authoritarian, he’s been a horror to the employees who ever questions his decisions and most have been pushed to resignation out of frustration.

The Ombudsman has recommended for the CS to fire Fazul over gross misconduct and abuse of office immediately. He’s currently on suspension given to him by Kiunjuri. In respect to irregular promotions, he promoted an officer who was hired as an executive secretary in 2009 through various ranks, some of which do not exist in the organization’s organogram,” it says.

“The said officer now holds the position of guidance and operations manager and acting deputy executive director,” the report explains. CAJ is also praying for the DCI to institute investigations against Fazul over forgery of documents.

Ombudsman also wants Fazul to return to state amount totaling to 8.5M that he has unlawfully earned as net salary in his tenure.

  • Sex Between Cousins Not Considered Incest Under Kenyan Law, Court Rules

Sex Between Cousins Not Considered Incest Under Kenyan Law, Court Rules

It is not illegal for cousins to marry or engage in sex, the High Court has ruled even though relationships between cousins are acceptable in some communities and taboo in others.

High Court judge James Makau, in an appeal where a man was contesting a conviction of alleged incest with a cousin by the Magistrates Court, found that the Sexual Offences Act does not mention cousin among the list of relatives under the offence of incest.

Justice Makau ruled that the National Assembly did not leave out the clause on cousins by intention but by the fact that in some cultures in Kenya – such as Hindus and Muslims – and some African communities, sexual acts between cousins are not criminalised.

“This means it is permissible to have sex with a cousin,” the judge ruled. “My understanding of the said section (Section 20(1) of the Sexual Offences Act) is that if any sexual act takes place between two cousins, that does not amount to incest within the meaning of the provisions of the Sexual Offences Act.”

The accused person, named in the court’s verdict as WOO, was arrested and subsequently charged in 2014 for allegedly engaging in sex with a 16-year-old girl knowing that she was his cousin.

He denied the claims and the case went to full hearing after which the lower court found him guilty of incest and slapped him with 10 years in prison.

    LOWER COURT

The man appealed on account that the lower court did not consider that the girl never testified that he defiled her and did not elaborate on how they were related.

According to court records, the man had told the girl to accompany him to his house at 3pm on April 9, 2014, and she agreed and even prepared a meal for him.

Her mother found her in the house and the result was the criminal case.

The girl’s mother testified that the accused was the girl’s paternal cousin but the court found that the trial court erred in finding that he was guilty of incest.

Makau found that the prosecution had failed to prove that the offence lay under prohibited relationships as provided for by law.

“I find that it was an error in law for the trial court to have imported the relationship of a cousin and included it within the provisions of the law when that relationship was not among the specified relationships to be considered in determining a case of incest,” the judge ruled.

The judge ordered the man’s release.

No Sex Unless You Vote For Uhuru, Shebesh Warns Men

Married men may be in for a rough stretch unless they accord political support to the incumbent, President Uhuru, and female candidates. This comes after Ruiru MP Esther Gathogo told wives to deny their spouse’s conjugal rights if they do not support Jubilee and women in the 2017 election her sentiments echoed by Nairobi woman rep, Rachel Shebesh.

Addressing a meeting in Thika, the legislator said women should use sex as a weapon to coerce men to vote for Uhuru and female candidates in various positions during the 2017 polls. “This time we should be bold and tell our men enough is enough. If they refuse to support Uhuru and women leadership then deny them sexual favors,” she said amid cheers from hundreds of women attending the meeting at CCM Makongeni Church hall.

The event, organized by a caucus of Jubilee female legislators dubbed ‘Women for Women’, was to drum up support for Thika Town MP Alice Ng’ang’a. It was attended by at least 16 MPs led by Deputy Leader of Majority in the National Assembly Naomi Shaaban and Nairobi Women’s Representative Rachel Shebesh.

It’s rather unfortunate that in this age and era sex is still being used as a manipulation tool and coming from rather privileged legislators we’re left with stretched jaws.

Attempted Attack on U.S. Embassy In Nairobi A Confirmation ISIS Is Stamping Terror Authority In Kenya

The moment the news hit the airwaves that unsuccessful terror attack was attempted at the Nairobi’s U.S. Embassy, knew there was A subliminal message being sent by A terror group. True to the word, it has emerged the killed terrorist was a follower of Islamic State responsible for an attack last week on a Kenyan police officer outside a U.S. embassy in Nairobi, the group’s Amaq news agency said on Saturday.

The knife-wielding man whom police described as a criminal was shot dead outside the U.S. Embassy in Nairobi last Thursday after he attacked and injured a Kenyan police officer.

“The person who carried out the stabbing of a guard outside the American embassy in Nairobi last Thursday was a soldier of Islamic State responding to calls to target coalition countries,” Amaq said.

Islamic State previously claimed an attack in Kenya in September by three women who were shot dead after they tricked their way into a police station in Mombasa and tried to torch the building, according to police. The police in Kenya have also previously said they had detained sympathizers with the group.

But experts say it is not clear how close the connection is between groups and individuals proclaiming allegiance to the Islamist group and the Islamic State organization in its Middle East heartland of Syria and Iraq, where it is increasing pressure from regional and international forces.

The ISIS has been on a recruitment overdrive worldwide with intentions of spreading their wings beyond the Middle East that has been their root. ISIS is one of the most brutal and senseless terror groups in history, so gruesome that world’s most feared terror organization Al-Qaeda denounced and called them out on the severe terror they’ve been reigning.

Locally, Al-Shabaab has been the sole terror group that has been on the prowl in destabilizing Kenya’s security. With ISIS coming in, the enemies have replicated, and rivalry between two groups could lead to more penis measuring attacks. The Kenyan security agencies should, therefore, heighten surveillance around the clock.

No More Taking of Alcohol At Popular Space Lounge, Nairobi

The Space Lounge has been in the middle of court battles and scores settling following complaints from the Kilimani Project Foundation on behalf of residents who asked for the closure of the club following complaints of too much noise coming from the club.

The Club, a favorite spot with middle age revelers along Ngong Rd, had its license previously revoked by the County Gov but later resumed operations on conditions they’ll adhere to set sound standards. However, the Kilimani Foundation went ahead further to open afresh complaints with the County Gov that the house hasn’t subsided and the nearby residents were being denied sleep.

The latest obstacle is from the Liquor Licencing Board of the County Gov that has declined the request of the club meaning the club is barred from selling alcohol within the premise and doing so is contrary to the regulations. Whether the proprietor is going to honor this directive is another thing. We’ve also heard of personal differences between the parties involved with the Kilimani Project leadership said to be having the personal vendetta with the Club’s Proprietor and relentlessly pushing for its closure, but that’s a story for another day.

LEAKED: Plans Of An HIV-Infected Man In Eldoret On A Revenge Mission To Infect People’s Wives To Spread Virus, Targets 200

Screenshots of an HIV-Infected person who confided to his friend for being on a revenge mission to infect as many families as possible has surfaced online.

In what looks like a friendly conversation, the man whom we’ve identified with his Facebook names as Francis Frank, doesn’t hide the fact that he’s infected with the virus but vows not to go down the grave alone. Frank, says he’s on a mission to infect as many people with the virus with his mission targeting wives of others, in his thinking, this will broaden the virus network to more people around.

    Its criminal to intentionally sleep without protection knowing you’re infected with the virus without informing the partner. Exposing one to the virus is punishable. Therefore this beast needs to be for the next ride to jail and must pay for the heinous act. Again the social media is going to play a significant role in serving justice and eliminating dimwits and evil kinds as this. Find screenshots below;

  • A Terrorist or Another Case of Investor Being Scared Away, Story Hassan Babakar Osman, Saudi’s Prince Protege

A Terrorist or Another Case of Investor Being Scared Away, Story Hassan Babakar Osman, Saudi’s Prince Protege

A Sudan , Khartoum-born, Osman a powerful businessman and recently married in Kenya where he’s been living for 20 years to one Sophia Roba and influential figure, fled the country following sharp differences with President Bashir since they contradicted in ideologies as Mwalim Brotherhood and terror that the President reigned on his opponents which later landed him and still a wanted man by the ICC for crimes on humanity including mass murder.

Osman is said to have fled to Dubai then Rwanda and lastly Saudi Arabia where he made powerful business networks including with the Royal family where he worked for Prince Abdul Aziz, became his confidant and later sent him to Kenya as his agent on the Galana project that he was investing in.

The prince appointed Mr. Hassan Babakar Osman, to be his local agent and charged him to prepare a memorandum of articles of association in 2010 with the objective of setting up an agricultural investment in Kenya, partly financed by the Saudi Government.

This was in line with a presidential initiative “calling for international businessmen to invest in food security by offering them land.”

The King was leased 100,000 acres from the Agriculture Development Corporation (ADC) on the property known as Galana Ranch/Block 1/1 situated in Kilifi County for 16 years under a renewable contract.

However, along with the way, things turned the other way with the Prince suing Kenya and accusing his local partners (foreign investors required to partner with locals in managerial posts) tried or rather schemed to fraud him if his shares in the company that was formed under Osman’s signature.

Prince claimed that through forged documentation, his majority shareholding of 900 out of 1,000 shares of the Arafco Agriculture Integration Company Ltd was fraudulently transferred without his consent to local directors under the name Milestone Developers Ltd as majority shareholder.

The local businessmen the Prince listed as his partners were Mr. Mohammed Koriow Nur, Mr. Mohammedulamin Mohamud and Mr. Mohammed Hirei Bare Ahmed who had six per cent, three per cent, and one per cent shares respectively. In an affidavit, the Saudi Prince informed the government that his partners were frustrating his protege Osman and fabricating crimes to see him overthrown.

Hassan Babakar Osman was recently arrested by ATPU at his Muthaiga home and accused of facilitating the recruitment of youth to join terrorist groups. The Anti-Terrorism Police Unit informed the Milimani senior resident magistrate Helen Onkwani that they need more time for investigations to ascertain he’s a local ISIL agent

The court was informed that the suspect was also forged a letter of attorney purporting to have been vested powers by the Prince of Saudi Arabia to transact business in Kenya on his behalf.

    HRH Sultan and Hassan Babakar
    HRH Sultan and Hassan Babakar

The prosecution further said that Osman is wanted by the Saudi Arabian government for the purpose of instituting charges of using the said forged letter of attorney to swindle money from the public.

The court papers stated that intelligence reports so far received by investigators indicated that the suspect is an associate of unknown ISIS and ISIL recruiters in and outside the country.

However, the intrigues in the case baffles, on Tuesday, Kenya Insights learn that a senior Jubilee politician from Garissa County called the magistrate blocking the release of the investor Hassan Osman. The same politician called the suspect’s lawyer Cliff to abstain from representing the investor. In the mean time, the investor has continued to be confined at Muthaiga police station. The investor has been arrested on several occasion and released with out charge. The investor is now under incarceration and medical and health complication where he has been denied access to the even government hospital for treatment.

Hassan was once arrested at JKIA over accusations of owning a fake passport which was then verified by the Somalia government, and he was released. Today amongst charges he’s being held with includes possession of a fake Somalia Passport.

Hassan’s project that he initiated on behalf of Saudi Prince would create employment over 4000 Kenyans generate foreign currency on the portion of sugar that will be exported to Saudi Arabia as per the terms of investments he was in the process if bringing in the Prince of Saudi Arabia to invest 150 million dollars to upgrade Kenya Meat Commission and the P.S. the MD and the board of KMC were going to finalise with the prince on a special visit to Saudi Arabia which had been finalised this would have up graded the Athi River KMC and MSA KMC to the status of European standards and cope with the high demand of meat supply to Saudi Arabia and the Arab world to approximate cover up to 70 % demand helping the pastoralist and generate more foreign currency it is wrong to do this to an investor who trusted Kenyans gave them 10% shares in return forged for 100 % shares total shame.

While the benefits that the investment was to come with remain constant, the bulk of case remains with the ATPU to prove that the investor has links with ISIL and if found guilty then should be prosecuted with the same. Kenya being Kenya, dirty play can neither be over ruled in this field since rivals are often at alert to fabricate and with malice accuse one of none existent crimes and using their positions and connections within power circles to frustrate rivals.

If that were that case in Hassan’s, it would be an unfortunate trend, and a scare alarm to investors was looking into pumping their money into Kenya. The case needs to be followed with keen interest especially up from the President’s office who should shield investors from monkey dealers in town at the same time being vigil with terror motives. It’s a catch two. If determined that Hassan has no terror links then the interest parties too need to be brought to justice for frustrating investors.

  • Radio Queen Adelle Onyango Ropes In Kenyan and South African Stars On Her Breast Cancer Awareness Campaign

Radio Queen Adelle Onyango Ropes In Kenyan and South African Stars On Her Breast Cancer Awareness Campaign

“To honour my mum I got a bunch of celebrities from Kenya and South Africa to share messages of hope around breast cancer.”

NAIROBI, October 17, 2016 – Top radio presenter and social activist Adelle Onyango has roped in celebrities from Kenya and South Africa for a social media campaign on breast cancer.

Adelle says it took her a “little over a week. Just to reach out to different personalities and now the collection continues as we roll out the different messages,” adding, “I want survivors to know that we celebrate them, breast cancer patients and family members to know we recognize their battle and are with them in strength and prayer, and for men and women to know the importance of self breast exams and regular medical check ups!”

Some of the celebrities who have lent their voices to the campaign include TV news anchor Janet Mbugua, rapper Shaq The Yungin, Israeli – Kenyan act Gilad, DJ Mikey, actress Brenda Wairimu, singer Angela Mwandanda, rap queen Femi One and South African star Nandi Tshabalala.

Commenting about the messages sent out by the various celebrities, Adelle said the one that caught her off guard and made her emotionally was by Janet Mbugua.

“Janet knew my late mum and when I played her audio she speaks about my mum, about how strong my mum was and it really just brought tears to my eyes. My mum passed way from breast cancer her anniversary of her death was on March 31,” the Kiss FM breakfast show host said. “We got listeners texting us about their loved ones battling breast cancer and how alone they’d felt until we spoke about it! Also to see male listeners find out for the first time that they too can get breast cancer. Knowledge is power!” To honour her mother’s experiences and life, Adelle and her sisters are very conscious about breast cancer. “Well for us, being that our risk is higher we are conscious about early detection all year long,” Adelle said, “When my mum was alive we would go for the breast cancer walks she would organize. It’s been hard for us to do that stuff without her around because it makes it more apparent that she’s not here. Personally I think this is the most vocal I’ve gotten since she passed away I hope that means I’m getting stronger!”

So, is there enough been done for breast cancer? “More can be done. Cancer is such an expensive disease to treat! And without the treatment it just spreads. We need to subsidize these costs. And also in rural areas, arm people with knowledge. Many seek treatment when the cancer is on its late stages because they misdiagnosed the symptoms at the beginning and wasted time. Also as an individual what type of lifestyle are you living? Some risk factors are controllable, like healthier diets (less fats), not smoking, less drinking, more exercise!” Adelle said.

  • Deplorable; Kenya Airways Paying International Flight Attendants As Low As Sh35K Salary

Deplorable; Kenya Airways Paying International Flight Attendants As Low As Sh35K Salary

The national carrier that has turned from a pride of Africa to being a shame continue to get hammered despite their PR exercise to sanitize the filthy profile. Genuine worries that Kenya Airways is at the brink of total collapse given massive losses they continue to make.

An audit report conducted by Deloitte reveals from the ticketing, fuel and accounting to the baggage and cargo departments; the audit trail tells a story of plunder and theft. Most of the KQ ticket prices filed in its system were below the minimum seat cost as per its finance records. KQ issued more than 7 million seats between 2012 and last year at below price, resulting in a loss of $611.6M.

The auditors in the report, accuse the KQ management of allowing its staff to void, refund and reissue tickets, causing a revenue loss of $12 million.

With Kenya Airways in financial distress, it turned to Dubai Bank, at the time a crumbling financial institution that would later go under, for help. On August 18, 2014, the board approved Dubai Bank as one of the banks that KQ could obtain facilities from to a maximum of $5 million.

The auditors also found two repatriation transactions (one for ZAR3 million and one for AED2 million) in respect of which no payment had been received from Dubai Bank into a KQ Central Bank account. The total value of these transactions was $700,000, with two employees in the finance department found culpable. A loss of $5.2 million was recorded by the airline from these dubious transactions with Dubai Bank.

The scheme was so intricate that Baghel Deeraj of Dubai Bank operated a fake email address with Bank of Africa when he wasn’t a staff member of the West Africa-based lender.

As KQ woes continue to pile, internally the workers are subjected to the hostile environment. According to documents in Kenya Insights hold, staff members are disgruntled. A good number have downed their tools leading to several flights being canceled.

Workers are protesting in what they term as exploitation by Career Directions Limited (CDL), Insights Management, Strami and Trade Winds Aviation staff.

KQ outsourced recruitment to CDL also made arrangements with the mentioned companies in what seems like a bid to continue exploiting the workers and milking the dying Kenya Airways. The outsourcing is proving injurious to the employees as terms of employment don’t meet with KQ’s.

For the last five years, KQ has been procuring loading and grooming services from Trade Winds Aviation services at about Sh150,000 per individual employee per month, yet individual employees end up being paid mere Sh10K monthly. The rest, your case as good as mine, the outsourced companies apparently colluding with management to fleece the workers.

Information given to Kenya Insights by the section of KQ workers reveal an ugly truth that the company is paying the most pathetic and exploitative salary in the region’s aviation sphere. Flight Attendants world-wide are paid handsomely, and KQ is paying even International Flight Attendants As Low As 35K salary, yes you read that right, thirty-five thousand Kenyan money. Now you see why they won’t hesitate at a snap to move for other airlines. KQ is making enough money, but poor, selfish management is running it down.

Dadaab’s Broken Promise: New Report Criticizes Closure of World’s Largest Refugee Camp By Kenyan Government

“The deadline to close the world’s largest refugee camp must be lifted,” said Jan Egeland, Secretary General of the Norwegian Refugee Council (NRC). A new report released today by NRC criticizes the returns process from Dadaab camp in Kenya to Somalia, as no longer being voluntary, safe or dignified.

The report, titled Dadaab’s Broken Promise, says that the decision by the Government of Kenya in May to close the Dadaab refugee camps has led to a situation where the voluntary returns process does not meet international standards, and breaks the agreement that Somalis would be assisted to return home safely and voluntarily.

“We are willing and able to enable voluntary return, but the pressure to push more than 280,000 registered refugees from Dadaab camp has led to chaotic and disorganized returns. From what we have seen on the ground, it is no longer voluntary, dignified nor safe,” said Jan Egeland.

“Refugees in Dadaab need international protection. The Kenyan government and the UN refugee agency should reinstate the organized and voluntary process of return under the Tripartite Agreement. The unrealistic deadline must be removed before the situation further deteriorates,” Egeland continued.

The Tripartite Agreement for the voluntary return of Somali refugees from Kenya was signed by the Kenyan and Somali governments and UNHCR in 2013. It was based on international law and created a framework in which returns were to be organized.

“The initial returns programme under the 2013 Tripartite Agreement was largely a success, as it saw Somalis would be assisted to reach their return locations safely and with dignity. We should return to the terms of this agreement, rather than simply aiming to push back as many refugees as possible,” said Egeland.

NRC’s new report highlights the major failures of the current returns process. In addition to failing to meet international standards for voluntary return, the report finds that refugees returning to Somalia are not sufficiently protected. It also reveals that the pressure to speed up the repatriation process threatens to create a revolving door scenario.

“The number of vulnerable Somalis planned for return far outstrips the resources available to support them in Somalia,” warned Neil Turner, NRC’s Country Director in Kenya. “Sustainable return should form a key component of the returns programme. It must prevent families ending up in displacement camps in Somalia or returning as undocumented refugees to Kenya.”

Over 80 per cent of the population in Somalia lives in poverty, and over one million people are internally displaced. Basic social services and infrastructure are mostly non-existent or at best limited. In addition, the security situation in many areas remains fluid. An overwhelming 74 per cent of Somali refugees in Dadaab said in August that they are not willing to return yet, largely fearing insecurity in Somalia.

    Facts and figures
    • Over 900,000 Somalis are registered as refugees, mostly in neighbouring countries.
    • Kenya hosts more than 335,000 Somalia refugees, including over 270,000 in Dadaab refugee camp.
    • An estimated 1.1 million people are internally displaced in Somalia.
    • Somalia is one of the poorest countries in the world. 43 per cent of the population lives on less than US$1 per day, and the life expectancy is just 51 years.
    • Somalia ranks among the five least developed countries in the world, according to the UN’s 2012 Human Development Index.
    • Five million people in Somalia – more than 40 per cent of the country’s population – do not have sufficient food. This includes more than 300,000 children under 5 years who are acutely malnourished.
    • About 3.2 million people in Somalia need emergency health services, while 2.8 million people require improved access to water, sanitation and hygiene.

  • Student Sheds Tears After Adelle Onyango’s Self Awareness Talk At Machakos Girls High School

Student Sheds Tears After Adelle Onyango’s Self Awareness Talk At Machakos Girls High School

“...So the emotions just rolled down her face. It was so humbling. A reminder that, what I’m doing and my story, is influencing and inspiring so many people!” – Adelle Onyango

NAIROBI, September 10, 2016: Over the weekend, radio queen and social activist Adelle Onyango joined three other top female personalities in a mentorship event dubbed #NajijuaNajiamini held at Machakos Girls High School.

Hosted under Champs Foundation, the campaign is a brainchild of radio presenter Mwende Macharia, who hopes to use the campaign to “create awareness among young people aged 15-24 years on self empowerment, self confidence and self appreciation”.
For this edition Mwende invited Adelle together with radio presenter Mwalimu Rachel, gospel star Bahati and Liz Marami, the first female marine pilot.

“It’s powerful when, we, ladies in the media get together to inspire and mentor our little sisters. The illusion of jealousy is just that, an illusion. What we are doing is bigger than us,” Adelle explained.
Adelle gave a talk to the hall full of teenagers about the importance of being self aware.

“I spoke about my journey, roughing it out even after losing my parents, especially my mum. I gave a speech about speaking your success into existence. Moulding your identity but leaving room for you to grow and unlearn things. I emphasized about the company you keep, basically, you are the average of the four people you hang out with,” Adelle said.

After her talk, one of the student’s – Georgina – was overwhelmed with emotion and narrated how “she always listens to me since I joined Kiss FM. She even knew I joined in 2013!!!!! She always dreams about joining not any radio station but Kiss FM! So the emotions just rolled down her face,” an equally emotional Adelle said, “It was so humbling. And a reminder that, what I’m doing and my story, is influencing and inspiring so many people!”

This is part of Adelle’s desire to create social change and empower the girl child; she is also the brand ambassador of Intel® She Will Connect.

Recently, she joined over 150 women from Narok in a week long digital literacy programme that is aimed at giving women and girls the opportunity to acquire or improve their digital skills while expanding their understanding and use of technology.

A unique platform was used to dispense the training – a custom built trailer with a 40ft container that has been redesigned to become a digital classroom equipped with PCs, internet connectivity, digital screens and trainers that can accommodate 30 women at a time for training.

Narok became the first county to benefit from the Intel® She Will Connect Digital Caravan that will embark on a nationwide tour visiting other counties including Machakos, Muranga and Nairobi and will be a major boost to ongoing sector efforts to bride the large technology gender gap in Kenya.

Following the week long training in Narok, it is envisaged that the women and girls will have tools to enable them to attain skills to improve their education, enhance their political participation, have a stronger voice in their communities, and increase their income by connecting to new economic opportunities available online.

  • Demystifying The Lies That Chris Brown Broke A Female Fan’s Phone in Mombasa

Demystifying The Lies That Chris Brown Broke A Female Fan’s Phone in Mombasa

The most anticipated performance of the year in Kenya finally came to reality when the international RnB star Chris Brown finally touched in in his private jet for one of the most expensive concerts in the recent times.

As he was making his way out of the airport to his waiting car, like he has been, Chris encountered an excited fan who asked for a selfie with him, but he politely turned her down saying “No baby.”

Unconvinced, the lady identified as Brenda Chepkoech, followed the superstar to his car and photos show the same. Reports emerged in the media moments after Chris left the airport on sections of media especially Nation Media Group that the singer had smashed the fan’s phone.

In an interview with NTV, who by then were under pressure to justify and give proofs that indeed the singer smashed her phone, Brenda says Brown grabbed her phone and threw it away when she was positioning herself to snap a selfie.

While it’s manner less and high scale psycho case to follow him even after turning down selfie request, it’s hard to believe the incident occurred since no footage has emerged to prove the allegations. It’s important to note near to 50 journalists were at the airport to receive the singer and all his steps from the jet to the car were covered. It’s nearly impossible for such a scuffle to go uncaptured with the dozens of cameras that followed him. The impact on her phone which from physical appearance look unscratched also disqualifies her allegations.

Enjoying her 40 seconds of fame, she’s showing the phone to journalists. You can see her phone unscratched

As usual, social media users who were sitting waiting for the pettiest moment to snap on took to Twitter trending #DeportChrisBrown basing their judgments on nothing but hearsay. No evidence to prove that he smashed the phone. This happening months after Koffi Olomide was deported following an assault on one of his dancers. The whole incident was caught on tape, unlike Chris.

She's still having her phone with her as Chris Brown enters his car. Said in NTV interview that he threw it away when entering the car

Well, Brenda, you’re lucky enough Chris called you baby, and you can go around telling your friends Chris Brown smashed your phone, not a bad thing of you asked me. Learn to let go when one says No. Anyway, lies don’t stay for long; you can’t sustain a lie. It shows. Now let Chris Brown rock Mombasa.

  • A U.S. Report Reveal Kenya Engaging In Crude Child Labor With Skyrocketing Child Prostitution and Pornography

A U.S. Report Reveal Kenya Engaging In Crude Child Labor With Skyrocketing Child Prostitution and Pornography

A report commissioned by The US’ Department of Labor on Kenya has revealed some disturbing statistics, the annual Findings on the Worst Forms of Child Labor focuses on the efforts of certain U.S. trade beneficiary countries and territories to eliminate the worst forms of child labor through legislation, enforcement mechanisms, policies and social programs.

The Report serves as a resource to foreign governments, NGOs, academics and policymakers working on labor and human rights issues.

The report has established that Kenya has made a minimal advancement in efforts to eliminate the worst forms of child labor. The Government continues to expand social cash transfers to additional households as part of its National Safety Net Program for Results and implemented and participated in several programs to combat the worst forms of child labor. However, the report finds that children in Kenya are engaged in the worst forms of child labor, including in sand harvesting and commercial sexual exploitation.

Kenya has yet to ratify the UN CRC Optional Protocol on the Sale of Children, Child Prostitution, and Child Pornography and its minimum age for work law and compulsory education age are not harmonized due to the lack of a particular compulsory education age. The Government has also not committed sufficient resources to enforcement efforts.

The report notes the commercial sexual exploitation of children, sometimes as a result of internal human trafficking, which is apparently dine by relatives and friends.

Sexual exploitation of children the report indicates is a major problem in Kenya, especially in Eldoret, Kisumu, Nairobi, Nyeri, and in coastal areas. The majority of children engaged in commercial sexual exploitation are girls, but boys are also involved.

Coming at a time when paedophilia cases have been increasing with latest being one Alfayo who bragged on the internet for sleeping with a small girl amongst many other reported and unreported cases of sodomy and rape. Several interventions have been given in the report for the government in ensuring safety and protecting the children.

I Will Finish You; Boniface Mwangi Refuses To Apologize To Ruto Over Killing Juma Remarks Dares Him To Sue

Battle of Titans seems to be lined up as the journalist and human rights activist Boniface Mwangi declined to apologize and retract a tweet aimed at the DP Ruto. Through his lawyer Kilukumi, Ruto had given Mwangi a grace period to retract and apologize for a tweet in which he accused and warned the DP against killing him the same way he did to the Spain businessman Jacob Juma who was murdered in a suspected State execution.

Before his execution, Jacob Juma had transformed into an anti-corruption crusader who vehemently insisted and accused the DP of being a corrupt figure and pointed fingers at him for plotting to execute him over his vocal stand against him. It will be interesting to watch of the furious DP who attacked Mwangi in a TV interview as a drunkard will go ahead with the lawsuit given stakes that it holds or will chicken out.

Reacting to demands by Ruto to retract tweet and apologize, Mwangi has dared the DP to go ahead with filing a lawsuit so he can find an opportunity to defend himself in Kenyan court over his involvement in PEV which he didn’t get a chance to defend himself since the case was terminated with prosecution citing incorporation from the State and interference with the witnesses. Yebei, a key witness in Ruto’s case, has been adversely mentioned in this angle.screenshot_2016-09-29-07-35-45-1mwangi1-680x365

Mwangi has dared to go ahead with the intended lawsuit so he can defend himself against allegations in him that were publicly made by the slain businessman on plotting to kill him. In a cracking punchline through his lawyer Gitobu Imanyara, Mwangi maintains Ruto is a public servant who should stand harsh criticism going further to say the DP has no reputation to protect as the public portrays him as a corrupt and filthy figure. How this case goes we can only catch a breath and watch

  • Ben Gethi And Convenient Amnesia On NYS Heist

Ben Gethi And Convenient Amnesia On NYS Heist

Public Accounts Committee has this morning questioned the unscrupulous businessman Ben Gethi Wangui over the missing NYS Shs.791 million.Mr. Wangui has been accused of stealing the said amount alongside Josephine Kabura and other six who have been charged with 15 counts of money laundering.

The eight are accused of colluding with devolution ministry officials to wire the money from NYS coffers to purchase property through phony companies. Watching Mr. Wangui defend himself before PAC is a waste of time and public resources. The charlatan takes nothing seriously, asked to describe himself, the man who claims to come from Nyeri but was born in Garrisa cannot remember when he came to Nairobi when he cleared school and the names of his business partners.

This is a rude chest thumping act because the transactions in question were a syndicate between him and the high and mighty government officials. He purports to have been the supplier with NYS for five years, way before the former CS Ann Waiguru was appointed to head the devolution docket. This is a cover-up aimed at protecting Waiguru who bowed to public pressure for her involvement in the infamous NYS scandal.

The documents presented by Mr. Wangui to PAC indicate that he qualified for the tender to supply his over priced oil in the 2013/ 2014 financial year when Ann Waiguri was heading the docket. Anyone who watched the interrogation was able to notice the way he was dodging straightforward and direct questions that needed one-word answers. He could not tell the exact year he began supplying NYS with overpriced commodities.

The con went further and presented a bank statement of one John Kago Ndung’u. When put to task to explain why he had submitted another man’s bank statement; he hesitated for a while and could not tell the relationship between him and John Kago when asked about it. He apparently kept evading the questions and gave answers that cannot convince even a mad man.

Using ‘convenient amnesia’ to safeguard himself against hard-hitting questions, Mr. Wangui took advantage of some the of committee members’ abnormal leniency to give filtered information to sail through the probe. The likes of one Hon. Kareke Mbiuki, a panel member, at some point, sounded like he was Mr.Wangui’s advocate. He said hustlers could be forgiven for their ‘forgetfulness’ giving an unconvincing example of DP William Ruto who rose from selling hens to the position of deputy president.

Consolidating his weak point that hustlers cannot document their transition from rags to riches, one need not be intelligent to notice that he was trying to take sides. Kenyans are tired of games, hundreds of millions were lost and youth dedicated projects stalled, watching Ben Gethi Wangui before PAC is a bitter pill to swallow and a further waste of taxpayers’ money. The man belongs in jail.
